I hope I don’t sound nosy. But I was curious what causes an administrative processing and how to avoid that? That is a very long time to wait! 😧

No it’s fine you aren’t being nosy at all. I mean after all I am putting my information out there so people get curious. A lot of things can cause administrative processing. In our case it was mostly because of my fiancé’s travel history and his nationality. He is from Afghanistan with an Afghan passport and has traveled to Pakistan a couple of times. Even though he has been living in Germany for 20 years, they looked past that and put him into administrative processing due to his background. Like someone else said on here if your fiancé isn’t from a middle eastern county no need to worry too much.

We’ve been waiting on administrative processing for almost a year and all of the sudden I see this.

Our K-1 visa has been in administrative processing for almost 2 years and has not expired yet. But that’s because I am continuously in contact with the embassy as well as extending our intend to marry letter every 4 months. I send the embassy a intend to marry letter every 4 months. Were you in contact with them?

I think @Jorgedig was implying these are things you need to address when submitting your expedite request. Your medical records alone may not suffice but if your doctor writes why/how the fathers presence would be important for your high risk pregnancy may be more helpful.
No one here knows what you are going through and USCIS/embassy wouldn’t know either if you don’t provide the correct documentation. No need to get so defensive 🙂

    Oh okay I’m sorry @Jorgedig

I did not understand. My mind is just everywhere.

And also why your high-risk pregnancy merits an expedite.  Presumably, you have access to prenatal care and the beneficiary's presence won't impact that care.

How do you know what I am going through and how do you know if his presence will impact that care or not... I am going through a lot at the moment all by myself and emotional/mental support even physical support would help a lot!

It makes a difference in that you would have better chances at expediting the case if you (the petitioner) are pregnant rather than the beneficiary. Everyone assumed you’re the beneficiary, that’s why the question was raised about giving birth in Germany vs US. Perhaps it would good to be clear from the beginning.

Oh okay I see, thank you. I’ll make sure to be clear next time.

It makes a big difference on who is pregnant not where you would have the baby. You as the USC need to call and supply them with your medical diagnosis, what exactly you are high risk for. Doctor's official letter. (I don't need to know but they will,  for example being over 35 makes one high risk but does not make one automatically eligible for expediting.) They will make the call. If you were the beneficiary it would be most likely be denied because if a USC wasn't involved then the person would deliver in their home country without a thought.

Okay that was very informative, thank you. I will look into it and see what happens. Thank you very much.

Probably not but are you sure trying to deliver in the USA with covid this high is safer than Germany ? I would rethink that.

Honestly I am not really understanding what you are trying to say! Is it safer in Germany to deliver the baby or USA? And this has nothing to do with my question as to where I want to deliver the baby? Why does it matter where I am going to deliver the baby?

My passport is due to expire in Feb 2022. I recall that you need a passport valid at least 6 months after your intended entry to the US once you have your visa in hand.

Considering the travel ban on European countries currently in place with no end in sight, it means I will have to renew my passport some time between now and September 2021 max.

my K-1 application (as the beneficiary) is currently stuck at NVC until it can be transferred to the US embassy.

so my question is this: Can I update my passport number at NVC already (if I renew my passport now)? Do I have to wait to have an interview scheduled at the embassy? What would be the best/possible  moment in the process to do it?

2022 is a year and a half later from now and I’m pretty sure you’ll get a interview date way before that. I wouldn’t even worry about it right now. I would wait and see if I hear anything back from the consulate the beginning of next year and then worry about the passport in the middle of next year. Good luck.

He is from Afganistan and traveled to Pakistan and so the reason for the long AP which  those 2 issues prompts

updates on the CEAC sites means case has been looked at by immigration officer/  they may have recd some background info for their security checks/or they may have asked one of these countries for additional info

I already knew the reason for the long AP was because he is from Afghanistan and he has traveled to Pakistan. Thank you for letting me know again lol

however, I wasn’t sure about the frequent updates. I kind of had an idea it might be because of them working on the case but wasn’t too sure so thank you for confirming.

Does anyone think the k1 will actually go through for all of us waiting or are they going to keep it on the backburner until it gets removed as an option? Will they at least continue processing the ones who have been submitted? Even if we do get our k1s, will the USCIS even be around to submit our AOS? If we all get told no more k1s and we get married and file for a spousal visa, will it take years due to there being an almost non-existent USCIS?

I am checking these boards every single day and not a speck of good news ...for months. I'm always checking the news each day and it's always something really bad about USCIS shutting down or the post office..etc. I've never been this depressed and heartbroken in my life. I regret filing a k1 more than anything and I'm sure I'm not alone.

Does anyone see any light at the end of the tunnel? I just want some good news for once, if even really small.

I can totally understand your frustration... this all is very heartbreaking for me. My fiancé had his interview last March (2019) and ever since then has been in administrative processing. When I use to email the embassy they would reply and say our case is under administrative processing. And now when I email them, they reply with we aren’t processing k1 visas right now due to covid 19. So I don’t even know what to do anymore at this point :(

I am the only one thinking that it's been alot of years and the relationship should have developed from fiance to marriage notminding immigration status?.... I think you both should consider marriage and stepping up to CR1.

Yes that’s exactly what I wanted to do. But the whole process will start over again which is why I have been waiting since I already waited so long.

I am sorry that is taking so long. I can only think that something got lost in the mail regretting your case.

I am sure you like, already done this. But did you sign up for https://egov.uscis.gov/casestatus/ ?

Also you can write your local State rep asking for help and information. They might not be able to get it done now due to Covid-19. However, they might be able to give you some answers.

Also someone with more experience, correct me, but doesn't the  221(g)  form come with the reasons for it and the steps how to correct it? Like you will know why the visa was refused and placed into Administrative Processing.

The main one I been reading about online has to do with the background check or the Validity of the Proposed marriage.

Maybe if it has been two years, you should seek experience legal advice.

Thank you so much for your positive feedback and remorse.
I did not sign up for that case status, but I do look at my status on CEAC from time to time.
I emailed my local state representative last year and the office said they would email the embassy but I never heard back from them again. Maybe I’ll try again sometime soon.
My fiancé had to fill out this form called DS 5535. In this form it asked questions like his past travel history, his past home addresses, family info, social media info, etc.

They gave him this form to fill out after his interview, we filled it out and sent it back within a week and ever since then he has been under AP.
it’s most likely they are doing background checks but like almost a year and a half, like seriously.

    Hello,

Over a year for AP is highly unusual for Germany or any EU country.  I have only heard it taking that long for Pakistan and a few other countries.

Did you follow up with the embassy and/or your congressman?

Well yeah he is originally from Afghanistan and has traveled to Pakistan within the last 10 years so I understand the lengthy AP. However, I was hoping to hear something at least after a year of AP but it’s been 16 months since he has been in AP and then now with Covid-19 it’s even worse because it’s AP and Covid-19 presidential proclamations.

  14. 12 minutes ago, Jorgedig said:

As mentioned in the other thread, the reason for his AP is likely his country of origin and travel history.  The answers are still the same:  AP cannot be sped up or waived.  This would be the same even if there was no pandemic and embassies were processing K-1s.

    Hello @Jorgedig

I know and totally understand that AP can not be expedited, and that was not my question. I don’t expect for our AP to be expedited. I just want to know when they’ll resume processing K1 visas because right now whenever I email the Consulate in Frankfurt, they won’t even give me an answer on our case or even an update because they are saying they aren’t processing K1 visas. When I use to email them before Covid19 they would at least give me an update and let me know what was going on with our case. Now it’s just oh, we aren’t processing K1 visas right now.

If you filed a K1 over 2 years ago, it should have been processed long before the Covid started. Most were processing from filing to visa in hand in 8-9 months, worst case 12 months a few years ago. your fiance should have had his visa a while ago. What month/year did you file?

Yes I know he should have been here by now. His interview was last March 2019. After his interview, he was put under administrative processing and has been ever since his interview last year.
We filed in May 2018. His interview was March 2019. After interview was put into administrative processing 😕

  16. Hello Everyone.
I don’t think anyone will know the exact answer to this but any ideas or suggestions would

be great as I am getting overly anxious with each passing day.
I know they are currently not processing K1 visas at US embassies around the world due to Covid-19. However, does anyone know or have an estimate of how much longer they will not be processing K1 visas? I saw somewhere online today that it might be until December till they start processing K1 visas. And this is making me

extremely overwhelmed and anxious as we have waited already over 2 years for my fiancé to come to the states.

16 months is too long. I think at this point you should sue the government (wom). Please, u should hire an experienced immigration attorney at this point.

At one point that’s how I feel and then another I am afraid if I do file for a writ of mandamus, we would get denied. And it’s scary because we have put so much time, money, and tears into waiting it out. It’s really hard making a decision.
