The "Ready" condition is that the file is at the embassy and they are preparing to contact the beneficiary with their "letter", which is commonly referred to as the P3 letter. These will be the instructions as to what documents, what forms need to be completed, the interview payment and scheduling as well as indicating that the DS-160, Online Nonimmigrant Visa Application should be completed prior to the interview.
Only some people are getting that letter in India weeks after " Ready" status. Some hospitals are refusing to schedule medicals without that letter. The embassy is always giving the same canned automated response. Not sure when this craziness will end.

Despite the lawsuit, India is still playing games. First, they were saying they have started K1 since December. They replied to plaintiffs stating the same. Even though I was not a plaintiff, my status changed to "In Transit". Now, after a few people booked the interviews, hospitals are saying they cannot book medical unless the consulate sends them the invitation letter. Consulate has not sent that letter even to those who were " Ready" in March. All emails sent to the consulate are bounced back with the same auto-reply. Maybe only the plaintiffs will be able to interview at this god-forsaken consulate.
Edit: India is not even banned and Mumbai is issuing around 3000 F1/F2, B1/B2, H1B/H4, CR/IR every month since September 2020. They just won't process K1 visas.

Status changed to "In Transit" today. NVC received on May 27th.

After all of these months, her interview is scheduled for a week from today! We are not plaintiffs in the Milligan vs. Pompeo case. Despite what their website says, Moldova has resumed K-1 processing.
Congrats!! Did the NVC give you the date or you had to pick your own?

Thanks and no I am not part of any litigation
Thanks 🙏🏻
Did they provide you your interview date? I thought K1 are supposed to schedule on their own.

She also wrote that suicide and pregnant questions were asked during medical check.
Makes more sense.

Hello! Where are you from? We are still waiting for the interview . Last March our petition was approved and we scheduled for August, but it was cancelled. I know it's silly to compare just it makes feel better if anyone has their K's interviews started!🌺 Good luck at the interview. Here are the questions from this site K 1 interview in Ukraine , so questions can be different.
Wow!! This looks like a interrogation. 🙄

When did this happen?
Today. None of them were plaintiffs.

So this is the 2nd time today I've read of someone on VJ reporting exciting news...the other news today was a non-plantiff getting a non-expedited interview for K1...one can only hope that the DOS sent out a little email saying let's get these stacks of applications moving.
Yes, many K1s in India had their files moved to embassy. 😃

I used to think that it would get going right away when the ban lifts, and hopefully, it will, but what about all of the embassies in non-travel ban countries that aren't issuing K1's? And if they do it's pretty much only expedited cases... I know some embassies, like Canada, have started to work on K1's, but from what I heard this has happened in very few countries. Despite K1 being a priority. 😶
Any thoughts on why it's like this? 😟
Yes, some countries like India are acting in an extremely biased way regarding K1. They opened everything except Greencard relatives (banned by Trump) and K1. They did not even start plaintiffs' interviews whereas other non-banned embassies in Phillipines, Mexico, Pakistan, DR scheduled plaintiffs' interviews. It is really frustrating!! Embassies are not afraid of lawsuits and even the judge thinks it is not an unreasonable delay when people are denied interviews for 9 months. Even now denying interviews only for K1s, it certainly is not COVID. I have no idea what it is?

Interesting......OP, how far into the CR1 process were they with the previous marriage? Anyone know if this is something that could be discoverable via FOIA?
FOIA does not disclose information about others. It just gives information about yourself. Speaking from experience.

It helps plaintiffs in banned countries only.

It helps plaintiffs only. Time for another lawsuit. This is just hopeless at this point.

It seems like the judge left the embassies unchecked to delay K1 visas citing local conditions. So many countries where they are doing all kinds of immigrant and non-immigrant visas, they are not doing any K1 visas saying they will process K1 only during routine processing (God knows when). Why the judge was fine with a blanket ban on just one visa type is what baffles me.

What a bummer. Well hopefully now its full steam ahead with family visas
Yes, its the highest priority right now. Maybe citizens should sue to get their spouses as well.

Nope. They didn't mention tourist visitor visas (B-2). As I mentioned, ESTA isn't a visa.
Don't you think we are splitting hairs? They are technically the same category: temporary visitors. What privilege does ETSA have that tourists don't have once they enter US?

Plaintiffs recent response didn't say that. It listed student visas, E visas, H-2 visas, etc. When it mentioned ESTA (which isn't a visa) it left out the pertinent fact that VWP is entirely managed by CBP, not DOS. CBP is a part of DHS. Contradictory to concede "Plaintiffs are not challenging the lawfulness of the Presidential Proclamations, Plaintiffs are not asking Defendants to immediately resume routine visa services, and Plaintiffs are not challenging the decisions of consular officers." while listing DHS as a Defendant. The "No Visa Policy" was from DOS.
Yes they did say that. I read the whole document. They said that not issuing visa because of travel ban is capricious. Travel ban if you have been in a country banned is legitimate but issuance of visa because of ban is illegal since you can easily overcome that by visiting country not banned for 14 days. Also, they are giving student and visitor visas in places where there is no ban but still denying to interview K1s. This rebuttal righly points that fact out.

Any idea about Mumbai consulate!? Are they even working or not!?
I have been following Mumbai closely and its been very frustrating. They opened spousal visas on September 1st and have given interview dates to most of those whose appointments had been canceled. Still, they have not processed any K1s. Only hope is that K1 lawsuit positive outcome will force embassies worldwide to give K1s same priority as spousal visas. There is no specific date if and when that will happen.

The lawyers have asked the judge to rule by 10/20/2020.

Yeah they started doing spouse interviews. It says on their website as well.
I don't think they are ready for your interview yet. Most likely, they may be doing Feb DQs. Wait for 2-3 months. Your turn will come. Keep contacting embassy once a month if you want.

When was your DQ? Even though they have been doing interviews, they never give straight answer. I think Pakistan started doing IR/CR interviews in September.

I thought you need original documents for beneficiary only. Even USCIS and NVC approve with photocopies because the embassy can easily verify the authenticity of documents issued in the US.
