Again, Three (3) years after marriage and filing.
Please donot refer to him as your husband, if you'll are not yet legally married. Referring to him as such confuses the issues.

Hi guys i am a 19 yr old jamaican who is in the us on a visitors visa since december 2012,can my father who is a green card holder since 2009 petition for me and do i have to go back to my country?
You must go back before your say expires. It will take 3 years before a visa is avavilable for you.
-
Again the titled said field office closing in Kingston. The OP asked about traveling for a interview in Jamaica.
-
I have.
You mentioned nothing about Jamaica.
The title mention Jamaica, therefore I was responding to a Jamaican post. I can not nor would I be addressing the universal in a post that was about a field office in Jamaica.
The subject of the post was a field office closing in Jamaica.
-
I went to a USCIS field office for something.
LOL
In Kingston, Jamaica, what did you go for? Kingston hasn't done DCF since the last 7 years, so you just went to see if you could go?
To put it bluntly most people in Jamaica doesn't even know there is a field office there. So you must have been one of a few if you even have gone there.
-
No one goes to any USCIS field office for anything so I don't know what all the talk about travel is all about.
-
On March 1, 2013, USCIS will permanently close its field office in Kingston, Jamaica and the USCIS Field Office in Santo Domingo, Dominican Republic will assume Kingston’s former jurisdiction.
I's exacly as it is written, the field office, there is nothing about the consular being closed. All interviews are held at the US Consular in Jamaica.
Two different agencies tha two diffren aspects of the visa process.
The field office of USCIS receives and review visa petiions for DCF
The US consular revivews and awards and approves visa.

Here is the US Embassy in Jamaica website http://kingston.usembassy.gov/index.html there is nothing on here about any closing. Please post what you read and where did you ge this information.

i call her my wife but we still not married just living together for the last 3 years. i really appreciate the fast reply. my 3 years daughter is with my current partner and was born here( planning to married her).
Become a USC first, than file for all of them. You need to state your current situation correctly, if she is not your current wife hen don't refer to her as such. In order to be given correct responds to your questions the facts must be stated correctly.

Get a letter from the employer explaining such.
-
Yes, but she could either gain an annulment or possibly divorce him in the USA (divorce laws depend on the state she resides in). Having married before she disolved the previous marriage through annulment or divorce makes her a bigamist in the eyes of the law. Even getting the annulment now is not enough, because she got married before the annulment happened, and starting an annulment now proves that. Before you petition anyone, or she tries to divorce your bio dad, talk to a good immigration lawyer. It may be best to let sleeping dogs lie.
Why something has to be done, because even the Poster legal STATUS IS NOW IN jeopardy because he obtained his legal status through his mothers immigration journey.
-
There is annulment, that is the process she shou;d proceed with if you wants a chance to petition your father.
your mom should start filing annulment paperwork in Philippines

Great. perhaps you could have responded with your opinion without the ''people on this DIY site are the most negative there is'' . We all have how we air our opinions and views on different issues. It is well with you.
As I stated, 'people' on this site have the most negative attitude when responding to certain topics, stick around long enough and you will receive yours in due time.
I have been on this site long long enough to know and see how reaponds are given to different classes of people.
-
''People'' in his situation could mean someone or people seeking support to get a tourist visa which is normally given base on your own merit. And the poster of this message even went as far as directing the OP to the USEM website. l don't see nothing negative that was said. Maybe You have issues with how people air their opinion and views
If the tone of the written response is acceptable to you, than accept it. It wasn't acceptable to me and I responded with my opinion.
-
I have read all responses here and I don't seem to find where the ''negativity'' is in all the responses. A question was asked and it was answered rightly and you are playing the JUDGE here saying people here on this site are the most negative? Wow!
Maybe you are used to being defined as a class of "People" who has nothing to offer, so its okay to generalzed about someone they know absolutly nothing about.
"Why you want to go to the US doesn't matter" why someone is visiting does matter, it is the 1st question asked.
-

Maybe there is a problem with your reading ability, 'People in your situation have little chance. You are already living away from your own country, proving you are willing to immigrate. You must understand the " strongest ties " rule to have any chance. That means PROVING your ties are to Ghana. Hard to do no matter what but very hard to do when you arent even in Ghana and have been away for a year."
Now tell me who is "people" in this content. Before you try to judge read whaat is written.
-
You people on this DIY site are the most negative people there is, correct a letter of invite is not needed, but noone can predict an outcome just based on a person, race, country, education or finance. Stop trying to play GOd.

A vistor visa can be applied for, don't let the negativity stop you and your cousin from trying. It you don't take the chance and try you will never know if you could have turn a negative situation into a postive one. Yes, the Consular does care why you are trying to visit the US, if asked just be truthful.
There are many people from all walks of life and countries who are granted a visitor visa. So do not let what is said here stop you from trying.

At my stepson's green card interview, we explained our plans for my stepson to finish his degree abroad and were told by the interviewer that it would be fine as long as he didn't stay out of the country for 6 months, so we saw no reason to get a re-entry permit, and he has never been gone 6 months. But I am afraid you are right about the situation. And in reading online, it seems that the re-entry permit is not even a guarantee, although they say it is unusual for someone with a re-entry permit to be denied entry. And, as I understand it, the re-entry permit allows multiple re-entries. I can't imagine having to apply for a re-entry permit every time he is coming to the USA.
I think that tomorrow I will call customs at our airport here is Detroit, and see if we can get a meeting with someone and talk to them about unflagging my stepson so he can re-enter one more time for his biometrics. Maybe they will have some sympathy for our situation as it is not so strange for an American to go to a university in another country, especially one that they have already been going to before they received their green card. I guess the worst case is he misses a semester of school, loses his tuition money, and I pay rent on an apartment that he won't need until the fall.
Why would he have to miss a whole semester, file the paperwork today, within 2 weeks receive letter for bio appt, do an early walk in, them leave country and pick up reentry permit in Russia. You are making it more complicated tahn it really is.
-
He needs the re-entry permit. There is no way around it. If he has obtained this before he started staying out for school, he would not be having this issue... he may have to stay long enough to do his bio, for the rentry permit. He can pick up the permit at the consular in Russia. He must apply and do bio here stateside.
Alla and Gary can't change the rules nor procedures.

Was there something in the Guide listed here that you didn't ubderstand? http://www.visajourney.com/forums/topic/297309-tourist-visa-guide/

Well eversince she was born, her parents name me as a second Mom for her. They even wanted me to adopt her right away. but I decided to wait. I even provide financial support for her since she was burn. Please note that this has nothing with her only coming here for citizenship status. The girl is like my daughter. She gets anything she wants from me. I went to see her last summer and will go back this summer. So, how do I bring her here to live with me. Thanks
Sorry but it has been explained, that based on the conditions in this child life now and yours you donot have any avenue avavilble to be able to legally adopt the child to have the child to go through the US immigration process. With this said, you can adopt the child in it's said country and the child can continue to reside there in their home country with you or without you now as her legal parents. This will not open availability for you to be able to bring the child into the US with the immigration rules and process that is presently in place.
