    Hey there. Medicals RFE is as straightforward as it gets. Just do the medicals, put a SEALED envelope with medicals along with a copy of your RFE notice and send it to the address they provide. Fingers crossed you will be approved with no interview.

    Thank you for your response. It never said anything about frivolous asylum, would that have to be the specific wording they use? NOID had details from the interview where the officer felt like I was inconsistent in my answers, and in the end it says " Considering the identified credibility issues, the absence of reasonable explanations for those issues, and taking into consideration you individual circumstances, your testimony was found not credible under the totality of the circumstances. As your testimony was not credible in material respects, you have failed to meet your burden of establishing that you are a refugee as required by 8 C.F.R. 208.13(a). Consequently, you are ineligible for asylum.". Final denial just referenced NOID reasoning.

    I guess the paragraph they quote is different from the one you just mentioned, which is good?

  4. @sandranj Hi Sandra, I was reading your posts regarding asylum and got pretty worried. I applied for one in 2013, got interviewed and denied in 2014 (no appeal), maintained my F1 status since then. I did, however, travel to my home country once in 2017 with AP due to close family emergency (which I have documentation for). Now I have an approved VAWA and waiting on interview. Do you have any advice you could give in case this comes up in the interview?

    in my local office I was told my interview will be trough an iPad (Microsoft meetings) due the COVID regulations, I’m praying for everything will be fine that day. I’m going by myself with God with me. I’ll have my interpreter by phone. 

    Wow online - that's crazy. Happy they are still doing interviews though during pandemic. What is your local office? Also did they explain how are you supposed to provide any documents they may need - tax returns and things like that?

    Very detailed and knowledgeable response. Just wanted to add that infopass is actually still happening by appointment, I went last month. Might be a narrower list of reasons for them to schedule one though.

    It is possible that it's still pending, I'd say you should check through your congressman or info pass appointment to see if the marriage I485 is still pending.

    You can try filing an inquiry with ombudsman. Gotta send a letter with a form through regular mail though since they require a signature.

    Hi there. So sorry to hear you had to go through all this pain...

    Please go to the interview by yourself and tell the officer to hold your I485 form while you collect documents to file for I360. Then get a ~8-10 page evaluation from a licensed therapist describing your emotional condition, your diagnosis (depression, PTSD), your situation with your ex (you'd have to attend multiple session for therapist to do that for you). Write a detailed statement yourself (6-10 pages) about how you met, got married, how he god abusive in details. Ask any friends to write affidavit confirming your marriage was real and if they can confirm abuse add that too, have it notarized. Add abusive texts he sent. Add any bills, bank statements etc., police clearance from your state/FBI and your home country. I may be forgetting something, so look for more info online. But basically it does sound like you should be able to get all of this yourself and file even without a lawyer. Please be hopeful, if you need any help - this forum is here to support.

    Well as you said, it may depend on an officer, but why would you risk any chance of messing with your interview? They may say you can't use her and reschedule you for another interview many months later. Also I guess you need a Spanish interpreter? If it was a rare language maybe it could slide, but there are definitely hundreds of Spanish interpreters in TX, I'd highly discourage you from doing that.

    I wouldn't do it if I were you. Quote from an article:

     

    The guidelines also give USCIS the power to disqualify someone from serving as interpreter, if the person is not sufficiently fluent in both English and in the interviewee’s language and able to interpret competently, impartially, and without bias. This means that, for example, a family member with a personal interest in the outcome of the case might not be allowed to serve as interpreter. In fact, USCIS explicitly says within its guidelines that “family members will generally be disfavored as interpreters if there is another qualified interpreter available to the customer.”

    I'm concerned they will ask about abuse.  Is there anything I can print out to show them to not ask questions about abuse 

    Wow so expensive. Usually it's around $250 for both physical and labs. But of course at this point I'd be going for anything as well just to make sure you get it before the interview.

    I saw this happen to 1-2 ppl here in the past few months, I think they heard back with their I485 approval within like 2 months or so.

    Up to 8 weeks for a notice is normal, wait till mid-November, should be on its way.

    Without physical abuse a detailed psychological report is good enough. But it can't just be a brief summary - gotta be long and detailed like 6+ pages as per Sandra, I believe.

    The most recent approvals I remember seeing are summer 2019, but as Sandra and other members mentioned - there's still a bunch of cases waiting since 2018 for approval. Once it's past 21 months or whatever the higher number they have at the moment you can inquire with congressman (right now that would include cases filed in 2018). 2019 filers just gotta wait a bit longer for now.

  15. Update: Scheduled an Infopass appointment and went to speak to the officer today about my case going to NY (after NBC) instead of Houston. He said he requested a transfer and Houston should have it in a couple of weeks. He was also able to update my address on file, since apparently a couple of AR11s I sent around 4-6 weeks ago didn't do the job. He also said that "they are trying to get rig of the old cases faster", so since my filing date was December 2017 I should be getting an interview soon. So apparently the filing date does matter as well :) Fingers crossed now, will be checking my mailbox twice a day lol

    If it was me I would just go to the interview, why wouldn't you? They may place it on hold and when VSC approved your VAWA you could just receive a GC in the mail without having to go to the interview again.

    Oh Gosh... Thank you so much for your advice. I scheduled an info pass appointment for tomorrow, hoping it can bring some clarity to this mess.

    Wow your story kind of made me tear up, the brutality of some officers appears to have no limits. Hopefully it will mean that after VAWA approval you will just get your GC in the mail, so the worst part gotta be over.

    If you lived in different states might as well get FBI clearance. You can request it online and go get your fingerprints taken as a private facility, google how to do that.

     

  17. Hi everyone. Please advise - I have 2 I485s pending, one VAWA and one marriage (my ex-lawyer's "mistake"). Marriage was filed in NYC in 2016, I asked to reschedule interview in 2017 and haven't heard about it since then. VAWA approved January 2020 and I have lived in Houston for the past 15 months, where I've been receiving all the correspondence. It appears that when my I485 and I360 moved from VSC to NBC they were processed and sent out to NYC, as per my congressman's inquiries. They are "unable to provide additional info" in terms of why the heck is my case in NYC now. I sent VSC a few AR11s, but I really don't want this to cause another 6 months delay on my case. Any ideas what can I do? File a petition to withdraw marriage case? Keep inquiring with the congressman every few weeks? File ombudsman? 

    Appreciate any input I can get. Thanks.

    Additionally to Sandra's response - doesn't hurt to do it now and hold on to in in case you get NOI soon, but I've never heard of insurances covering that exam. My doctor told me insurance won't cover it even partially.
