AneliaO got a reaction from Crazy Cat in Successful online wedding before K1 visa issued, now waiting for AOS (split topic)
I meant that if all else fails. We will do the online marriage while I am in Morocco and then file for the spousal visa upon my return to the states. We will exhaust all avenues for K-1. I know it is not recognized in Morocco. But we will use it as one way to show a bonafide relationship. We are getting married one way or another.

You gave me another COA to think about. But I plan to get a lawyer to ensure we have our Ts crossed.

I disclosed everything. In my post, You can read the letter I included with my petition. I even included the marriage certificate. The original intent was to get married in the Philippines when I was there for 3 months, but things happened and we ran out of time before I had to return home. She wanted to be married, so we chose the remote marriage path, not thinking about the immigration process. I never did any research until after the fact. Based on my research the K1 visa was the path forward.

I met my wife online and spent 3 months in the Philippines together. When I got back to the states, we got married in an online zoom call. We filed a K1 visa and was approved. We are now waiting on the AoS approval.

We got married online through Utah’s virtual marriage process — it was quick, simple, and completely valid. It’s especially worthwhile in places like the Dominican Republic, where same-sex marriage isn’t legal. To prove consummation, we submitted a hotel bill from our honeymoon and pictures...

Lack of time off isn't a concern of USCIS/DOS. Actual time spent together in person is important for high fraud consulates.

the CR 1 can also be denied (our 1st one was and we had to appeal and reapply)
You need to actually know what CO saw on computer and why denied the K1
Casa will not say age difference as that is age discrimination / the CO will come up with something he says to deny
For us the CO said "i did not know what books wife read"
and we had a long discussion of this in text messages with her trying to tell me and me saying "i never heard of Shakespeare and Mark Twain"
so, i did see but didn't know these books
You need to talk to the bene and find out what was asked and bene's impressions of the "turn around " when the passport was returned
you also need to formally withdraw the K1 -letter to USCIS office will do that -case $, both names and both DOB's/ you can send this letter in with the new I 130 for spouse visa
If you have to go to consummate the marriage from Utah zoom, why not marry there? Make sure Casa accepts (immigration does but how do the consummate the marriage?)
Reason is
Morocco does not accept it as legal meaning u can not stay in same room with him-not even to eat or a motel ,or person who rents an apartment as they are required to see marriage certificate
A Utah Zoom marriage, legally performed via Utah's online marriage laws, is generally not recognized as valid in Morocco. While Utah recognizes online marriages, Morocco typically requires marriages to be performed in person or according to local religious and legal customs

Yes they are, but that is a big red flag, coming from Morocco, is a high fraud country
You need to spend lots of time together, pics of you and your other, parents, friends, family, events, etc. a few trips would help your case.
But then you have to consumate the marriage before filing your petitions with USCIS.
Best wishes.

Yes, and the location of the marriage will be the location indicated on the marriage Certificate. It's actually the location of the officiant, usually a judge. Although Utah County is the entity dealt with, sometimes the judge is in another county.
To reiterate, the petition cannot be filed unless there is evidence of consummation included. Unless the couple is physically together during the ceremony, they must have evidence of being together in the same country between the marriage date and petition filing date.

AneliaO reacted to JeanneAdil in Denial during K-1 visa interview
Unfortunately this is so true but the age gap of over 10 years would be the real reason
On the CO's computer he/she may have seen a remark from a superior that had previewed the petition and recommended the denial
OR
could have seen you spent little quality time together
OR could have seen something on a media site
In Moroc time spent together is so important
showing Morocan family -especially the mother- approves is important
Now you are faced with the issue to end or pursue a Moroccan marriage and CR1 visa
the steps to marry in Moroc are outlined in the following site
https://ma.usembassy.gov/u-s-citizen-services/local-resources-of-u-s-citizens/marriage-in-morocco-2/
it requires quite a bit of travel inside moroc to marry
an appointment 1st at Casa embassy to get avidavit to marry (cost about $100)
then to translate all US documents (most expensive part of the process)
then to Rabat to Office of foreign minister
then to hometown to interview with police and judge
and wait for permission to marry
took us 3 weeks

AneliaO got a reaction from OldUser in Denial during K-1 visa interview
There is an age gap of 18 years. My fiancé said the interviewer was kind but changed his demeanor once he reviewed something his computer. We didn't know we needed to ask for an extension. They do not communicate at all.

AneliaO reacted to SL2024 in Denial during K-1 visa interview
When I had my K1 visa interview I took a signed statement of intent to marry each from me and my fiancee at the time (now my wife) to re validate and extend the petition.
As my interview was just over a month after petition expired and I didn't want to assume that it would be automatically extended (I was also advised that embassies don't always automatically extend petitions and to take the signed statements of intent to marry from us both as well). The officer re validated and extended the petition at the interview after I gave her these.

AneliaO reacted to RJandHamid in Denial during K-1 visa interview
It seems like they likely denied you based on other factors like the age gap. Obviously no one here can tell you for sure, but we can tell you that K-1 visas in Casablanca are commonly denied with no real explanation. The I-129F petition expiration is just what is going to happen when the petition is sent back, I don't think you were denied because it isn't valid. Unfortunately this scenario is pretty common and the best course of action now is to get married and file a spousal visa petition.

There should not have been any doubts. My fiancé said the interview went well. He even took his passport. But when the interviewer looked at something on his computer. He gave my fiancé back his passport and gave him the document I attached.

AneliaO reacted to JeanneAdil in NVC case creation question
You do not do anything at NVC stage but Casa is pretty fast now to schedule K1 interviews so prepare by getting the documents from USC to Moroccan ASAP
List of needed documents on following site
It says I 134 for the income but USC also needs to send copy of photo ID showing US address to prove US residency

AneliaO reacted to Edward and Jaycel in NVC case creation question
You do not log into CEAC as a K-1 applicant. You will not receive an invoice number. You can check your case status here to see when it is sent to the embassy and marked as "Ready":
https://ceac.state.gov/CEACStatTracker/Status.aspx
When it is sent to the embassy, you will receive an email from NVC with a letter attached called the K1-FTP. Hang onto that as the beneficiary may need it for medical exam scheduling, etc.

AneliaO reacted to JeanneAdil in Visa Availability
although casa is hard for interviews and visa issues , the last month reported (February) show 56 k1's issued
As long as your case has no red flags and the pending immigrant shows good knowledge of the USC and USC lifestyle then best to u both
Understand that the biggest red flag is large age difference with the USC (a woman ) older than young Moroccan
but education differences , lack of job experience for the Moroccan, absence of Morocco family approval, woman not of child bearing age, and differences of religion also play into the interview
so, good luck to you both
