  1. Tourist visas do not go thru NVC they are easy for the embassy as little paperwork to see for that interview to have an approval or denial no medical needed so no document no sponsor needed to no document no AOS it is up to immigrant to just show a few things how they pay for trip money for stay in USA and ties to show they will go back home as for student visas , these need fast approval now to be able to travel and here for the semester which starts in either August or September (only a few months away) and again if the student has the needed documents I 20, a valid passport, ds 160, paid the fee, can show they have monies or scholarship to pay the school, and updated passport photo, its an easy decision for the CO the real backlog is with the dv lottery which was to be done by last September and is still getting processed (with the new dv lottery results out now creating a real mess) https://travel.state.gov/content/travel/en/legal/visa-law0/visa-statistics/annual-reports/report-of-the-visa-office-2021.html if u look at the stats , there have always been more non immigrant visa than immigrant this is mainly because there is more work, more documentation, more security checks for both USC and intending immigrant as that person is to permanently live in the USA as for spouse visa the 2017 report total for all countries was 70,809 and conditional spouse of 41,822 and end of 2021 fiscal year was 64,964 and conditional spouse 20,092 only dropped 5,845 spouse visas from 2017 to 2021 with drop of 21,730 for conditional spouse visas for the same years contacting congress, they have done nothing in so long , good luck they have know about the illegal immigrants for well over 20 years / do they allocate money to ICE to help-no they take money from other agencies https://immigrantjustice.org/staff/blog/ice-lies-manipulates-and-takes-money-other-agencies-lock-and-deport-more-immigrants this is why the Presidents lately have taken to making Presidential orders
  2. is this a CR1 or K1 or other visa? makes a difference in the answer
  3. OP I must apologize for not having more sympathy for your situation we all know u have put valuable time and energy and your heart into this we all know as we all have done it too and i married from a high fraud country too so i took a lot of criticism but we know u fell in love we know (from your posts) that your heart and head were in conflict its hard to not know if your doubts are real or if others have influenced your thinking but please please be cautious and don't ever think we post on the negative for any reason other to make u aware and hopefully get u thru this heartbreak i was talking reality here without thinking of your heart and what u have put into a relationship i just think u dodge a bigger problem he would have given u if he was with u and u married so very sorry for what u go thru now
  4. Maybe reading what attorney Hacking says about NOID could help he is a lawyer often recommended here on VJ https://hackinglawpractice.com/lets-talk-about-noids/ Like i said i did my own appeal and won but i ended up reappling on top as that was what the immigration court said i could do and it took longer to appeal than just to reapply and fight the issues in a new petition
  5. but he can turn in a ticket and rebook for a different flight / he could be anywhere in the US
  6. yes, my house phone called my cell phone and i was not doing it and i use to get calls from scammers that were in other countries and it would come up as a US number How? 1. transferred from nearest cell tower here and picks up any number 2. caller is close to that number and able to use invade it for their use 3. scammers (For information only) get a sims card from a friend in UK, france, USA , Canada, etc and use it in their phone in their country
  7. Yes, if u did not provide the actual REAL proofs to overturn the issues the CO had
  8. NOID is notice of intent to deny to appeal a NOID u must present actual proof that the reasons for the denial is wrong Examples the notice says u have not met in the last 2 years before filing the petition and u have proof of boarding passes within the time and photos from that trip to be together u can not just say "that issue is wrong or not true" u must have REAL proof that any issue the officer has with your petition is not valid It is doubtful they will reconsider and the appeal takes more than a year best to reapply and when u receive the NOIS , address the issues in the next petition or at interview How do i know? i did an appeal and won as i had the necessary proofs (this took over a year pre covid) and my letter from the Immigration Court of Appeals said "marriage is bona fida and i could reapply" What can you do? Receiving the denial notice issued by USCIS means that you are given the opportunity to file a motion to reconsider or reopen, or you can appeal the decision (Form I-290B). The deadline that you will have to meet is 33 days of the decision date. Besides, there is a filing fee of $675.Oct 26, 2021
  9. How many times can you apply for K1? Can I apply for another K-1 Visa? You can only apply for a K-1 fiancé visa one time in a 2-year period, and only two times total. So if it has been more than 2 years you are okay. If it has been less than 2 years you will need a waiver.
  10. watching youtube about border and security about different countries , it seems they call when the person is coming on a tourist visa and ask the person (in this case fiancee) if they are suspecting someone to arrive and if border patrol thinks the person is planning to work without the proper visa , they call a "suspected employer" to ask if the person is expected to start or return to a job how do they know a person is coming with fraudulent immigrant intent? the person brings documents like work history, birth certificate, job info, no money to live on, etc and they all allow the immigrant to call lawyer or family (1 call) to say they are being arrested if that is the case
  11. OP 1 of 2 things happened He fly into Chicago and from there disappeared on his own after going thru Customs and he scammed u If he did that u r better off without him Or CBP sent him back as they suspected he was breaking one of the immigrations laws and he has a bar now If that is true CBP did u a favor and u are better off without him What can u do now? Do nothing / u have not married /u have not signed the I 864/ u do not have to pay for health care for him/ or support him for the year or 2 that it takes to get the approval to work and you are $1225 richer/ u r off the hook and YOU ARE BETTER OFF WITHOUT HIM
  12. When entering the United States from overseas, you must obtain your luggage and bring them through Customs and Border Protection (CBP). You will need to check them back into the airlines to make your next flight. Baggage not obtained after your international flight will not get to your final destination. Straight from CBP site https://help.cbp.gov/s/article/Article-992?language=en_US
  13. you are not married so it would not say this He made it to Chicago on your money as for a 5 year bar, an attorney is not going to be much help i suggest u google border security and watch some youtube videos to see what CBP is concerned with
  14. no reason to worry as u got the receipt so it was accepted your fiancee may want to check with the bank
  15. u asked for Delta rules and i posted directly from Delta rules my husband just flew Delta to Moroc and needed mask when landing and is flying back to Atlanta today and the stewards say a mask will be needed when landing in Atlanta
  16. Make a new SS office appointment print out the info from this page https://www.***removed***/k1-fiance-visa-application-process/#:~:text=K1%20visa%20holders%20can%20get,in%2 Go to the appointment and if the desk person does not know the process, ask for a supervisor
  17. u need to understand the process File I 130 outside the US she may hold a tourist visa but a CBP officer may not allow her into the US as they would assume immigrant intent when they pull up the info on computer if I 130 is approved u do not file I 485 as she is not adjusting her status here If u plan for her to come on the tourist visa and to file I 485 , that is fraud and when she is at the POE the CBP will ask about this Don't take any chances file the I 130 and go thru the legal process to
  18. Roe v Wade affects every woman in the US and therefore there is a big push to overturn (1 side) or to uphold (other side) same sex marriage as defined by law does not no reason to overturn it and we are not hearing it is pushed by anyone to overturn the decision and many religions fought against the 2015 decision and lost In 2013 Immigration allowed marriage by same sex couples (if married in a country that allowed this and the couple to reside in a state that allowed it ) the same as marriage between a man and woman and this is before the federal government made the law basically doing away with DOMA Department of Homeland Security Secretary Janet Napolitano said: "[W]e will implement today's decision so that all married couples will be treated equally and fairly in the administration of our immigration laws".[37] On June 26, 2015, the U.S. Supreme Court struck down all state bans on same-sex marriage, legalized it in all fifty states, and required states to honor out-of-state same-sex marriage licenses
  19. we never got a physical notice for interview that's why i thought this was for the oath and that is why u were concerned
  20. This is the part u need to know as all visas are refused for administrative processing If you were informed by the consular officer that your case was refused for administrative processing, your case will remain refused while undergoing such processing. and u do not need to worry unless the CEAC site says denied Depending on how well your country keeps records will be the determination on how long the AP lasts which can be days, weeks or months always good to state the country in your posts and to follow the portal for your country and read posts there (Hit the word portal above and scroll down for your country) and please do a timeline
  21. Does the email say to print it out? Is there an attachment with the security questions that have to be answered the day of the Oath and signed in front of the immigration officer?
  22. Roe v Wade has nothing to do with same sex marriage/ its about abortion and women and u are both men Legally marry and he returns to Korea for the CR1
  23. I don't think there was any CBP person involved in all this sounds like the immigrant got here and pretended not to be admitted as he had other plans to join a different USC he had been talking to just as the OP suspected
  24. He can return to Nigeria for the interview how he will get the needed criminal report from this European country will be interesting as he is not there legally He will be asked for criminal reports from Nigeria and this European country Good luck on that one
  25. Reading this post i think of the man who waited for his K1 fiancee at the Atlanta airport and he posted on here he said she sent him a text saying they were refusing her entry and sending her back to her homeland as he was getting his car, he saw her in another car leaving the the Hartsfield Jackson airport if your info comes from your fiancee , u were used for the K1 as u originally thought i also watch youtube border security videos so, who informed u that he was detained? if him, i highly doubt it there is no reason for a CBP to refuse entry for an approved K1 visa unless u cancel the petition/ afterall this person passed all the security that immigration did to approve the petition and him GF u were used for a visa and u should have cancelled
