    I got good news which is a bit ironic since we just spoke about it. My status of the I-485 just switched to Ready to be scheduled for an Interview. 🙈 And thankies, I really appreciate your kind words! Hopefully you’ll get yours soon too. 💗

    That makes your case even weirder then. 
    Most of the time, people don't get their EAD's until the case switches to "ready to schedule interview" meaning that they don't need no more evidence from you on regards to you I-485 and that you are good to go "work wise" I suppose. 
    Regardless, consider yourself very very fortunate, many (including myself) are dying to work an a RFIE is like stepping on a nail for our journeys. Super congrats ❤️

    Just updated our timeline and thought of dropping an update in here too. I got my EAD combo card in the mail yesterday, 02/01/20. Super happy about it since this makes the waiting for the GC much easier, imo! No movement on my I-485, still stuck on the RFE response which we sent in 25 days ago. We’re in Houston, TX.

    I am so bored out of my damn mind! 
    I've been here since August of last year and while it was fine the first couple of months I'm actually losing my mind over this, at first I was like: 
    "Oh yeah, prolonged vacation! Able to do and learn so much! I can finally work on all the projects I've been meaning to do for the last years! I have all these cool ideas and inspirations that I can put into work!" and more but, not having a job is killing my, for a lack of a better word, "vibe" 
    It's as if for me to be able to function properly I need to be able to serve a higher cause, and that includes slaving myself away towards the government lol.  
    Don't get me wrong, I'm not actually "bored" I know I have and can do a TON of stuff but not having a job just simply kills everything, my creativity, my inspiration, my ideas, etc. 
    I really would do anything to get back the freedom and things I used to have back home, being able to transport myself wherever I wanted, have a job, earn money, studying, my friends, my family, stores even, just, everything...
    I know it was a trade off when we decided to venture into this, sacrificing my entire life just for the person I love but this just feels like torture by now. 
     
    All in all, the things we do for love.

    USCIS requested the long form of the birth certificate. 
     
    RFIE updated on the system on December 27th 
     
    RFIE received on the mail on Janaury 2nd. 
     
    Response to the RFIE sent back on January 7th. 
     
    USCIS update on the system about RFIE received on the system on January 9th. 
     
    Case is ready for an interview on January 24th (updated on the system). 
     
    Interview has been scheduled on Jnaury 24th (updated on the system).

    Wow we have exactly the same timeline! 
    I can't help but be both extremely happy and jealous for you haha, then again, you didn't receive a RFE so that probably helped out your whole case overall but mad congrats regardless! 
     
    Your lucky you even got a denial letter for your SSN, we didn't got sh** lol. 
    You shouldn't have no more SSN issues after you get your EAD, most people get their SSN (if they asked for one on their application) a week or so after they get their EAD or the same day they get their EAD

    Oh my goodness no way! That's very very exciting, specially considering your timeline! You're the latest October filer I've seen so far to get their EAD! Major congrats !!

    Soooo something happened which is a little bit exciting to me! 🙈
     
    My I-765 Status just changed time “New Card is being produced”, while my I-485 has not changed. Still says that our RFE response has been received. My I-131 is still at “Case was received”.
     
    Was curious if that’s normal or someone experienced something similar? I don’t wanna get too excited about it, can’t help myself to worry about things especially after a RFE. 😅

    Yep, as the others said Jan 1 starts a new tax year but it will be easier because your residence and earnings will all be US. Thank you for the nice comments.

    Aaand only few hours afterwards I got "Interview was Scheduled". My case went from "RFIE received" by uscis on Dec 28 to "Interview was Scheduled" in less than 3 weeks.
    I'm sure that it depends a lot by the local office each case is assigned to, but it's seems like our cases (fall 2019) started moving really quickly.
    I really hope you all receive news as soon as possible!!

    Hello everyone! I just received the update “Case is ready to be scheduled for an interview” after receiving a RFIE on Dec 10 for my birth certificate. They received the response on Dec 28, so it took less then 3 weeks for Uscis to review and approve the case. I wish for all of you out there who got RFEs a quick resolution of this inconvenience and that you can get quickly your ead or interviews!

    Income is reported based the previous Jan through December .  So income earned this year will be reported next year (2021)

    This answer is for the average K1 couple with moderate income. It is not for super rich immigrants who earned six figure salaries, hold many foreign investments, property, own foreign companies, etc. It is  just a simplified description that will fit most of the VJ K1 crowd. And it is specifically written to oflyingbunnyo who asked the question, but others may benefit too.
     
    The pdf call Publication 519 is about the IRS rules (tax laws). It doesn’t matter if you file online or fill out a paper form and mail it, the rules are still the rules. 
     
    So to cut through the first 8 pages, because I know you are a K1 arriving in August. You have no SSN, haven’t worked in the US, AND don’t have a Greencard. You don’t by any of that have a claim to be a resident alien yet. BUT as the spouse of a US citizen you can choose to be treated like a resident alien for tax purposes. You get to follow the same rules as citizens, Greencard holders, etc. if you and your spouse choose to do so. The reasons for choosing to be a resident alien for tax purposes.:
    Nonresident aliens pay higher tax rates on their US employment Nonresident aliens can not file jointly with anybody Nonresident aliens use a different form 1040NR So basically that’s what the first 8 pages are helping decide. There are people here not married to US Citizens, who work, and file as NRs. New K1s married to US citizens get the perk of choosing to be a resident alien, so you can skip anything referring to a NR in the rest of that Publication 519. (Already we have eliminated a bunch of gibberish.) page 9 tells about Nonresident Spouse Treated as a Resident. 

    If you have read this thread, you should know already that the American married to a K1 has mainly two choices for filing status:
    Married Filing Separately (Only his/her income reported. The K1 who has no US income files nothing. Nobody has to choose to be a Resident Alien) Married Filing Jointly (Must write a statement choosing to be treated as resident. Must report both spouses’ income, foreign and US. Probably going to be the cheaper way to go because foreign earned income can be excluded on tax form 2555 by those whose home country has a Tax Treaty with the US.) Unfortunately for you, Costa Rica has no tax treaty with the US. So you will not benefit at all by filing jointly because you would not qualify to exclude your Foreign Earned Income.  Your spouse probably should file Married Filing Separately. You have no US income so you have no requirement to file for 2019 tax year at all. Next year, you will have a job and some US income and you will file jointly with your spouse. As far as I can tell, you are off the hook for taxes so can quit worrying about it.

    Wow! All these recent EAD approvals I think make me and everyone else super excited! (granted, can't be too excited as people like us who received a RFE will probably see a longer wait 😅) but regardless it's good to know that things are moving along and everyone's turn will eventually come along sooner rather than later !

    @Moana&medo was just asking a valid question like everyone else does here like you said. Most of us want to find a job as soon as we can due to some financial challenges we face. However correct me if I am wrong,  it seems you are annoyed and impatient with your answer. If you feel that way, feel free to ignore such questions. 
     
    Again like you said, this is a platform where we help each other. We may not have all the answers that we are looking for here but hearing advice and encouragement is much more welcome.
