  3. Yes you need to upload the petitioner's divorce paperwork to NVC. Also your spouse will need to take that original (or original certified) divorce paperwork with them to the Interview. Or your spouse will get a 221g for it.
  4. My wife had her interview on Monday (August 8th). She got a 221(g) because of my brazil authenticated divorce paperwork (for a US based 1st wedding I had) They want the originals, which are in one of many boxes in my room back in California. Or with the carterio here in Brazil. And I am currently in Brazil with my wife.
  5. Your son, does not need to immigrate, if he has the CRBA and US passport he is a US Citizen already. You just have to get a family size of 3 on the i-864.

  7. All the NVC stuff (i-864 and ds260) is filed the same way via the ceac online system (at least I hope in 2023 all countries have switched to the online system). Both the i-864 and ds260 have a separate fee. When it comes to the NVC & Embassy/Consulate they accept English or the local language. It's only the USCIS i-130 part where it has be in English.
  8. Note (afaik) you only needed to file by paper if you where requesting a w-7 (for your spouse to get an ITIN).

I seem to recall (it was over a year ago, lol) a question on the online i-130 if the beneficiary was in the USA, if you answered yes to that (even if they were there temporarily), you would have gone down the adjusting path. As I stated with more details: read the instructions for i-824: https://www.uscis.gov/sites/default/files/document/forms/i-824instr.pdf fill in & print the i-824 (fill this in as the petitioner): https://www.uscis.gov/sites/default/files/document/forms/i-824.pdf make sure you sign it physically. see the fee for this form in the instruction link, make sure you include that fee in what you send mail in the form wait for the welcome email from the NVC.
  12. then as stated by others you/your lawyer messed up and indicated your spouse would be adjusting status. But in truth you need to file the i-824 & pay the fee, and the delay in time (probably 11 months or more) for it to get to the NVC to continue processing to get the appropriate embassy/consulate for Thailand.

Yes, the beneficiary is the one that needs their civil original documents and a photocopy of them at the interview. everything from covid shots, Flu (if it's winter time), and many your childhood shots, including things like MMR and Chickenpox. Along with Tenatus (reinforced every 10 years) and Hepatitis B. You will get the actual list you need once you are incontact with the medical doctor). I (the US Citizen) did include a photocopy of my passports (from when I started to visit her) along with my current passport (and Brazil entry/exit stamps) for my wife to take to the interview.
  14. As noted by ShazShaz, for medical that comes before the interview you will need your spouses vaccination record. And of course for you will the original Birth Certificate and Marriage certificate as well as the photocopy when it comes to the interview itself.

  19. so as normal, a random lawyer has made a mistake on the i-130. And failed to note whether your spouse was in her home country. So it get it moving to NVC to continue the process an i-824 was filed. Once the case is moved to the NVC your brother should get a welcome message (well or the lawyer will, not sure didn't use a lawyer). From there he will pay to do the AOS (i-864) and the DS-260, and then him and his wife will do both of those forms.

  21. If the USC/US Resident has been divorced, make sure you have all the divorce paperwork (original or certified copy) to take to the interview.
  22. if they did not mention originals/certified copies, then photocopy is fine (you are not likely to get your originals back if you mail them). Be aware though, you will likely need the original of these items at your spouses interview.
