    Might be just a thing the do sometimes in your local office? I wouldn't worry about that. Every office has a slightly different format of an interview letter as I've discovered.

    Which address are you thinking of putting there? In the application it clearly states US mailing address and US physical address. I don't think they can send it to your country. I think due to pandemic all the renewals get processed with old biometrics, unless something has changed recently. 

     

    Another thing to note is when you're getting your GC if you've stayed outside of the US for over 6 months they may question this trip . Make sure to bring some documents with certified translation proving your emergency. And when applying for VAWA did you submit police clearance from your home country? If not they will request it if you stay there long (I believe it's 6+ months in the past 3 years).

    *my I-485 is still not moving since my I-360 approval from September 2019 which has been 18 months. It still says fees were waived on November 2017. Did they send you a medical notice ? How long does it take between the notice, interview and card in hand? Sorry I want to know how it works before my travel on May for 2 weeks. 

    No problem! Where is yours located? New York and a couple of other offices are taking 2+ years sometimes, most others take around 12-18 months, hopefully your interview is coming soon. You can check about that through the congressman.

    I had a weird case with VAWA approved Jan 2020, medicals letter from NBC April 2020, then summer 2020 they sent I485 to NYC where I used to live (found out through congressman), November 2020 NYC sent I485 to Houston, January 2021 I had interview and card in hand.

    We did have people on this forum get approvals after the RFE response was just a personal statement. Make sure it's very detailed though, at least 3-5 pages.

    Maybe someone can write a statement they know she broke your phone with pics?

    Also maybe you took some trips together - any hotel reservation receipts or plane tickets will help.

    My I485 status never updated either when it was transferred, I just got the interview notice in the mail. Realistically my guess is that your interview will be 9-15 months from now.

    It was mentioned here before that VAWA applicants are exempt from public charge rule, plus Biden has been doing some actions to remove it for other categories as well. A different question is, are you eligible for that before you get your green card? I'm not sure tbh, but definitely do some research.

    • Section 8 HCV applicants must be at least 18 years old, and a United States citizen or a noncitizen who has eligible immigration status.
      • Eligible immigration status includes a lawful permanent resident; registry immigrant; refugee or asylee; conditional entrant; parolee; withholding grantee; person granted 1986 amnesty status; resident of the Marshall Islands, Micronesia, Palau, or Guam; victim or relative of a victim of trafficking.

    If you don't respond to the RFE your case may (and probably will) get denied. As Stillwinning said, it's a lengthy process and you're on a deadline here, so if it was me I'd start calling a bunch of places literally today and sign up for 1-2 sessions every week to be able to meet the RFE deadline.

    And please can recommend any affordable doctor in NJ for the medicals.

    Why was it mailed? I always personally picked up my medicals, start to finish it would take up to 5 days. Likely just the bloodwork and flu shot, but some vaccines are also periodic. I had to get tetanus shot, since it expires every 10 years.

    Some people get stuck with pending background check status. It happens to maybe 10% of cases I think, so hopefully you'll be able to avoid that.

    I know some officers will be picky and if you're leaving a section blank you need to put "N/A" in it, otherwise they might think you just forgot to fill it out.

    Do you have C31 EAD? That should serve pretty much same purpose as I360 approval. Although I do not actually know the process of applying for I485 after I360 approval that well, maybe someone will elaborate. I do not think you need a lawyer for I485, it's I360 that required a lot of evidence and stuff, I485 is much easier.

    Uscis work with your priority date not the date you sent your package or they received your package, that’s why I always say am August filer, the PD, guys correct me if am wrong 

    If I'm not mistaken, Sandra mentioned here that PD is only relevant if you were married to a GC holder. If your (ex)spouse is a citizen it's irrelevant.

    You can google "USCIS case processing times" and check. Officially it says March.

    You can go to the interview and tell the officer you will be filing I360 and ask them to hold your I485 for a few more weeks since you're about to apply. If you have any good proof for abuse (police report, order of protection, affidavits, therapist evaluation) - bring it to support your statement.

    Here is mine: Dec 22, 2019.  I-360  received, Feb 19, 2020 RFE for police reports etc., March 24,2020 Replied to RFE. No prima facie 

    Probably an average of 2 years or so. So you might hear something end of this year.

    Gosh what a long wait! Congratulations!

    I do not think it will hurt to send a letter, but I also think there's a pretty low chance it will help. Where was he planning to send it, local office? It usually takes the application 2-5 months after VAWA approval for the case to make it to local office. If it was me, what I'd do is wait about 1 month after receiving a I693 deficiency notice from NBC (approximately 2 months from now) and then try and schedule info pass. At the info pass play silly and say that you filed I485 in 2016 and when should you expect an interview. If your local office refuses to schedule info pass then just keep sending inquiries with congressman every 3-6 months on the status of your I485.

    I just posted a day by day timeline after GC approval here a couple of days ago. Here it is again:

    Day 1 (Fri) - Card ordered

    Day 4 (Mon) - Case approved

    Day 6 (Wed) - Card mailed

    Day 7 (Thur) - USPS picked up the card (this is when tracking appears)

    Day 8 (Fri) - Card in hand

    As far as I know as long as your ex didn't contact USCIS asking to withdraw I130 (causing automatic I485 denial) you should be able to use old I485. Check with congressman if I485 is still pending to be sure.

    Yes 100% approved. This question was here many times, even within the past week I believe someone asked it. Please spend some time reading previous posts, it will be time well-spent.

    You will likely (although not guaranteed) get approved status somewhere between now and 3 months from now. However, even though that magic word "approved" might appear later rest assured your I360 was already approved the minute they ordered your new card (C31 EAD).

    Same day even, just shifted by 1 month haha. My I485 updates. Card received Jan 29.

    Yes to "This means..." question. Usually they forward it soon after you get courtesy letter, although some offices reported that cases will be held at NBC until local office interview slot will be available. Many ppl don't get any online updates, so check with congressman so see which office it's in.

    Sounds like a very good sign. I went to an appointment in Oct/Nov to ask to transfer my case from NYC where it was by mistake to Houston. Officer said they are trying to get rid of old cases 1st, so since my filing date was Dec 2017 my case was "old". It arrived to my office in Nov and in Dec I received a interview letter for January.

    С09 is free and I know quite a few ppl here got it after VAWA approval. C31 is $410.However, there's a chance your C09 will get denied, because you're technically supposed to apply for C31 after VAWA approval. I personally chose to pay and apply for C31 to be sure I don't break the continuity of my employment.

    Yes, include the receipt you received for your I485 with I360 application. Sounds to me like you only need to file I360 at the moment (which is free), and then in 5 months file for EAD renewal (include I360 and old I485 receipts). Since it's same category the I765 receipt you get will serve as 180 day extension for your current EAD.

    I believe it would still be valid and you can just renew it 6 months before it expires since it's under the same C09 category. As long as I485 is active (pending, waiting on interview) you're eligible for an EAD. But that's my guess only, maybe someone else would have a more competent answer.

    What my lawyer isn't able to tell me is how much time it would take to get an EAD and AP if I apply under category c(9). I already have a job that I started working for after getting my Marriage based AOS. Since that filing will no longer be valid after we file VAWA concurrently, I am concerned that I might get a gap in work. 

    I don't think I can work using my current EAD once I file I-360 and I-485 VAWA. My wife and I are also in the process to get a divorce, but it would be 6 months or so before that is finalized.    

    You do not need to file a new I485, only I360 and I765 for C09 category. Divorce timeline doesn't have an impact here. I'd say for initial C09 VAWA EAD it takes 2-6 months as far as I remember people reporting here.
