if you think colombia is safe right now you need to go do some research.
Every country has killings, people are living and making do. Country is still on the map. Babies are being born every day. No one is dropping bombs on Columbia, other countries have it worst. there are town and cities in the US that are just as hash as Columbia.
Your mother getting married doesn't do what you think, it doesn't just wavw you in with a white flag or a green light to go. Study the immigraation rules before you'll make poor decisions, that may effect the rest of your life.

Your mother getting married doesn't grant her citizenship. What so bad about going back to your home country, there are many safe place still there.
Making bad decisions will only compound and make the problem even bigger. Your mother needs to get the immigration facts straight first before she makes any ill gain decisions.

Your mother can file for you as her child while she is a LPR, but you will have to interview outside of the US. Have mother to file now, leave the US before you are 18 and 1 months old, therfore you will not have incurred any overstay.
BTW breaking the law doesn't make a good impression on any college or job application.

No, her boyfriend filed for a visa and listed her as his wife. She never claimed anything, he did.
Does it matter who claim, the fact is a claim was made to the US governmment under oath.

Facts; with a current population 500,000, there is probably a national marriage register. Therefore your sister could probaly get a letter stating that there is no record of her being registered as married. But BF, can kiss his current vistor visa and any other visa to the USA good bye.
I will state again, if by chance that child's Bc states that this couple register as husband and wife at the hospital/or Birth record registar at the time of birth of their child. Your sister will not be able to un-tangle this list of un-truth. She needs to tread carefully in her decisions going forward.
BTW, if your sister and BF has traveled to any other country together, this may also raise some concerns about the marriage.

I'm not very familiar with those visa regulations, but perhaps you could poke around other forums and check up on it on the US immigration pages? I know that dependents of students and employees can often enter on certain visas (F-2 for F-1 visas, is the one I've personally heard of).
She wasn't asking about a work or student visa, the oster stated in her 1st post that he was arriving as a LPR. Again, mis leading the poster away from her orginal question.
hello, my name is Jane 18, im from the philippines. my boyfriend is leaving at the 20th of january as an immigrant in Chicago. it's hard that we will be far away from each other cause we have a 1 year old son. my question is, how long will it take for him to petition me and our child and what type of visa should we apply for? should we apply for a k1 visa? we are not yet married and please help me what kind of visa should we apply for? which would be easier k1 or spouse visa? im looking forward to be with him in the US with our child. thanks!
A student or a worker would be a non-immigrant visa.

The guides here would help answer this. It'll take about 6-8 months (average right now) to get the petition approved, but then it will take another couple of months to get the visa approved depending on your embassy.
Also, listen to what Penguin (above) says. My estimate is based on the assumption that he is a USC, but if he's not then ignore me.

I believe I asked the same question a couple of post back, what country, and what does the child BC say. It was ignored, therefore I walk away with no other advice to give. Both of these questions are critcal to futher advice to be given.

You are over thinking a simple process. The USPS has the next day delivery down to a science, they have a lost rate of less than -.ooooo1 percent. Unless you address it incorrecly, than the failure to delivery is null.

I know for a fact they will ALL be open on 12/26 at 8:00 am, the 800 number will be avavilable at 9:00 am for calls.

Did you try calling the USPS 800 number and ask for the nearst 3 and phone them to see if they have what you need.

I guess my question is how many US post offices or UPS stores will you drive past in that one hour drive to a building that may or maynot accept mail at their door. Since 9/11 most US government offices do not accept mail delivery to their offices unless it is delivered by a reliable agency.
BTW both of these agencies the USPS or the UPS delivery mail next day guarantee delivery.

Her boyfriend applied for a visitor visa and was approved. He ticked married on the form and listed my sisters name as the wife. The child's bc has his name as the father. The marital status of the parents are not listed on the BC.
What country is this? Are you sure there is no martial status on the BC?

The issue is she never claimed to be married. Her boyfriend claimed he was married to her but they believed him without asking for proof. When she went for her interview she was asked if she knew him and she said yes he is the father of her child and boyfriend. They then said she will have to move to the married category because the records they have of her shows she was married to him. She told them they were never married but they insisted they have the same address and a kid so she should list her boyfriend as husband and bring a marriage certificate when coming back for the next interview . We are worried because she never married him and she does not want to misrepresent facts to the embassy.
What is listed on the child BC, did she list herself as married to the father of her child? Who was trying to get the visa inwhich someone claimed thy were married and what type of visa?

So who does the USCIS belive, at one point she did claim to be married. When she wanted the tourist visa she was married, today when she wants the family sponsor visa she is single. So how do you prove you are single, after claiming to be married.

Not sure where you live in the US or what news station you watch, but the President of the US granted all federal government workers Christmas Eve as a holiday.
Also your husban should be aware of the Jamaican holidays that are obsevered around the Christmas holiday.

It would be unlikely for the POE to second guess the Consulate. I have never come across it anyway.
Excuse me, but they do it every day. There are many who arrive upon with a valid visa, but they are turned back.

Please beaware, getting the visa is only one step, now you have to get past CPB.

A bank can refuse you the option to open an account, based on not credit worthleness. Since your SS card indicated you aare unable to work, their logic is you are not credit worthleness (s.p)
