    Wow these are some crazy questions... Can't imagine that's common and they ask everyone these. I've been in several local groups for a while and their questions are all tame, like when did you meet, what's the petitioner's job.

    This one doesn't have an expiration date, it’s effective until the president cancels it. 12/31 is another Presidential proclamation.

    Guangzhou has chosen to ignore it...-_- I asked whether K1 interviews will start, will it be plaintiffs only or not even the plaintiffs. I'm OK with plaintiffs only - my concern is even that doesn't seem to be guaranteed.

     

    Instead of the usual copy and paste response, they now tell me to go to https://china.usembassy-china.org.cn/visas/immigrant-visas/contact-us/immigrant-visa-unit-question/, which I did, it turns out to be a case-specific inquiry and gave me nothing, since my case is still at USCIS. But I was asking for genenral information and not specifically about my case, seems like they're dodging the question.

     

     

     

     

  4. Purpose of the visa aside, time is one important factor here.

     

    K1 is not a tourist visa that you can get within days and then come visit, it takes about a year to be approved now, and after that, only 90 days for you to "try dating". I assume your fiance doesn't have a tourist visa and has difficulty getting one, otherwise you can just try dating using that. Will this long distance relationship that you're unsure of last a year? Will you then be sure within 90 days? It just doesn't make sense to me.

    Doesn’t sound reassuring, nothing about how consulates should handle it, they could just continue to give the same “guidance” - unable to resume services and we don’t know when blah blah

    It literally says that named plaintiffs in proclamation countries should immediately contact them for an interview. Those who aren't named plaintiffs in those countries still won't get processed until the end of the proclamations. For people outside of those countries nothing changed for now.

    It doesnt say how the consulate should handle it though. Anyone at P3 stage can always contact them for an interview, thats not a privilege of any kind... the consulates can just say "cant do K1 interviews while routine services are suspended, we don't know when we'll resume" like they've always said. 

    I havent heard of a plaintiff contacting their consulate and successfully getting an interview or even a definitive answer. What did your consulate say?

    This is exactly my concern. Similarly, after the DV lawsuit,  some embassies have found other reasons not to issue those.

     

    Maybe this will work in our favor? In a recent post, State Deparment included fiances in immediate relatives. Guangzhou is processing CR/IRs, and without the travel ban as excuse, they should treat K1s equally... right?

The proclamation was to protect American jobs while the economy recovers, and to prevent those that want to do harm to the US and the economic recovery, from entering. There was nothing said, or implied was directed towards non immigrant visas. 

    You should read the proclamations yourself, yes, there are multiple. Can't discuss this when you don't even know what the travel ban is... What you're talking about is not the travel ban, which bans entry of all people who have been to certain countries, regardless of visa types, and it's certainly being used as the reason not to start K1 interviews.

    US Embassies and consulates decide whether they re-open or not, local governments don't have the right to decide for them.

     

    Besides that, embassies don't have to fully re-open to do K1 interviews. It's a matter of priority, many are doing CR1 interviews while being closed to other catogories. State Department has announced embassies are authorized to give K1s  high prioritiy.

     

    For some countries it comes down to the travel ban, a Trump Presidential Proclamation. Guangzhou consulate replied in an email that the travel ban is the reason they haven't started K1 interviews, and they won't start until that's lifted.

    A ceremony without certificate doesn't make you a married couple, a marriage certificate does. Try applying for a CR1 without a marriage certificatea and say we had a ceremony, will that work?

     

    Maybe there's religious/regional exceptions where a ceremony without marriage certificate can qualify as a marriage, that's clearly not what OP is talking about...

     

    Edit: and OP doesnt intend to do that before applying.

     OP can do whatever required ceremony in the US to get the certificate. The abroad ceremony is essentially just a party, not legally binding. Plenty of couples have one ceremony in the US and one in the country the other person is from, or in the country they decide to take a vacation to, without getting legally married in each of those countries.

    You can enter with the visa IF it was issued after March 28, then you can apply for a resident permit IN China. From what I hear, it's not hard for the spouse of a Chinese citizen.

     

    Visas issued before March 28 are not valid yet.

    Immigration knows their path - b visa, marriage, AOS, and approves their green card applications. I don’t know what’s left to be “caught”. 

     

    Obviously I do not recommend this path. And based on some decisions made by the government(and not my feelings about it), I use the word questionable.
