SHANE (USA) reacted to nykolos in Is Manila accepting expedites for K1?
I hope that you and your Fiance are successful, I mean that sincerely as someone who is the same situation.
Theirs a whole lot of promotion going on with lawsuits like these, so I'm quite suspect when these same people on social media come in here and promote it as well, members who claim that it works but are still waiting for the outcome, it's all just one BIG RED FLAG for me. You're confidence in law firms is far greater than mine, I just don't trust them, especially when their trying to drum up business.
Please keep us posted.

Like Daniel, I also joined the lawsuit to get my Fiancée🇵🇭 to America🇺🇸 ASAP.
Will we win?.. ...IDK🤷🏻♂️
If we win, will we be scheduled for an interview at USEM faster than if we hadn't joined the lawsuit at all?.. ...IDK🤷🏻♂️
But I chose to join the lawsuit because if it's successful, I know that I would have seriously regretted my decision to not join it when seeing the Plaintiffs reunited with their Fiancées sooner than later.
I also took this gamble because the lawfirms representing us have won several Federal cases in a row, so it seems not so risky.
Is $2500 a lot of money to risk?.. ...ABSOLUTELY!!!
If my gamble has a negative outcome, then I'm out $2500... ...but at the end of the day, that equals less than one week of pay for me as I net far more than $2500 in a week.
But I'm very optimistic that we will win. And with a positive outcome, not only will I finally be able to marry my Fiancée, but I'll be in a different tax bracket in which I will easily regain the $2500 lawyer fee.
Ultimately, it is ridiculous and totally unfair for USEM to stop ALL Routine K1 Fiancée Visa Interviews/Processing for over a year now, while processing other Visas.
Therfore, I sincerely hope that we are all reunited with our Fiancées ASAP!

It’s actually 2.6 million in the backlog. Here was the article Greg was talking about:
https://www.cnn.com/2021/04/12/politics/biden-challenge-immigration-visa-backlog-invs/index.html
At this point, if you don’t file a lawsuit, you won’t get approved for a very long time. They are so far behind and have such a skeleton crew that I just don’t see it happening.

These are the top immigration lawyers in America. Relief comes via a writ of mandamus, that's what a mandamus suit was designed to do 🙂 Just to give everyone some background, they didn't want to take this suit at first, so it wasn't about the money. They wanted to make sure they could win the lawsuit and make sure they could get our cases expedited if we won. $2500 for mandamus suit is a steal. I checked with another lawyer before I joined who had no skin in the game and he said it was absolutely winnable.

Everything you said is completely false. Literally everything you said. Plaintiffs absolutely do get a priority, it's a mandamus lawsuit, did you know that? (educate yourself on mandamus) May 2020 is not a 2 month backlog once the embassy opens to regular K1's. They will not open to full capacity in the next year at the soonest (please read the news, either CNN or Fox will do for this topic) So that 2 months is more like 8 months to a year or more at best, and that's once they re open, whenever that is . Lastly, foreign travel is opening up in the Philippines???? Yeah ok, with covid spiking there and a president using it for a power trip? They have had the longest lockdown of any country and now the are going to open up????? Because you think they will???? Sorry man, you didn't join and you have a bunch of excuses telling yourself why. Unfortunately they are all a false narrative you have made up to make yourself feel ok with making a terrible decision. But hey, if that helps you sleep and night, that alright. 🙂

Do you have a link to the recording or a transcript? Or is that information strictly reserved for the plaintiffs?
In any case, I certainly hope it works out for those who joined the lawsuit. The delays have gone on far too long.

Ouch. We'll see if Daniel or one of the other plaintiffs responds. What a sad situation all around.

Sorry to hear you are in the same situation as us.Our approved petition has been at the embassy in manila since March 5th 2020 .Unbelievable the devastation caused by this embassy. If the grocery store employees at our local stores here in Texas were the same as the staff at the embassy there would be millions dead here from starvation. Its amazing our wonderful grocery employees can serve thousands each day with only a simple plexiglass screen ,not full enclosure and masks by all and no one is dying from that.We don't know what to do and the total lack of info from the embassy just makes it so much worse.I mean for God's sakes can't they even come up with a que and issue everyone a number so we can at least watch our progress? At this point their actions border on cruelty and total dis-regard for us.And we are trying to do it right and legally immigrate. If you hear anything please advise us all and i hope the best for you. terry

Hi everyone, after exhaustive work to get this off the ground, the it looks like the Milligan lawyers will be posting a onboarding link to their website either over the next few days (possibly Monday). I’m so happy that we may hopefully have some relief soon. If you want more info, please send me a PM.

The last update I saw, we were at 144 registered couples. It could be more now as that was when the deadline ended. The planned filing date is some time next week. They stated they are still accepting cases for onboarding if you were on the fence about joining!
-
SHANE (USA) reacted to DanielMarianne in Is Manila accepting expedites for K1?
The lawyers and actual people in the Milligan case who have won would disagree with you. If there’s an order from the judge, those plaintiffs get priority. Do they go in front of a case that’s actually being processed? Probably not, but they do get prioritized over others. Generally the embassies would like to get lawsuits out of their hair as quickly as possible, and just adjudicate the cases to get it over with.

Yes dude. You could surely book round trip tickets to see your fiance in many parts of the world starting Dec 2021 (assuming everything opens up) But you are always gonna do that and see her in Maldives, Dubai, Costa Rica for only a few weeks at a time? Up to what point in time will you eventually marry her- 2023?
Fyi. Google about the Milligan vs Pompeo lawsuit. The first rounders got their interviews. Oh wait- were they ladies who chose military men, did they make babies with them before the wedding? Oh no. They did Not qualify for the expedites yet the lawsuit worked.
In August 2020, the travel.state.gov statee this line “k1 are now given priority. But this depends on post-specific conditions. “ that was freaking 2020. Wth happened to USEMB Manila?
This statement was only put up in that website because the state learned of the brewing Milligan Vs Pompeo Lawsuit and they had to Make that press release that K1s are being processed so the assigned Judge in DC state will see to that when the preliminary injunction was filed in October 2020.
Wait for the embassy? Dude, US EMbassy Manila alone has got 9,000 k1 applicants waiting to be interviewed.
An online Interview will
never be done because the K1 is the most notorious visa application. The strictest and trained Consular Officers in the universe were planted by the Immigrant Visa chiefs of the State in US Embassy Manila because we got the highest number of k1 visa Applicants in Planet Earth. Go to travel.state.gov and in 2019 alone 7,134 k1s were issued. Highest in the world.
Manila Also is notorious for having couples with age gaps between petitioner and beneficiary of 20 plus years and up. Thus every CO is trained to check the body movement of the applicant, hands, eyes the way she talks even if it is only a 3-minute interview.
You clearly got the money to Join mandamus lawsuits but you choose not to. Well it is your call bro. Do not wait for the day that your lady-love will whine to you in the future telling you “babe i wish we joined them. I see their wedding pics on Facebook. “. It is your call.
Legal terms:
Plaintiffs not litigants
The Milligan vs Pompeo and the new Manila Mandamus are not class action lawsuits. They are called Mass Litigation only. Class action lawsuits takes years and will also benefit non-paying applicants. It has never happened in the history of K1.
God Bless.

SHANE (USA) reacted to DanielMarianne in Is Manila accepting expedites for K1?
That’s fine you feel that way. I’d urge you to actually look at the details of what the case is about and what it’s trying to accomplish. It has a legal team that has a successful track record, and while no litigation is 100%, we feel cautiously optimistic. But if you only want to spread negativity, then I’m sorry that this upsets you so much. However, don’t go whining when we are with our fiancé’s for Christmas while you are still waiting as you look at her on your phone. God bless. 🙏

SHANE (USA) reacted to DanielMarianne in Is Manila accepting expedites for K1?
They should either do away with K1 interviews during this time, or allow online video visits to those who are able. This is just government incompetence IMO. The most egregious part about it is that you still see B and J visas being processed over reuniting couples.

Both must compile the evidence request to prove the couple will not become a ward of the state or public charge. Here is what is required.
EVIDENCE OF SUPPORT: You must submit any evidence which will show that you and members of your family who will accompany you are not likely to become public charges while in the United States. Visa petitioner (US Citizen) will have to complete form I-134. If the petitioner does not qualify as a sponsor, a Joint-Sponsor should present (any US Citizen living in the US or Legal Permanent Resident), who will also have to complete form I-134. Both the Sponsor (Petitioner) as well as the Joint-Sponsor, will have to present last year's income tax return transcripts. W2 form and proof of current and sustainable income (e.g., letter of employment on letterhead including salary and start date, most recent salary receipts, bank accounts, the value of properties, etc.). You may download the I-134 affidavit at https://www.uscis.gov/i-134. Bank statements in place of a letter from the bank will work just fine. Print the statement that shows the opening balance for a month and the closing balance for that month. Do that for 12 months—no need to print off all pages of a bank statement.
Get the IRS transcript in place of the actual 1040 here:
https://www.irs.gov/Individuals/Get-Transcript
Use this link to determine the income levels needed https://www.uscis.gov/i-864p

SHANE (USA) reacted to Greenbaum in Air travelers will need negative Covid test to enter US
Air travelers will need negative test
Share By Cate Chapman, Editor at LinkedIn News Updated 4 hours ago Most air passengers coming to the U.S. from abroad, including children from the age of two, will be required to present a negative COVID-19 test taken within 72 hours of their trip. The new rules, introduced by the CDC, come into effect Jan. 26. Only certain passengers transiting through the country or coming from places with little testing capacity will be able to enter the country without a negative test. The U.S. currently bans most visitors from Brazil and Europe.
Roughly 2.2 million new coronavirus cases were reported in the U.S. in the first 10 days of 2021, per Johns Hopkins University data. More than 27,000 COVID-19 deaths were also reported over that period, putting January on track to be the deadliest month of the pandemic. Arizona, California, Oklahoma, Rhode Island, and South Carolina are the five states seeing the most daily new cases per person, according to The New York Times.

Maybe a 3rd country then.
Although, I honestly don't understand the rush to marry someone you've never met.

Yes, because you have your final Divorce Decree, you are eligible for the K1 Fiancée Visa.
However, you can not file form I-129F with the USCIS unless you have first met her in-person within the last 24 months and you have proof of your physical meeting.
On a side note... ...America unfortunately has turned marriage into a financial contract so protect yourself in the future with a prenuptial agreement.

Eligibility
U.S. citizens who will be getting married to a foreign national in the United States may petition for a fiancé(e) classification (K-1) for their fiancé(e). You and your fiancé(e) must be free to marry. This means that both of you are unmarried, or that any previous marriages have ended through divorce, annulment or death. You must also have met with your fiancé(e) in person within the last two years prior beginning the K-1 Visa petition process (filing the I-129F). This requirement can be waived only if meeting the non US Citizen's fiancé(e) in person would violate long-established customs, or if it would create extreme hardship on the US Citizen.

That is the most current copy that I have. If you add your country/regional thread from the sub-forums as one of your go to places, then you would be interacting with others from Columbia. I'm afraid you will not get an answer to your question from those who are processing in Germany, Nigeria or Greece as they do not need to know the current status of the Columbia P3.
You should consider to be a part of the conversation for your country here on VJ. Go to the blue ribbon above, select "forums" then scroll about three-fourths of the page down and select the region that most represents where your country is located. There you will find others from your embassy who are asking the same questions or exploring thier next steps.
If you find anything not up to date or the information is wrong, please share your findings. Please compare the date of the P3 of mine with the date from your copy, once you receive yours from your embassy. Keep in mind that I try and be factual with my information, but I can't do it on my own and that's where you come in and can give back to the community those who come behind you. Without others ahead of you I would not be able to provide this to you. I can only share factual information if folks like you continue to be my eyes and ears for your embassy. I wish you much success in your visa journey.
