    There are four separate boxes, but you listed only three! The one you're missing is the one where you will find the transcripts: "return transcript" is the name of the box.

    The problem with this approach is that he is out of status until the doctor can see him. It might not be long, but f I were in his shoes I would press to be under authorized stay asap.

    I agree. I see tons of USC "taking over" the cases but the beneficiary should be 100% involved too.

  3. If the interview letter asks for a birth certificate, then I would bring it. How far ahead is the interview? 

    Sometimes BC do not take that long, and it is a good document to have. What if she loses her passport and needs proof of citizenship asap? Google Vital records of the State she was born. Sometimes you're able to request it online.

     

    For my own interview (I applied on the three year rule) I brought my husband, his birth certificate, his passport, my passports, a physical copy of all the documents I'd submitted with the application, plus new, updated evidence. Officer just asked for my DL and my green cards. But I feel it's better to have what they ask for in the letter and let them handle it however they want it.

  4. File asap for the 485, i864, i131 and i765 asap. After you file, have him get his vaccinations (if you have insurance, go through their providers so that it costs less). Then, once he has all the vaccines needed, he should go to a USCIS civil surgeon and complete I-693. Wait until you get an RFE for it, then send it.

     

    He shouldn't travel outside of the US until he as the AP.

    That's why nothing beats good ol'e handwriting to fill out the forms, together with reading instructions and the questions 20x, to make sure one understands the form entirely.

    If I would refile before I got a notice to appear, how soon will I be able to travel outside of the US and what would I need for it? Advance Parole or Stamp? I still have the a travel stamp valid till Jan 2025 from the denied case. Will the refiled I751 attached to the previous one so my stamp is valid? Or do I have to get another stamp and how long does that usually take?

     

    Also can I apply for a E1/E2 or B1/B2 visa if my refile got denied as well?

    I'm so sorry you're in this situation, and I wish you all the best with your health issues.

    As others have suggested, you're not getting a B1/B2. Your only chance is to fight this denial, which I know you will. 

    I also see that you're worried about an NTA and I wanted to say, just do the next right thing. And the next right thing is to either file by yourself (but you said you don't have any more evidence), or hire an attorney ASAP that will file for you. I know Hacking will. He has a YouTube show where you can ask questions for free. Just  Google YouTube Hacking Immigration Law and it will show up. Next show is today.

    Looking at your post history, the fact that your name isn't on the lease and you don't have a joint bank account PLUS the domestic violence charge do not guarantee a successful outcome for N400 under the three year rule.

    Regardless, she should apply for N600. There might be other situations (for example, at the SS office) where she needs to prove her citizenship. And if she loses her passport she doesn't have any other means to prove it. If I remember correctly, I was asked to show my husband's BC on my naturalization interview. So some officers might actually request a proof of citizenship. While the passport will suffice, again, what would happen if she loses her passport prior to your interview? Btw my local field office was also Columbus, OH.

     

    But for now, she can use his naturalization date.

    I don't think this timeline will work. I believe you have a deadline to enter on your K1, which might be shorter than the wait times for the B1/B2. Usually B1 B2s are good for 10 years.

    I would have them apply for their visas before you apply for yours. And then answer the question on the form accordingly.

    I was worried about my case because I didn't mention my stepchild on my 485. Worried to death that they'd deny me. In the end I did list him on the 751 and N400 and even talked about him for a minute at my citizenship interview, but nothing bad happened. Yet I was worried. Guess @OldUser and myself are different from Eddie!
