    Regardless of what you choose, your income from the Philippines is excludable under “bonafide residence” test.  The exclusion is prorated for days outside the US -360 + 364 (days outside the US + 34).  Your taxes can be filled out and ready to file as soon as your and your petitioner’s income documentation is in.

  2. Hi guys.. I ( non-US resident, spouse of a USC) arrived in the US last Sept 2019 and we got married last Nov 2019.

     

    1. I was working in the PHILIPPINES until August 30, 2019 ( in my home country, income taxes were automatically withheld)

    2. No SSN yet ( screwed up with the SS Office, long story )

    3. AOS ( filed last Dec 2019, biometrics on Jan 8, 2020 )

    4. Not sure if I will get my EAD and SSN before April 2020, in time for the tax filing of my USC hubby

    5. Obviously unemployed since Sept 2019 😂😂😂

    6. want to get this right since it can be an added evidence if and when we do our AOS interview 😊

     

    **** Question: do we have to file taxes as MFJ or MFS, taking into consideration that I don’t have my SSN yet. What are the forms that we need to submit ?

  3. I feel you guys.. had the same situation last year and the first 3 quarters of this year. My husband ( then fiancé when he visited me ) went to my home country in May 2018, and we didn’t see each other again until I came here in the US last Sept 2019 through my K1 visa. That’s a solid 16 months of being physically apart. I would have gladly given up everything if I could have visited him, but alas, my tourist visa was denied, and he couldn’t visit me again because of his job.. so we had to endure 16 months of separation. We talked as much as we can every single day ( during our breaks from work which is also difficult cause we had different time zones), emailed each other, took photos of each other and send to one another, share what we were doing on a given time, what we had for breakfast, lunch and dinner, what movie we were seeing, etc etc. All the things that a “normal” couple would do because at that point , that was the only thing that we can do. You will get through this.. when you really love someone, no distance can stop you from growing closer together. Cliche I know, but it’s true.. the reward is so great: to be with him permanently. You can get through this. Keep busy, keep communicating as much as you can. Before you know it, June will be here.. good luck on your journey! 😊

    • NOA1 to NOA2 (application approved): 104 days at CSC, 148 days at VSC, 101 days at TSC
    • NOA2 to NVC receive: 28 days
    • NVC processing time: 20 days
    • NVC transferring application to consulate: 5 days
    • Consulate processing time: 69 days

     

    This gives an overall processing time (from the day the I-129F is filed through to interview being available at the consulate) of 235 days via CSC, 277 via VSC, and 231 days via TSC.

     

    This gives me the impression that if I were to file I-129F today, on average I could expect to receive a final interview at a local consulate between 231 and 277 days (so around 7.5 to 9 months) later, is that correct?

     

    I'm struggling a little with matching this data with other sources I've found online. It's close to what I've found at citizenpath.com and immi-usa.com (two of the first hits when I Google "K-1 visa processing time"), but the official processing time from https://egov.uscis.gov/processing-times/ just for the I-129F is 5-7 months at CSC , and 14-18 months (!) at VSC -- and that same site doesn't seem to give a number for K-1 processing times at TSC.

     

    Is my interpretation of the processing time listed on this site correct? Why does it seem to differ so much from the official government data? And is there an easy answer to the question " on average when can I expect to receive a K-1 visa if I apply today", or is it more complicated than that?

     

     

    “ It’s more complicated than that “ is right .. there are things like RFE’s ( request for further evidence ), and other service centers are busier than the others, etc. Then there’s the matter of medical exams..

    As I understand, she can make the letter, sign it, scan it, then email it to you.. peeps here say that wet signature is not a must for the letter of intent to marry😊 best of luck on your journey!

    I am not sure if this A# is referencing an alien number (My wife (previously fiancee) does not have one at this time as far as I know) or does it reference the Admission record number on the I94?

    Hi.. you can check her A number on your NOA2 from the K1 Petition ( Notice of Approval , beside the “ beneficiary” portion ) 😊

    Based on majority’s advise, if you choose to send tax returns ( as opposed to tax transcripts), you will need W2’s, 1099’s etc.. the consensus is that tax transcripts are the best option..we just sent our own packet yesterday so I cannot share our own experience yet...

    I underwent that same procedure at SLEC. There would be TB smear ( 3 days after the 3rd day of sputum test ), and then TB culture ( 8 weeks after that ). Most of the info is correct: pray that you would not get any call on that 8-week waiting period, otherwise your fiancée has to go to a 6-month DOT ( directly observed therapy ) and take her medication every single day at SLEC, in the presence of the health care professional. As I understand, it’s free. I know it’s frustrating, me and my then-fiancé ( now husband ) prayed everyday that we do not get that dreaded call. After 8 weeks and she’s clear, you can go right ahead and schedule your embassy interview. As daunting as it may be, TB is a killer, so we appreciate the fact that SLEC is doing its job in screening immigrants really well. You will get through this. Good luck on your journey 😊

    hi there.. most of us did it by ourselves, with a ton of help from this great forum.  Just follow their ( the masters I call them :) ) instructions and tips and you will be more than okay... good luck on your journey!

  11. Hi guys.. due to my procrastination ( yep, my bad ), I applied for an SSN last week ( I-94 expires Dec 8 ) and of course I got their “ manual verification “ letter .. my questions are:

     

    1. on my AED form page 2 Part 2 question 14 ( do you want SSA to issue you a Social Security card? ) I am leaning towards a No since I already applied for one, although I know it will be rejected due to a nearly expired I-94.

     

    2. If I do choose No, should I include the manual verification letter that SSA gave me? Would it have any impact at all?

     

    3. if I choose Yes, would it mess up my initial application ?

     

    appreciate your thoughts guys thanks.. and yeah, I’ve already beaten myself up for not applying SSN at least a month before I-94 expiration 😒😞

    If they are available, yes.. better to be safe than sorry.. and all the pay stubs too, preferably the last 6 months. Some even bring Certificate of Employment and Compensations. The rule of thumb is to be ready with the docs IF and WHEN they ask for them. If they don’t, then good. If they do, and you don’t have them with you...
