Maybe to prevent even more cases.........

Yeah I totally get this. Although it doesn't make sense for the UK to allow US visitors when their cases are worse, but they can't process or reissue k1s for us to go there. But us allowing US to come here means more possible infection here, increasing our cases and potentially meaning the US will lengthen the ban. I'm sure other countries are the same. A lot of contradiction and different rules everywhere.

But nothing we can do but wait and hope. 😧

  2. I'm wondering the same thing. Like others I've done numerous emails to different people, but get nowhere (including the embassy). And calling has been pointless since the embassy wont discuss anything visa related over the phone. It's heartbreaking. I can't participate in the lawsuit because I'm not in a financial position to do so. Everyone is in the same boat as far as not knowing what's going on, and it's frustrating so trust me, I feel your pain. I also haven't seen my partner in a year so I understand that pain too. I don't think the embassies even know what's going on- even though I think they should (at least by now). So I'd also appreciate any info, especially on expedited cases. I can't stand doing nothing! Contacting my local MP was a waste of time but even if it's futile, I rather try than do nothing. 😧

  3. Just letting you know that they updated this page today: https://uk.usembassy.gov/information-for-nonimmigrant-visa-applicants-following-the-coronavirus-covid-19-outbreak/
Unfortunately it still says : We are only able to process visas for spouses and minor children of U.S. citizens (IR-1, CR-1, IR-2 or CR-2). We are not currently able to issue or reissue any fiancé(e) (K-1) visas. This is why it is not possible for you to proceed with your visa application at this time.

So sadly nothing new for k1s. Only part that seems new is the following:

[NEW] I have heard that interview waiver is possible in certain cases. Is it possible in my case?

At this time, Embassy London can accept interview waiver applications for individuals who will be traveling in an official capacity and applying for one of the following visa categories: A-1, A-2, C-2, C-3, G-1, G-2, G-3, G-4, NATO-01, NATO-04, NATO-05, or NATO-06.

Due to the Presidential Proclamations that remain in effect, other visa categories are not eligible for interview waiver through Embassy London’s interview waiver program at this time.

Expect to get a new medical exam if older than 7 months.

Yeah I figured this would be a thing. But tbh it seems silly. We should have to do a covid test and that's it. Someone I spoke to had their medical done (their visa expired too), and a covid test was OPTIONAL. Like, really?  smh. Anyhow, I don't want to have mine done just yet until I know what's going on with my visa. I don't want to risk getting a second medical, just for that one to expire all over again. I don't have the finances for a third time. Even a second one is going to be a challenge.

Reminder that UK and Ireland proclamation happened before the Labor Proclamations. Because of the UK and Ireland proclamation you would have needed to go to unrestricted country for 14 days prior to attempting US entry:

Yes, by the time we found out about spending 14 days elsewhere before US entry, it would have eaten into my expiry date and expired during the 14 days elsewhere. And even if we were able to find out before, this option wasn't financially feasible for us anyway.

I am blessed in that regard....I manage to fly down every 3-4 weeks and spend a few days at "home" with her.  Sometimes I need to remind myself how fortunate I am to be able to see her.

That is amazing! How lucky! It's been nearly 1 year since I've seen my partner. We were suppose to see each other in March this year but y'know, travel restrictions. I HAD a valid k1 visa. That expired. And yes, I know k1s were exempt from the first ban, but the Embassy didn't actually inform me (and others) of this until it was way too late.  We were so close... 😧

  7. At which point in the process are K1s considered an immigration visa? I know they're non-immigrant with INTENT to immigrate, but I also read that there's a point it's considered immigrant. I'm wondering if this extension would apply to me. I had a valid visa but was unable to travel due to the bans. My visa has now expired, as has my medical.

Apologies in advance if this is already answered elsewhere.

I have read and signed it. And the question was in regards to the petition- was looking for clarification.

The same is true for all immigrant visas, not just K-1's -- they can be re-issued, not extended. A re-issued visa still has to meet requirements of the immigrant visa Iaws.

Before an immigrant visa can be issued  there must be evidence that the individual is eligible under all grounds included in the law, e.g. financial, criminal, medical, etc.  Medical conditions other than CV-19 may have changed during the 6+ months since the medical was done/visa was issued, so need to be re-evaluated through a new medical, not just a CV-19 test.  The only way to ensure eligibility is with a valid medical report.  IMO, a petition that would, essentially, make the medical process less stringent is unlike to result in even a temporary change to immigrant visa law -- especially since the reason for the worldwide crisis was medically based.

I'm sorry your fiancee can't visit -- I'm sure it must be really frustrating to be so close to being together and have it all fall apart.  Hopefully, travel bans will clear before July and you will be able to use your exissting visa.

Yeah that's true. Thank you for your response. :)

  10. Hi everyone.

My US fiancé was supposed to visit me in the UK and stay for 13 days. We were going to leave together for the US on the 31st March. Now that isn’t happening...  My k1 visa expires in early July (I got approved in February). I’m aware there are many others in a similar situation, and many that are probably in worse situations.

As many of you probably have figured out, there isn’t any official information for those who hold k1 visas and haven’t yet immigrated to the states (due to the travel ban). Or even what happens with those who are going through the process and how it will affect them. So far from responses I’ve received from trying to contact the embassy and other emails I hoped would be useful, it looks as though the k1 visas cannot be extended (even in light of the virus). Once they expire, it seems you have to get one re-issued. I don’t know about anyone else, but this is ridiculously unfair. Another medical to test for corona? Sure. But anything else? Nope.

Like many, I’m waiting it out to see what happens. But let’s assume the travel ban goes beyond people’s visa expiry dates. I wanted to know who would want to petition against this to try and see if we can get something done about it. It’s a long shot and probably a waste of time. I have no idea how I’ll go about a petition, and think it's probably too soon to do so, but just wanted to see who would want to be a part of it.

I know there’s a lot of other more important things going on right now. I’m not posting this to intentionally insult the current crisis or anything.

    Stay safe & well,

    Ash~

My fiance is from the UK and we’re in the process for waiting for the noa2, which was supposed to have arrived any day now according to processing times. I started a really good new job literally two weeks ago, I was earning well above required, he was going to be here in 1 to 2 months.

Then the Coronavirus hit and I got hit with the “last in first out” policy, while my company lies to me about trying to save money. They’re still getting catered food and beer, extra healthcare help, personal uber/lyft rides to work, and telework approved.

A week ago I could prove I have a job and support us both, we were looking at apartments, our life was going to start out amazing. Then all of this happens. How am I supposed to cope with all this when I don’t even know when next I can see the love of my life, much less hug him.

People in isolation all over the world stuck with their partners in the same house, able to work from home, they’re all complaining. Meanwhile us K1 beneficiaries and petitioners have to have our fiances be stuck in another country, and have to watch them get sick while we can’t do a thing. Life feels really ###### unfair.

I’m so sorry if this isn’t the appropriate forum, I just didn’t know anywhere else that would understand. Everything feels so horrible, I just want to go back to 2 weeks ago.

I feel you. My US finace was supposed to be with me today in the UK. We were going to leave for the US on the 31st March. Now that aint happening... 😕   My visa expires in early July (I got approved in February). Some people have even earlier expiry dates it seems. I hope we get extensions and the ban is lifted soon..

can the visa be extended?  we're supposed to go from Australia in June, but right now no airlines are flying out of Australia, they're all grounded! STUCK!

No, from the email I posted, they can't be extended. I hope they reconsider but their email wasn't very hopeful.

I wonder if enough people petitioned, would they make arrangements for people who already have the visa but haven't been able to leave for the US yet? My visa expires early July and I'm becoming doubtful that the UK>US ban will be lifted by then given how long it's taken with China only recently reporting not having any new cases.
