He’s in AP, perfectly normal and no way of expediting it I’m afraid. They can ask for the passport to be returned if he needs to travel though. She can also look at filing a Writ of Mandamus to force a decision.

Very odd, sounds like somebody has made a mistake. Current PD for visas is 1st Dec 2021, so 2.5 years, but I think Ghana has quite a long wait for interviews. Maybe 3 years? It's as good a guess as any.

Hmmm very odd. The VB sets it out clearly, she shouldn't have been asked to submit docs as her PD isn't current for filing. Does her CEAC status definitely show E3 on it? Just wondered if perhaps she's been put in the wrong category by mistake. But either way I'm not really sure how or why it matters, there's no visa available to her yet, she's still got a long wait. It's not like she's going to jump the queue and get given a visa ahead of somebody else with a current PD. Visa availability is much more strictly controlled and there simply isn't one available to her yet.

The problem she's got is that any of those ties will pale in to insignificance when it comes to the tie to her children. So I think she's got an uphill battle as it will always be assumed that she wants to stay with her children.

Afraid I don't know, as we applied via an employment based immigrant visa route, so we didn't have to adjust status. Once we'd had the medical done in London, that was it.

3. You only need the first Hep B to pass the medical, and can have it (and any other missing vaccines) done at the medical. Both myself and my husband had the Hep B and were fine, we got our second dose before we left the UK and then our final dose (it's only 3) is being done in the US soon. Our children (age 16 & 18) had the joint Hep A and Hep B at the medical, but be aware that they give children a different one in the US, so they can't complete the course here. We're getting their final doses done at Christmas when we return to the UK, our son needs both for travelling with school next year anyway so might as well. All 4 of us were absolutely fine after our Hep A's and B's, and we each had several other jabs at the medical too. No side effects although as a fellow needle phobe I feel your pain on that front! I'm just glad I didn't need to have a blood test as well (only our daughter did).

Bottom line is that from what you've said you don't have a valid reason for an expedite. So he needs to tell them that and either cancel the request or just wait for them to refuse it.

Are you sure? Odd that they're asking for something so specific then. So what reason did he give for an expedite?

Are you saying your Dad said you were ill as the reason for requesting an expedite but you're not? Obviously they're going to require proof of that, you're asking to jump the queue ahead of everybody else that's already waiting for an interview. If you can't provide proof then you need to be honest and cancel the expedite request. Which consulate?

OK, so if both those PD's are correct and you're trying to compare the two cases - at the moment only one may be invited to complete the NVC processing (submit docs, complete DS-260, pay fees) as only one is potentially eligible to do so under Table B of the Visa Bulletin (depending on the country). The case with a PD of 20th June 2023 isn't able to do any of that yet regardless of which country they're in. But neither are eligible for a visa yet, they've both got quite a wait ahead of them. I'd assume that both will be DQ'ed well before their PD's become current, so at that point it just becomes a case of whether the earlier PD is current first, or both become current at the same time (if there is a big leap of dates on the VB).

There's no problem with that though, it's perfectly legal, and not immigration fraud (unless they actually intended to stay permanently when they got the F1 and entered on it of course).

I'd kick off with your GP - you have a legal right to it, they can't say no! A Summary Care Record is something every practice should be able to give every patient, it's not like it's not a normal thing. You're the second person I've read of this week whose practice didn't seem to know what a SCR is, which is just really odd. Mine had a webpage about it on their website and I just requested it on there, and had it emailed to me within a few hours. When you say your 'application was approved in June 2023', do you mean the I-140 petition? You mention the Feb 2023 guidance but that's only relevant if you're applying via AOS, where are you now? And which country are you from?

It totally depends, some months they seem to cut off around the 8th, other times it's midway through the month so you may just have squeaked in. Keep an eye on the CR1 IL thread as then you'll know when they go out this month.

5+ yrs going on current timescales if he doesn't become a citizen, maybe 3-4 years if he does. So he would definitely be best applying for citizenship asap (he can apply 90 days before his 5 year anniversary IIRC). He needs to not leave the US for too long or it will reset his 'continual residence' clock and he'll have to start all over again. https://www.uscis.gov/policy-manual/volume-12-part-d-chapter-3 Once he has citizenship then he can 'upgrade' your petition so that you are then an Immediate Relative with no limit on visa numbers. Just checking you’re aware that her visa will only be valid for 6 months from the date of her medical? Not a problem if you’re planning on leaving fairly soon after she gets her visa of course, but just something to be aware of.

They're right, the clinic has nothing to do with interviews, and I've no idea why they're even giving you a timescale which is clearly not correct. You need to contact the consulate.
