    The 3 years is counted from the date on the green card, not from the date she arrived/got married. If her green card expires June 2024, that means the "clock" for N-400 began around June 2022.

    No.  To file the N-400, she must have been married to a US citizen for 3 years AND she must have had a Green Card for 3 years.  She cannot skip the I-751.
    The 3 year clock for citizenship started when her Adjustment of Status was approved.   Normally, the N-400 can be filed about a year after the I-751 is filed.

    I went to a restaurant in LIC recently.  Guy at the door told me I need a vax card to eat inside, but I could go inside and order to go if I wanted.  So I said I'd just get it to go.  Ordered my food, walked over and sat down and ate.  

    They don't care, because they want money to stay in business.  As it SHOULD be.

    That's what I'm doing, Not getting the vaccine and my life is normal.
    In NYC by the way,  places just have the sign on the door that says you need to be vaccinated to enter, but in a lot of places nobody actually checks or cares about your vaccine status, I even asked and they told me they don't care, the only places that actually check are gyms and museums.

    There's actually a third option... NOT getting the jab, and going on with their lives just fine and dandy.
     
    And I'll add to @brendaaa story with my own anecdotal data... my family knows five people who have died after getting vaccinated.  One was late 40's, and otherwise healthy.  Got the first jab of Sinovac, started having bleeding issues that night, and died within three days.  The others, I think they died after the second jab, but cannot actually remember all the details.
     
    Death and adverse reactions are NOT imaginary my friend.  Just because you don't want to believe it does not render the cases untrue.

    Why you so mad? and accusing me of lying? I simply said what I know about people I personally know, who are you to call me a liar?
    Yes I do know 4 people! my friend (40), my friend's dad (65) , my dad's girlfriend (56) and my aunt (63).

    You say it's safe and there is no danger but I personally know 4 people who got the vaccine months ago in Israel, that got injured and their world turned upside down, doctors admitted this was caused by the vaccine. one is 40 years old who is now paralyzed after the booster shot.

    Wondering if the "covid-19 vaccination requirements for foreign visitors" is applicable to K1 visa holders? or is there a NIE for K1 visa holders who are not vaccinated or are vaccinated by non-USA-approved/recognized vaccine?
     
    I remember K1 visa holders were exempt from the former ban on foreign visitors entering US due to embassy giving K1 Visa holders a NIE (National Interest Exempt)

    I have some good news for lawsuits stuck at the NVC. My friends K-1 visa petition is being moved from the NVC to US Embassy in Manila after a judge ruled in his favor. It was a 9 month lawsuit!!! I’m so happy for him! So there is hope after all with these WOM lawsuits. Now my case may be much different but at least some cases are being pushed through. This is also a relief to know that there was no issue with his petition being expired!!!!!!!! Great news! Glory be to God!

    So yesterday was my Medical at St. Lukes, no sign of illness, no fever, no cough just plain excited and of course Im negative in swabtest. 
    I was surprised when they told me that I need to do a Sputum Test, at first im confused because my last Medical July 2020 im good. 
    So, 3 days collection and today was my 1st. I have a hard time coughing since I dont have like bad cough and I gagged the entire time trying to spit and if i drink cold and eat sweets  thats when l get cold cough. My spit (sorry) was clear and im so confused how they concluded i have "something" in my lungs. 🤦‍♀️ they should have concluded after 2x attempt of xray and not just " they saw a line, something" once,
    Oh Lord JESUS. 
    This whole sputum thing is the worst, need to reschedule my interview. If im done in 2mos waiting how long the Embassy can reschedule my interview?

    I’m to far along in my case to back pedal, and I do not agree WOM are causing more delays. The government being slow and not staffing people, or attacking the work load is the real reason for delays. Covid? What about the vaccines and what about returning to normal in the work force? I go to work everyday, we work more now than ever.  Do you know in July alone the US embassy in Manila only issued 149 K-1 visa’s, with a back log of over half a million at the NVC? They have no dedication to a back log that is looking like years and years to clear. The defense ( Government ) is not doing me a favor trying to dismiss my case. They want the judge to ok a 5 year waiting plan. That’s insane! The government needs to start doing their jobs. Any of you ever pay for a service in your life or pay somebody for a resolution, and it not be full filed? Or you have to wait unGodly amount of time for the outcome to get what you need done. It effects people’s lives and quality of life. Nobody seems to want to argue that now do they? Also the courts are making a lot of money right now, $400 in court filing fees, I’m sure they are enjoying all the cases coming through financial wise.

    For those quoting my thread, I haven't been shown anything substantial that cases are getting sent back to USCIS to die if you "win" a WoM. If you have documented cases like that, please post them. 
     
    I have heard negative things in regards to the state arguing that 1-2 years isn't an unreasonable delay...and just putting you back in line. I mean I guess there are some odd family visas from terrorist infested countries where the agencies involved drag their heels for years, but it doesn't make it "reasonable" when in most cases what we're talking about is obvious K1s from the Philippines. My case is still in limbo, no updates for over two months. 
     
    Personally, I find the whole situation of abandoning your post as a government official over the cerveza sickness worthy of being mocked. If you disagree that's fine. I've worked full time with the public since the outbreak, so no reason the government can't either. These are unique days, and nature abhors a vacuum.

    Again do you have any feedback on a current  Writ of Mandamus? I don’t care who posts, but obviously you have nothing better to do with your Saturday but troll on somebody who is need of some answers. You also have no validation to say the government is not messing with people’s lives. Yeah there’s Covid, I know, I had it. however, that is not an excuse to make people wait years who are qualified to be with their love ones, nor is it a reason to steal peoples petition money because they exercise THEIR right of writ of mandamus.

    Not exactly quite sure, just the standard writ of mandamus. But from what I’m reading here, looks like I’ll either lose due to covid, or I will get my visa sent back to the USCIS where I have to start all over. Which is absolutely insane because the delay has caused an expiration not me. This is also a new tactic that the NVC is using. Not the normal proceedings according to the lawyer. It is a way of taking $ and not doing their job. That’s the bottom line. A lot of people a very frustrated as all Embassies take their times to resume and blame covid. Imagine waiting years to be married to someone just because they live in another country. This is Messing with peoples lives. Facts are facts.

    This seems so dishonest.   The US government treating its citizens like #######!   My wife and I debated on doing the K-1 or the CR-1 and decided on the Marriage visa because it seemed easier long term.  I would be devastated if my government did this to me!   Two presidents in a row screwing us over in different ways.

    This is shocking news if true that Biden's plan to clear the backlog is to just cancel all the K-1 visas and not renew them! Any other sources confirming or denying this would be appreciated.

    Like Daniel, I also joined the lawsuit to get my Fiancée🇵🇭 to America🇺🇸 ASAP.
    Will we win?.. ...IDK🤷🏻‍♂️ 
    If we win, will we be scheduled for an interview at USEM faster than if we hadn't joined the lawsuit at all?.. ...IDK🤷🏻‍♂️ 
    But I chose to join the lawsuit because if it's successful, I know that I would have seriously regretted my decision to not join it when seeing the Plaintiffs reunited with their Fiancées sooner than later.
     
    I also took this gamble because the lawfirms representing us have won several Federal cases in a row, so it seems not so risky. 
    Is $2500 a lot of money to risk?.. ...ABSOLUTELY!!!
    If my gamble has a negative outcome, then I'm out $2500... ...but at the end of the day, that equals less than one week of pay for me as I net far more than $2500 in a week. 
    But I'm very optimistic that we will win. And with a positive outcome, not only will I finally be able to marry my Fiancée, but I'll be in a different tax bracket in which I will easily regain the $2500 lawyer fee.
     
    Ultimately, it is ridiculous and totally unfair for USEM to stop ALL Routine K1 Fiancée Visa Interviews/Processing for over a year now, while processing other Visas. 
    Therfore, I sincerely hope that we are all reunited with our Fiancées ASAP!
