    That scares me, the fact they're going to 'contact immigrants soon'...

    No unfortunately, I am in the UK. I have my K1 in hand, was supposed to travel on the 8th Apr and it expires on the 9th Jun. I had just come to terms with the idea of having to get it reissued as advised by the embassy here if it expires, but then this wonderful announcement has sent us (and everyone) into a state of panic 😔

     

    It's always such a grey area with K1s in the technicality of it being non immigrant and immigrant, that's why I'm additionally confused! 

  3. I mean, what is even the point of a K1 visa if when it comes to the crunch, if you're not a 'spouse' already, you're left out in the cold?? Its not as if it's a flippant tourist visa and we get married and adjust from there. We apply and wait out the process legally as an engaged couple planning to wed.

     

    I know we dont have any clarification on the EO just yet but nowhere in any article that anyone has posted has mentioned the word 'fiance', and the EU/UK travel ban left us out of that too.

As an approved K1 visa holder who has not yet been able to enter the US, I HATE the fact that a period of 90 days separates us from those who are already married, when that is our full intention and sworn commitment to do so after arrival, especially when we have spent (in my case nearly a year) of processing & vetting our applications including an affidavit of support to demonstrate that we can be supported by our partner.

    Travel from the UK is banned for K1 holders currently (regardless of citizeship/passport held) - the traveller cant have been in the UK for at least 14 days.

    Awful news, however I unfortunately know first hand as I am a K1 visa holder who was supposed to leave London on the 8th April. I also have dual UK and Australian passports and it doesnt matter as travel is from the UK 😔

    That's my logic! I am happy for forgo my 'employment authorisation' in my AOS for my K1 too, just want to be with my partner.

  7. Hi all, I know Mexico-USA land border crossings are currently banned, but does anyone know if arrivals by air into one of the designated airports is also banned?

     

    Just looking for facts please, not comments about 'why would you be travelling right now etc' which seems to be rife in these forums.

  8. Waking up to this news and my heart is crushed. It's very hard to adapt the 'just be patient' outlook that people are recommending, when there are more factors than just longing to see your partner at stake.

     

    I have a valid K1 which was issued and I was supposed to travel from the UK on the 8th Apr, but couldnt due to the travel bans. My visa expires on the 9th Jun.

    Meantime, I resigned from my job in Feb and gave my 1 month notice, so had just finished working when this all hit. I also work in the travel industry and there is zero chance of getting my or another industry related job in the present circumstances. My US fiance has therefore paid the downfall between my rent/bills that my savings couldnt cover for the last month and would have continued to do so until the travel ban was lifted. Now I am going to be stuck. I have no family here in the UK as I'm originally from Australia, which before anyone comments that I should just go back there, I have 2 pets that were also coming to the US until their flight was also cancelled and are not allowed to go to Australia for a long time.

     

    I had just made peace with the fact that my visa might expire before I can travel and would have to go down the route of a possible reissue request based on information from the UK USA embassy, so even after all the months worrying about the initial K1 and process, I had accepted it was just going to take a bit longer. Now, this announcement may be forcing us to be apart for an indefinite period of time. My US truck driving fiance who hasnt stopped working through all of this to ensure food and essentials are still delivered throughout the US, who is paying double rent and then some, for us over there and here due to the crisis is so upset, as I am.

     

    I am completely lost,  my heart is so deflated.

    Actually, contrary to that - an immigration lawyer here in the UK I spoke to had been speaking to our Us embassy here who said it's more than likely K1s will be reissued providing a new medical is performed and the police certificates are valid. 

     

    I dont think you have any more insight into the US immigration system intracacies and visas than any of us do, and I've seen in many of your posts about how people on K1s should have gone for a CR1 visa instead. Well, hindsight is a wonderful, but not particularly helpful thing when absolutely no one could foresee these circumstances. There are SO many factors as to why someone (myself included) opted for a K1 over a CR1 visa, and many K1s have been reissued in the past under very different and not as uncontrollable circumstances, i.e I personally know of someone who had theirs reissued as the timing didnt work out with the sale of their house so your 'insight' doesnt really hold a lot of weight.

    Thanks for your personal view, I've seen you respond with a similar post on other threads, I'd just like to comment that your sweeping statement is also likely irrelevant to most peoples situations.

     

    If your partner was in a position where she had zero financial, employment, health, real estate, children, family commitments and was able to just leave as soon as the Visa was in hand, then that's a very fortunate position to be in but an unlikely one for the most of us.

     

    My visa was issued 3 months before my entry date, also leaving another 3 months validity on my K1. Im from the UK and I dont know where it's like where your partner is from, but here I have a mortgage, a job with a 1 month minimum notice period, a car, a house full of possessions, having complications due to a serious ovarian cyst that my Dr here in the UK is dealing with, pets who are being shipped and require certain vaccinations and arrangements to be made that cant be done instantly. Moving almost as soon as my visa was issued is near impossible. Without having any idea of how long the process would take or if it would be approved immediately, how would you suggest people plan around an immediate move once a visa is issued? I dont think anyone was factoring in the possibility of the world coming to a complete grinding halt.

     

    If your K1 had only just been approved last week, and the next day all travel from her home country and restrictions into the US had been placed the very next day, regardless of your fiancee being in a rare position to just be waiting without any baggage or commitments, for her green light to go to the US and just drop everything in an instant you'd find yourself in the same position as many at the moment, so it wouldnt matter whether you had waited or not.

     

    In these trying times, may those of us in this situation more forward with support for each other - the last thing we need is judgement and questions over why we didnt just up 'n go with visa in hand.

I am allowed to fly as a citizen but I want to know if I can get him across the boarder or if we just have to wait it out. Via expiring end of June and I need to get a job and place to live before we file for AOS and it’s looking like a bad bad time to be interviewing for jobs! 
    I called US embassy in London who hung up on me and said I have to email them! 

     

    It's really so scary. I am hoping that the USCIS maybe put like a provision in place or something with these K1s to maybe extend the expiration dates or AOS periods due to the circumstances... we seem to have been forgotten in all of this which is disappointing given most using the K1 visa are in some way closing down their life in one country to move to another! I have 10 days left of my job because I had handed in my notice period thinking I was leaving soon, so now not only do I not have my house in 3 weeks, also no job. 

    I do understand the measures being taken in heavily restricting traveller movements between countries to try to reduce the spread of the virus, but as it's not a total ban for citizens, spouses and residents it's just unfair it didnt extend to K1 given it's a fiance visa as so many of us are now left in very dire positions.

  12. I am in the same boat in that I am due to depart the UK on the 8th Apr. My K1 doesnt expire until June, but who knows what will happen in the meantime.

    I am only in the UK on a working holiday, originally from Australia so I have no family here and few friends. Meanwhile, I have sold most of my things, handing keys back to my house in 3 weeks, sold my car and worst of all are taking my 2 kitties who are booked to fly on the 2nd Apr. Hopefully they still can as some airlines will be operating a skeleton schedule (so far anyway). I certainly dont want to take any risks for myself or endanger others, but its disappointing that considerations for the K1 Visas weren't given when they are sort of family based visa, more importantly with expiry dates. We've all been through the process to reach our K1 approval so how is it fair that those already married are free to enter, but not us... are we really that different? So disappointing.

     

    Also, I am a travel agent and have been for 20 years. Calling the airline will be of little use, they are not the authority on visas and more often than not give out the incorrect information (I work on an emergency line and travellers are quite often rejected at the departure airport or if not picked up, at the arrival in customs for not having the right entry documents/visa that the airline should have, but didnt, confirm at departure). 

  13. Hi all, just wondering if anyone can shed any light to either put my mind at ease or help me be more prepared... its re my ACRO/history. Sorry in advance for the lengthy post.

     

    My (Im the beneficiary) K1 Visa interview is next week in London, UK. I have a current ACRO police certificate which states 'NO TRACE'. 3 years ago an ex boyfriend of mine was arrested for possession with intent to supply and I was subsequently arrested too - I had absolutely no idea about his activities and had just moved in with him but was told by the police at the time they needed to investigate me as I had already redirected a utility bill to the same address as him. I was released and not charged etc. 

     

    My interview was supposed to be a few weeks ago but I was so paranoid about being asked for a SAR (subject access report) after reading posts on VJ so I rescheduled my appointment and now have my SAR, which outlines the arrest and states 'DISPOSAL - NO FURTHER ACTION' and 'REFUSED CHARGE' and it stated that my DNA/prints have subsequently been destroyed.

     

    I can really only find information about people running into problems with denials and additional investigation required when they have a 'No live trace' status but mine is NO TRACE - the police found I was not involved or aware of the crime but I feel like I am being punished and am so scared that I'll run into issues at the consular because of someone else's crime!! It put me through such hell when it all happened and I am long gone from that relationship, but I feel like it still haunts me to this day as I have to go through these extra steps because of someone else and feel so stressed out and pretty angry everyday because I just want to be with my fiance!

     

    Can anyone share any experiences about having a previous arrest to their name but a No Trace status and NFA on their subject access report?

  14. Hi all,

     

    Just had my medical for my K1 today in London. All went fine, however I had ticked 'yes' to being arrested as I was falsely arrested, and released a few years back - my ACRO police certificate states 'No Trace'. From all of my readings, a Subject Access Report is only needed when your ACRO states 'No Live Trace', not for 'No Trace'? The Doctor today suggested I may need one for my interview?? I am now worried I wont have enough time to get one as my interview is on the 20th Dec?

     

    Any advice would be appreciated.

    Thanks. My main concern was the fact that I read somewhere that instead of your DS160 taking about 5 days to process it can take up to 16 weeks if you say YES to that question. Cant seem to find an answer on that anywhere.

    Hoping for some advice re the question of 'Ever having been arrested' on my upcoming DS-160 as my fiancé and I received notification from NVC that our file has now been sent to the consulate here in the UK.

    3 years ago I was arrested due to residing in the same house as someone who was arrested for a drug conviction. While they investigated him (who was later charged and sentenced), I was released as it was a 'false arrest' - I was arrested as I had a telephone bill to the same household as this guy. It was very upsetting at the time and I was SUPER worried it would hinder my future travel plans anywhere, which it never has so far and afterwards I got a police certificate for travel here in the UK and it states 'No Trace'. I even asked the police at the time for travel purposes and they actually advised me that I could say I hadn't been arrested/cautioned etc as it had been removed.

    I keep coming up against conflicting info - I know everyone says to declare any arrests, but the police here (and the certificate) told me it had all been removed and I could say no to this question if I travelled anywhere should the question come up.

     

    Just wondering if anyone else has had a similar experience and the outcome, or any advice? I have been reading if you say YES, there is an extra form and the standard processing for your DS160 goes from about 5 days to up to 16 weeks!!!

    Me too. My life is just completely on pause at the moment, too scared to spend any money as I have no idea when NOA2 will be approved and to ensure we have the money on hand for the medical, visa etc. As well as saving for moving and living expenses. 

     

    Am in a job I hate more than words can say, but no point in moving now and starting a new one in case I could be moving within a few months, but could also be more than 6 months. 

    Am growing so tired of starting every week thinking 'Surely this week!', then it passing and nothing.

     

    Horrible process!

  18. Currently at 113 days, still waiting. It's taking such a toll, and although its genuinely nice to hear of others approvals, it takes such a toll to learn that later files than us have received approval. What's worse is calling USCIS only to be told we are within the waiting period so they have no information. Would be nice to have a bit more info from them though, i.e. is there additional security checks going on with our file, is something missing, is the person processing just lazy? This process sucks!
