    I seriously doubt she was out it of status. But you certainly are implying that her intent is to enter the US and stay, she applied for a non immigrant visa not an immigrant one so she applied for the wrong visa.

    He can certainly try for an Expedite, it is free, a lot will depend on the quality of the medical evidence. Like you say 58 is hardly an issue. There is also the practical issue with an expedite, that if there are no appointments there are no appointments.

    My first thought is the need with so little evidence to get a detailed statement from her about the validity of the relationship, not a big fan of Lawyers bit can see this is a good example of where one could help.

    They are not eligible for adjustment of status, they will Consulate process. I think the child will be able to stay in the F2a category, he will be 20 ish when a visa number is available assuming current trends continue. That far out anything is going to be a bit of a guess.

    I am going to assume the Satisfactory Departure she applied for did not overrule the automatic no longer eligible to use the VWP because she overstayed. I would have thought a B would be very likely to be issued in the circumstances.
