Not exactly. Apply for the visitor visa tomorrow and then apply for the K1 a little after, you lose nothing. Plus if he’s applying for the B in Italy the waiting time is much shorter than in Nigeria. Not exactly correct. That’s for applying in Nigeria. He’s resident in Italy so he can apply there. -

If he’s legally resident in Italy then he probably has slightly higher odds of obtaining a B visa than if he were resident in Nigeria. Overall chances are still very slim with demonstrated immigrant intent via K visa petition. In any case you lose nothing but $160 by trying. Give it your best shot and thanks for your service. If the flight was canceled due to Covid and was purchased with a credit card, I’ve had good success getting cash refunded to the credit card for a couple trips. It wasn’t easy but then I’m very dogged.

This is an optimization problem with several constraints. American Airlines credits are particularly difficult to use flying out of Accra and Africa in general because American Airlines doesn’t come to Africa [only to Morocco] except through affiliates like BA and when the option to book through American Airlines (on BA flights) exists it’s twice as expensive as if you booked it directly with BA. First plan would be to try to get the credits extended however that’s only going to be extended for a few months and you indicate it’s going to be at least a year and half before your partner will be able to use it to come directly to the USA. Still buys you time. The chat option is helpful so you’re not kept on hold forever like they do. American Airlines until January 31 allowed you to gift your credits to someone else, alas that ship has sailed.

Stressing won’t solve anything. In any case nobody can tell what will happen on your return next time. Your wife has the higher risk of being pulled into secondary but even then she has more evidence in her favor proving she has no intention of abandoning residency. As permanent residents border patrol cannot revoke your residency or deny your entry so in my opinion your stressing is unfounded. I don’t envisage even the most unfriendly officer putting you into proceedings over this. -

No. The income is just for qualification. If immigrant comes and doesn’t work snd doesn’t claim any means tested government benefit, the sponsor is free and clear. If the immigrant decides to use means tested government benefits, government can come after the sponsor to pay back every dime. -

As someone who was detained for eight hours by British immigration in 2017, I have a bit of personal experience what he must have gone through. Absolutely horrible! In my case it was just a visit and I was ultimately released and allowed to enter so it doesn’t compare. Remember you can get compensation for missing luggage both from the airline and credit card coverage (if you purchased the ticket with a credit card) however you only have twenty days to do so. I have experience with that if you need guidance. I wish you both the best going forward. -
Apparently not true. My best friends husband had his last year under the 3 year rule and I swore to her that she absolutely she needed to go with him and I was convinced that it was mandatory. Well after he went alone and came with an approval, I had to eat crow and accept I was wrong. I don’t know if it’s because of Covid (and social distancing) however apparently they dropped that requirement if it ever existed. Regarding the OP’s questions about what documents to bring, my response is compiling all those documents won’t take an hour and carrying them won’t weigh a quarter of a pound, so what do you lose by taking them along? Nothing. What could happen by not taking them along? An RFE (although unlikely) which could delay your process. So out of an abundance of caution just carry them along! Cheers

It’s not just the amount of time, it’s also the pattern. I’d you’re spending in months 3 out, 1 in, 3 out, 1 in, 3 out, 1 in for two years although you’ve not spent six months continuous outside the USA, a reasonable immigration officer can say you’ve broken the continuous residency requirement. I would advice you should not spend more than six month out at a stretch but also if possible spend at least a total of six months or more here in the USA. Abandoning Permanent Resident Status You may also lose your permanent resident status by intentionally abandoning it, including but not limited to: Moving to another country and intending to live there permanently; Declaring yourself a “nonimmigrant” on your U.S. tax returns; or Remaining outside of the United States for an extended period of time, unless it’s a temporary absence, as shown by: The reason for your trip; How long you planned to be absent from the United States; Any other circumstances of your absence; and Any events that may have prolonged your absence. Note: Obtaining a re-entry permit from USCIS before you leave, or a returning resident visa (SB-1) from a U.S. consulate while abroad, may help show that you planned for this to be a temporary absence. Does travel outside the United States affect my permanent resident status? Permanent residents are free to travel outside the United States, and temporary or brief travel usually does not affect your permanent resident status. If it is determined, however, that you did not intend to make the United States your permanent home, you will be found to have abandoned your permanent resident status. A general guide used is whether you have been absent from the United States for more than a year. Abandonment may be found to occur in trips of less than a year where it is believed you did not intend to make the United States your permanent residence. While brief trips abroad generally are not problematic, the officer may consider criteria such as whether your intention was to visit abroad only temporarily, whether you maintained U.S. family and community ties, maintained U.S employment, filed U.S. income taxes as a resident, or otherwise established your intention to return to the United States as your permanent home. Other factors that may be considered include whether you maintained a U.S. mailing address, kept U.S. bank accounts and a valid U.S. driver’s license, own property or run a business in the United States, or any other evidence that supports the temporary nature of your absence. In your situation I won’t recommend a K1. Marry her and do the marriage route. You don’t want to waste a year and half only to be denied and have to start the marriage option. -

You’re really opening up a can of worms. Too many issues with your narrative. Mother listed as parent, child not listed on your petition etc. It was a clear misrepresentation on your application because the application is explicit, the question is whether it was a willful and material representation in which case you could have been inadmissible at the time your petition was approved. Better get a good attorney, I don’t envy your situation. Good luck!

You seem to take the assertion personally needlessly and went to great lengths to attempt to debunk it. It ain’t that serious. In any case using appealed cases as a proxy for fraud is a very poor measure. Those countries whose citizens have the process down pat likely never get to the denial and appeal stage because they’re masters of the game as indicated by organized fraud in their visa lottery applications. Unfortunately that’s not going to happen. Congress can’t seem to agree on anything concerning immigration including the reality that the system is both simultaneously abused by fraudsters and puts significant roadblocks in the paths of genuine applicants. The entire US immigration system is anachronistic and needs overhaul.
