  1. First Step: Fire the law firm. Tell them you will sue them for malpractice with the state bar. Ask refund for i-130 fee + fee charged for lawyer service. if they say no refund. Send them a letter that you intent to take them to court . This is ridic unethical behaviour from law firm . Iam guessing the org is not a law firm Step 2: Wait for the i-130 receipt. You can write a simple letter to USCIS PO Box saying that you wish to withdraw the i-130 petition as it is not required. Sign and date the letter Step3 : Mail the letter
  2. It is extremely important to get married within 90 days. DO NOT BLOW THE 90 day deadline .

  4. 1) How do you have an immigrant visa that is valid for 3 years ? they are usually only valid for 6 months max.
  5. Just so you know 1) Bank accounts : Most banks will not open an account unless you have a social security number. Some will open but you will be a foreigner holding a US bank account rather than a US resident if you cant get social security number 2) Social security number will take at least 2-3 weeks ( this is being super optimistic . they will only deliver to a US postal address 3) Drivers license cannot be obtained without a residency proof in a state. You need to have address proof of residency like electricity bill, car registration etc . its not a given that they will give you license with a immigrant visa . you also need to pass a drivers license exam to get DL. Make sure to plan accordingly and good luck with your goals
  6. you dont need Reentry permit as soon as you land in US on immigrant visa. As others have said , build your relationship with US residency. This would include 1) get ssn card 2) get drivers license 3) open bank accounts etc 4) Get your Green card in hand as they will only ship to US address once you activate your immigrant visa by touching down on US soil, you become a permanent resident ( aka green card holder). Come back 3-4 months later and than apply for reentry permit. I would not wait for a year in the current political scenario to come back as it would trigger the 6 month criteria for green card abandonment. Just be as cautious as possible in the current political scenario in USA. As long as you dont stay away between touch down on US soil with IR visa and than coming back to apply for reentry permit, you should be ok. Its a hassle with all the trip but you have do what you have to do
  7. just be honest and declare everything to be on the safe side. if you do not want to submit the evidence, take the documentation to the interview where they will review your application line by line and you can let them know about the tickets during the interview
  8. Ok here are a couple of options 1) You decide you want to get married. She comes to Canada. Get married in Canada. Immediately she files paper work or sponsor you for IR1/CR1 visa . She also needs to make enough money to sponsor you. It will take 15-24 months before you can move to US. You have to stay put in Canada in that period. You can visit her in US but you cant move permanently during the process. once the process is complete you will get a visa on your Canadian passport. Once you arrive on US soil with an approved IR1/CR1 visa you are a permanent resident aka US green card holder. You will have all freedom to work on any job or not work at all 2) Option 2 : there is no other choice as you do not have qualification for TN visa aka minimum requirement is a bachelors degree or a GED + 3 years experience

  10. I will be filing my n-400 soon and was wondering what documents do i need to upload. I have travelled here and there but nothing more than 2-3 weeks outside usa so no issues on the travel aspect Below is the list i i have 1) copy of green card 2) Speeding ticket i got like 10 years ago. it was a Court Dismissal as the officer did not remember why he wrote the ticket. I will be uploading the ticket and Court dismissal document Do i need to submit Tax Transcripts for 5 year rule filing ?

There is no issue with filing a mandamus. it shouldnt take 2+ years to adjudicated i-751. your file is probably stuck in some storage bin and they wont move on to n-400 until that i-751 is brought to life to an officer. I have posted a mandamus process here.. you can file it by yourself if you can do the work. it costs about court fees and a couple of hours of write up.. worth the try considering you are waiting for 2+ years. i have filed mandamus twice at i-485 and i-829 stage and both were approved within 60 days. congress office is useless 100% . dont waste your time

  14. you also need to aware of the current administration that is looking to remove any one with issues with the law. Things were very different in the past but now they are arresting and deporting green card holders to meet their deportation quota. good luck !!

  16. doesnt the embassy provide a transportation letter for those with lost/expired cards ? but with this administration it is going to be tricky
  17. i think this applies to those that entered the country illegally or kids who were brought without no fault of their own and they are now 14 years or older
  18. some times it works that filing n-400 pushed i-751 approval. no one knows cause USCIS is a blackhole
  19. its hilarious that one govt organization cannot access another govt organization (IRS) to lookup cause they have everything. We need a better integrated system.. ridiculous that they ask for transcripts though
  20. There is NO ban in your case and neither did you overstay . you were in legal pending AOS status from i-485 application day to until they day you left US. i see no issues here . Yes you can apply CR1 when you want.
  21. they dont ask for any immigration status flying domestic flights. there should be no issue unless you leave US borders into another country.
  22. 715+300 is the total fee if you are filing NIQ. so yeah they rejected cause your payment should be 1015$
  23. as others said, get a good lawyer. no one can tell you what your odds as every case is adjudicating on its own merits. patents, publications, scholar recommendations all help. Having a doctorate or a degree merely is not qualification for NIW
  24. you will have to apply for waiver at your local US consulate. Once approved than you can get to next step of what you need to do
