    What ever I said didnt require a smart mouthed reply & you knew exactly what you were doing. The first sentence you wrote is in direct contrast to what you say you dont do. In reality I dont think what you have to say is all that interesting nor important.
    I certianly did refuse to help them & dont have to meet your expectations in my actions. I am not trying to comply with your definition of a samaritan or Mother Teresa. If you help illegals you are assisting a fugitive. I assist them by suggesting they go home & use the legal methods to enter the USA.
    You seem to appreciate some aspects of the USA to conduct yourself as the samaritan you resent while complaining about the same government that affords you those opportunities.
    This country isnt perfect but there is a reason many of us that immigrated here feel its the best we could dream of & more than I thought I would be able to be part of.

    You think myself or others should enter into helping illegals find a way to stay in the USA? They are breaking the laws while using the services provided for by taxes they dont apy amoungst other things. My guess is you run your mouth while exerting zero effort in any direction.
    They arent ostrizised because of where they were born. Its because they arent born here & enter illegally. You think we should just open the boarders to rid the USA of all social problems? You must need to be educated in social sciences badly.
    You think the problem is centered around hospitals that care for no paying people? Where we live there are many of those people & they are almost all illegals. You simply dont have a clue.

They are forced to live a miserable life in my opinion while having no way to repair what they have done. Some have contacted me asking for help. My responce is that they need to go home. I will not assist them in any other way.
    I know somone where I live that has done exactly what you describe. She is very sorry for what she has done. He husband will leave soon for Canada. She has no idea of how she will survive here & cant go with him. She works for cash as a waitress but this wont be enough to pay her expenses soon. They have lived with the feeling of looking over their shoulder for a long time. She cant work, drive ect because of the lack of status. I hope she will return to Thailand.
    There is no question that immigration must be done by following the laws. Its difficult, expensive & takes a long time but there is no better investment in a lifetime that I can think of. This country has provided me exactly what the Constitution describes as well as the opportunity I had dreamed of.

    This just shows how difficult it can be. I know because I applied 3 times myself & was denied each time. The officer told my husband " I believe everything you have said but we are told if we issue tourist visas in these circumstances we will be fired that same day". At the time I was married which meant that as soon as I would enter the USA my ties would be to my husband & not my country. We intended to visit the USA for a few months only & would have returned. I had a business, house, daughter, family & a bank account as well. We then decided to get immigrant visas & move here to become citizens.
    In the case you point out it would seem likely he would return to me. It also possible he would walk away from those ties I suppose but it doesnt make much sense to do so. Especially because he has demonstrated he returned before. The only thing that can be done is to try again with even more evidence submitted. Or be adopted by Angilina Jolie.

    She wont be leaving Thailand without a visa. Two check points see to that.
    Why do you think she wont be approved? There is no reason to think she wont if you have done the documentation correctly which will result in the interview. The interview is easy for her. However it is at that time that your ability to support her that becomes the important factor. You will submit the 134 form & should submit tax transcripts as well. If that is done there should be no problem.
    This is no time to give up. Its tough to have to wait but like everything we have to work for its worth it in the end. Dont let this get to you,throwing away the future you planned.
    For what its worth I was standing there in LAX as they detained a Thai female that had some visa entry problem. It didnt take 30 days, rather 30 minutes tell her she was leaving on the next plane to Thailand. She was locked in a glass walled room right there to wait for the plane.

    I have been helping a USC & his Thai wife with a very simlar problem. They have been trying to get two kids visas for months now & still can not get it done. The Thai has one of these Thai court orders. These orders from a Thai court are useless inside the embassy. The embassy is U S soil so they go by U S laws.
    The background of her life as a young mother is the norm in Thailand. The fact that the father hasnt been seen for many years is the norm as well. That explanation will not help.
    There is always a way. Your lady will have to begin with a plan to prove beyond doubt that she nor anyone can find him. She must NOT say the kids have seen him or his parents or anyone from his family. The fact that he has been gone for 10 years will help. She should go find someone or some way to prove he hasnt been seen in all that time. Go the the police to get a letter saying they havent seen him nor know how to find him. Same for every contact he might have had in the past. Do not take this process lightly. In the experiance of the embassy these guys are often found when people really look. For this reason they will not make this easy.
    Forget the idea of the Amphur document making a difference. Same for anything from a Thai judge. Everyone that tried this was denied & sent away to try a different avenue. The embassy will not tell her how to find him. They will insist she continues to try up to possibly a year.
    She can try buying a pin number from any Thai post office that will allow her to call directly into the embassy. She must not ask about her case. She needs to ask general info questions only. Like; will they accept the Amphur letter. How about the effect of the Thai court order. This will allow her to feel she has the correct answers because most people dont want to hear it from people such as me. They always believe they have a new way that will work. The women I spoke of wasted 3 months so far only to let me know what I told her was in fact correct. Now she must leave to use her visa or loose it because she didnt get the kids visas so far. My husband is working with her USC husband to help them find a way. We have helped in 4 of these cases now.
    This isnt impossible if there is a thoughtful plan based on knowledge of what the embassy demands. Below are the responces sent by the embassy to questions from one USC we are helping.
    Read these several times. My husband points out that they have given a lot of info if you read between the lines.
    Embassy:
    We normally discuss these issues in person when people come for their interview. Applicants are generally able to satisfy the documentary requirements for immigrant visas without hiring an attorney. The normal requirement is to provide an affidavit of consent to emigrate, using our language, that can be executed by the biological parent either at the district office or at the embassy. Usually biological parents can be tracked down, such as through the grandparents. In the absence of a court document stating that only one parent has custody, we generally require that parent to make every possible effort to contact the absent parent before we will consider other possibilities. These children are not very old and one of them has had recent contact with the biological father, so we encourage your fiancée to make every effort to contact the father to have him swear the affidavit of consent.

    Thank you for your response. We again must state that we can’t provide any individuals with specific advice about their situations, but that most applicants discuss the situation with us at their interviews to determine the best way to proceed, and that most applicants do not need to have lawyers. Most applicants don’t qualify for a visa at the time of the interview anyway, and have to come for follow-up, which is no problem as long the follow-up takes place within a year of the interview. So, you may wish to postpone your decision to incur significant legal fees and again, have your fiancée focus for now on any other ways she might be able to contact the biological father.

    The green card nakes her a legal permanent resident of the USA. That means that she resides here not the PI. She can travel back & forth but must retain her residence here & not be seen as a actual resident of the PI. She must not stay outside the USA for extended periods of time or chance losing her G Card. That will be determined by the dates of entry in her passport.
    When she first enters the USA she has a certian legal status for a known period of time. The AOS ( adjustment of status ) is used to change that status to a more permanent status. The AOS process takes about one year not 3 to 4 months & not 2 years. That inital G Card will have a life of 2 years. She then applies for another card with a 10 year life which is the removal of conditions ( ROC ).
    If you havent filed for a K 1 you could consider going to the PI to marry & then file for a C R 1 spousal visa which allows her a green card upon entry. The wait for the C R 1 is not much longer than a K 1 anyway.
    However due to your retirement plan you should consider all the facts before you proceed. A green card is expensive & she will lose it fairly quickly if you dont change your planning.
    Only a U S citizen can have a U S passport.

    Even though people mean well with their advise you should begin by checking with the embassy in the P I to find out if they will even allow co sponsor in your case. They do not in most. It would be a shame to get to the intervew only to find they wont.

    # 1 The form clearly say it has been sent back to USCIS in the USA. At the bottom the form says the USC could contact the USCIS office in their area for info.
    What this means is for the USC to make an INFO PASS appointment to go see USCIS to discuss the situation. That is best way to understand what happened & what may be done. That should be done within about 4 weeks. She could try the phone but its better to go in person if possible.
    #2 Your wife can not call the Senator. She must use the Senators web site to make out a form to request help. The Senator has a staff member trained to placte the citizens.
    #3 A new application wont result in a different outcome. It isnt the paper work that is in error. It is the nature & quality of your relationship.
    #4 Letters sent will simply end up in the trash.
    #5 Your wife as the USC should be on this site. Posting, reading, replying to get first hand info that is clearly understood. You should read & discuss with her. I mean that with all respect to you. I know you are trying but this is deadly serious.

    The plain fact is that they arent that far out what is now the norm. They made a mistake which drew an RFE. That mistake cost them time. Now they get frustrated with the government & want to vomit. Many here on V J have waited 6 months. I have explained how the same mistake affect my case which still took a lot longer then the OPs. The OP should benefit from what I said.
    If the effort that it takes to emmigrate thru the legal process becomes too big a burden its easy for ANYONE to quit. Those of you that think Mexico is the place to be because they dont put people thru this horrible experiance should simply ask Mexico to allow you to live there. Just dont vomit while you are asking. Dont second guess your decision.

    Its true they dont have to be nice. They do have to restrain themselves. I some of what the officer said is simply offensive & wrong. I wouldnt waste time complaining to the people that trained them. Send a transcript of the conversation to every Chicano politician in the LA area. If it were one of them the people would be on TV waving the signs.
    Too bad you didnt tell the story teller you understood Cinderella but couldnt relate because she should know Algerians dont wear shoes. Dont let this go without responce because she will continue until stopped.

    First there's nothing that says you have to become a citizen so you have the freedom to not have to go thru the terrible experiance again. You could attempt to change the system & tell them to review your files & forward the citizenship documents to you.
    Or you could look at the citizenship test as a simple inconvience which you dont need to prepare for at all. You should be able to run thru the test in a few minutes with no problem. That small investment of your time would allow you to become what millions can only dream of. Only YOUTOO can decide what is important to YOUTOO.
    Most people have a profound respect for the privilage of becoming a citizen of this great nation. I know I do & already have more freedom than I ever had in my life.

    This is correct. BKK is not similar to any other country when it comes to this subject.
    In 3 recent cases the embassy required not only the signature but in 2 cases actually required the father to be present at the embassy for questioning.
    The embassy will provide a sample letter. They dont explain that they require the letter signed in both languages. In the 2 cases I know of they also never said in advance that the father needed to be present. In those case both mothers made some errors in the verbal explanation of the situation which caused the officer to question the intent of the very letter the embassy issued.
    This is a very difficult subject for people from other countries to understand. It involves a long history of Thai culture. It also demonstrates the extent Thai men will go to so they can avoid responsibility. What occured here is common in Thailand.
    He refuses to acknowedge the needs of the child because it is the only thing he can do to maitain some control over another human. Thai men must be seen as having the mind set of a child. Do not mistake their thinking for yours or that it involves a modicum of common sense.
    It may be a mistake to involve a lawyer. In Thailand these things are done by family members. This could turn into a very difficult situation if not approached in the right way. You will have to decide how much you are willing to pay. He will refuse the first offer. Prepare 3 offers & a strategy to make those offers. Use his family against him by makeing the offer thru them. They will want some of the money from him. They will try to force him to accept. He will lose face if he doesnt. This is their chance to make some money & they all know it.
    Keep in mind someone may have to ask him to travel to BKK. He will want the cost of that plus his loss of income & more to do it. You wont know if the embassy will require him to come until its too late. This means additional time & money to be spent. If the embassy refuses the letter someone will have to talk him into coming. If that happens the embassy will allow time & reschedual the interview.
    I know this all sounds impossible to believe but I assure you it isnt going to be easy. I helped with two cases in the recent past. I spent hours on the phone with the Thai to help them get thru what had to be done. There is much more to this than I can express here.
    The other options you speak of are even more difficult. They would be limited to simply leaving the kids in Thailand. A close friend had to leave one of her 3 due to exactly this. It has proven to be extremely difficult for her & the child. She now travels to Thailand often to visit her own kid. This affects her life in the USA, her work & her Thia family a great deal. I would not recommend leaving the kids for a thousand reasons.
    It is my hope that this child will be allowed to realise the same freedom we all have in this great country. To live his life here with both of you.

    Lets review. This women brings this man? to the USA to begin a new life based on mutual respect & love. She marries him. While she is out looking for a new house for them he takes a run to Florida to have a little Jamacian culture. That turned out to be another womem. I guess he changed pillows while working on a few new memories. He left his wife, his life, his responcibilities, his promises & his legal status.
    Your advice is to find a way in her heart to forgive. Just accept the idea & concept that this is acceptable. Get over it & lay her head down on that pillow & dream of the good old days. It is probably her fault anyway. I mean she could now try to do the AOS even though his actions caused him to be out of status. She could pay the fees. Of course she would have to save for new pillows & buy an extra one for the G F.
    He isnt a dog. I errored. He is a pig. He isnt her man either if you measure by your pillow standards.
