  1. Hello everyone. Quick update. Thanks to you guys we got married last month. Her birth certificate FINALLY came, so we submitted her paperwork and now we wait 8 months or so for her EAD works. 

     

    Anyway, we need her keys copied so she can send it to her aunt so she can clean up her apartment. She doesn't want to send the original because it might get lost. She also can't ask the landlord because she was the one who installed the locks. We tried to get them copied at Walmart but the machine won't take them. Anyone have suggestions for this?

    I am registered to perform marriages in Ohio also, just did my friends wedding the end of October.  I think I'll be back in Ohio the end of  December,  may be able to set you up.  A lot of counties in Ohio are doing all the licenses via online and a zoom conference call, then you can pick up your license.  It may take a few weeks to get your license,  so keep that in mind.  His was in Mahoning County. A lot of the court houses are backed up a few weeks scheduling the marriages also. You have to contact the clerk, then set it up with the bailiff on certain days and times, it was easier for me to fly out there and do the ceremony than it was for him to get his court house wedding  setup.     Thanks, but I live in the west side. It's in the boonies so the line probably won't be so long. 

  3. I am just worried the immigration officer will think we intended to use the visa for marriage. I read you should wait 90 days.

    In your last post you were advised to get married and adjust status. Why are you admiring this problem.  Less posting and more action. You’ve waited over a month which means it take longer for her to get a green card. 
     

    An approved I-131 will let her travel. But beware those are taking over 6 months.

    To summarize. I applied for a K1 visa, it is stuck in limbo. My fiance is here now on a tourist visa. We are waiting until February to marry so the UNCIS doesn't say she intended to use her tourist visa for marriage. She is wondering after we get married and apply for readjustment status if we can apply for "a pass" or something so she can go back for a couple months to say goodbye to her family and wrap a few things up.

    Honestly, it was probably better I waited. I didn't have a lot money when I filed it, but 2 jobs later I am making more money now than I ever was. I finished college a few years ago so I needed some time for experience. I moved out of New York, so my rent was cut in half. Guess I am saying I am more responsible now. I'm 26 btw!

This has the advantage that you don't need to be separated any more, but has several disadvantages: she cannot work legally or travel internationally until she gets her work permit/travel permit/green card, and she may not be ready to leave her PH job, assets or family right now.

    Whelp, I feel like the biggest moron ever. She doesn't own any property, have dependents, and works online. She doesn't make much compared to me, but since I live in Ohio and make ok money I can support both of us for a year. She just gives me $500 a month, which is like half her money her monthly income, but that pretty much covers her food and energy. We aren't rich, but we're not poor. Now excuse me as I scream loudly at that cornfield in the back over how stupid I am for not doing this 2 years ago.

    That is not accurate.  Visa fraud would only occur if she entered the US as a tourist with the INTENT to stay and adjust status.  Your post clearly states she entered with intent to leave.  Her intent was determined when she entered.  It is perfectly legal to marry and file an I-485 package to adjust status.  Just be aware that she cannot leave/re-enter the US or work for about 6-8 months.

    You're ###### kidding me. She had this tourist visa years before we met. You're ###### saying I could have just married her 2 years ago when I filed the K1 visa?

  9. I haven't seen my gf in 2 years and filed for a K1 in January 2020. If you aren't willing to wait for things to get better you clearly aren't in love with her. You're in love with the idea of being with her. This is going to cause you a lot of marital problems years down a line. I strongly ask you to rethink why you want a relationship to begin with. 

  10. I filed for a K1 and tried a Writ of Mandamas. The UNCIS filed a Motion to Dismiss on the last day of a 45-day extension after waiting the last day of the 60 days to respond. 105 freaking days...but my lawyers will make a counter argument next week then we get to wait 3 weeks for their counter argument, then we have to wait again for a judge to decide which can take anywhere from 1 day to 10 years. I angry that they just couldn't just settle and I know for a fact they are just trying to stall this out as long as they can. I am guessing it's gonna be another year and a half.
