    Hey not to be rude but you often move my posts to areas with less audience.. I observed this with the last post. Just saying. This was meant to be CR1 related.

    Hi Bigmeg,
     
    I just filed with divorce waiver. But the difference in my situation and yours is that my divorce has already been finalized. I would definitely consult with an immigration lawyer on your situation. Definitely not a good idea to file jointly but remain separated.
     
    Filing with divorce waiver is similar, you still have to prove it was a bona fide marriage. 
     
    From reading other's posts in the forum, might be possible to file with divorce waiver now, even though your divorce is not finalized yet. Months down the road they will send an RFE, and then you can submit your divorced papers when finalized. This is what others have done it seems.
     
    My advise would be to seek an immigration lawyer's advise.

    The problem is I’m due to remove my condition this august... so they may need my original certificate for that.. I don’t know if I should call uscis to address this question

    You can but not sure why you would send something that isn't even needed.   Best to concentrate on evidence that is and will benefit your chances of success

    I think you need to read again.   
     
    1.  You never submit an original document to the USCIS with any petition or application 
     
    2.  Marriage certificate is not even mentioned as a requirement.

    Hi guys, name is Bigmeg and I’m a Nigerian married to a U.S citizen. I met my wife “Online” and she’s “30” years older than I am. All I can say is God’s been faithful because after a year of waiting I got my visa from the dreaded “Lagos consulate”. I’m not here to write an epistle of my life story but I’ll be brutally honest with y’all cus I’ve seen people post about red-flags and I’m here to tell you that I’ve been through red-flags and made it. One thing you need to know about these red-flags, the consulate doesn’t give a ‘rats ###’ about your personal life issues with your spouse, the United States consulates are more concerned about you being a public charge to their economy, I repeat, that is their primary concern. If your spouse is financially capable, forget it you’ve gotten your visa. They don’t care about age difference or class difference or what not, all they care about is MONEY!!!!!! 
    Could you believe I went to the consulate and they didn’t even ask me to bring any of my wife’s documents, pictures, taxes etc. he asked me a few questions and congratulated me. Listen don’t kill yourself with stress, if your spouse ain’t financially capable start seeking for a joint sponsor, don’t wait until you fall in the black hole “AP”. Guys, it’s all about MONEY and nothing else, that’s what the U.S embassy cares about. Thank you.

    We have and thank you again for the information. He will not become a public charge and my employer has added him to my insurance due to our marriage license and my length of employment.

    Is not your case. The CO would told you if you are in a bad AP.
    My case, after interview, was in AP for 2 days and then my visa was issued. 
     
    Just breath and enjoy!! 🙃

    If the CO said that the visa was approved then that is totally normal. It happened the same to me next day of the interview, and after 1 day it said issued. Congrats!!
