No, this is a long process after a denial You need to wait for the NOID to arrive back in the USA (about 6 months) I filed my own appeal but i knew how to do this myself so i only paid the $110 fee (fee in 2011) If you can not write in legal terms , you need an attorney but only after the NOID is in your hands The appeal took a year and even though it said "marriage is bona fide " visa was not approved / it said i could reapply If i had known this , i would have saved time and just reapplied I suggest after the NOID from the US office is sent to you , you either respond to the query with actual proof the CO is wrong when i say actual proof if it says she does not want to live here , print out former dated emails or dated chats with her talking about long range plans to live and study in US you need to respond to each reason for denial with actual proof that the CO was mistaken not just "she wants to live here " You need to respond to these in both appeal if you decide to do it or answering the NOID or sending new petition I suggest you make sure IRS returns are joint and you file the W7 with this years returns if you haven't already gotten her ITIN and you start show commingling of finances to strengthen your case
