Can you post a link to this guidance?

    Thanx - Kineo

Scroll down is a re-parole section. The problem is, normally this is for parole issued by USCIS. In this case of those stuck in this gap, CBP issued it.

Maybe between the letter posted above and my call with CBP saying “all Ukrainians are referring to USCIS”, maybe provisions are being made for USCIS to handle reparole.

That letter makes is sound like “we are aware of the problem, working in solution, and will let you know”

    I hope….

I  would not like to say how to do it, there may be a special procedure just like U4U.

Extending TPS by a few days may help a few but does not address the 100,000? who arrived after, or the 30,000 a month under the new Parole programme.

But those people are all getting 2 years of parole right? For .gov that’s next years problem😂. And from what I see about TPS, extension wil happen for those on it.

It’s just a gap of people admitted between 4/11 and 4/25 who are stuck.

USCIS, yes. I don't see the process is in place yet. I still would not expect a fee for U4U.

But this I don't think would apply to the TPS. TPS would be a different process from my understanding.

I have found guidance where you just file a standard HP package (131 & 134) and mark your folder re-parole.

I haven’t been in this thread, and I guess I specifically posted here wondering about the U4U option. Has people been approved after coming here on U4U but leaving? (So they can come back)

U4U is obvious, but likely to take longer now so no way of knowing how long she would be gone, and it gives her another 2 years.

Being petitioned by her daughter I assume is out.

Can you apply for HP inside the US? I did not think so.

Asylum, now there have been people waiting 6 years plus but I get the impression they are letting those hang and concentrating on more recent applications. My question on this is how you would frame it, if you were from the occupied areas I can see that but not from Ukraine itself. Well unless you are a Putin supporter.

My wife just told me she read on instagram someone in a similar situation left and U4U was denied. I guess because they had parole and abandoned it?

My wife just got her 10 year a few months ago, so she can’t apply for naturalization till next fall, so that path is out. Plus not looking for a permanent way to stay, that’s why asylum doesn’t seem like a great option (also for the fact it would probably be denied like you said)

    What a bureaucratic disaster 🤦🏻‍♂️

This will be an interesting situation. From my understanding your first paragraph is completely correct.

As for U4U, technically it doesn't look like your MIL is technically eligible either. From USCIS:

It sounds like your MIL would technically have to leave the country for the duration of the application process. Sounds really crazy to me. In my opinion there has been no consideration my USCIS for this situation at this time.

    -Kineo

My estimate from numbers is probably 15k are in this situation, given port parole after the TPS date of 4/11, but before they stopped the process and changed it to U4U.

I am not familiar with U4U at all. How long are approvals taking?

Edit: my wife just said she read on Instagram someone did this then didn’t get approved U4U cause they had parole and left

  6. My MIL was given 1 year humanitarian parole at the Mexico border on 4/18/22. It is running out, and CBP is supposed to handle reparole since they issued originally, but they received guidance to refer all Ukrainian reparole to USCIS. TPS isn't an option as the deadline for that is 4/11/22 (presence in US).

Can MIL apply for U4U? She would have to leave the US and come back though right? Or could she maybe take the documents to a Port of Entry or Deferred Inspection Site (here in Ohio) to get stamped?

  7. Hey all, here is the situation. My MIL from Ukraine was admitted over the Mexico border on 1-year humanitarian parole on 4/18/22. The was given via CBP, what is known as Port Parole. I called the local CBP in late fall and they said they would handle reparole, to call back about 90 days out. I called back this week and they said they just received guidance to refer all Ukrainian reparoles to USCIS. The problem is, I'm not sure what program would work. She is wanting to only be here till the war is over, not get on a path to residency.

    Options:

Temporary Protected Status - This would be the easiest, but it's for Ukrainians who have been in the US since 4/11/22. She missed that by 1 week.

United for Ukraine - They specifically say this is for Ukrainians outside the US. I do know someone who was here on a tourist visa (6 month stay). They took a few days trip to Mexico, got U4U approved, then came back (2 year humanitarian parole).

I-131 - Apply for Humanitarian Parole with USCIS, although has long lead times and cost $$$

Apply for asylum - just to get her legal presence while adjudicated. Wouldn't actually want to complete the process

    ?????

CBP is squared away every time I have dealt with them, but USCIS is a bureaucratic nightmare. I tried calling to speak with someone but can't get past the auto prompts. I haven't had any luck getting consultation with local lawyers either, booked a month out.

Here is an article that I think explains why/what we were approved under so fast. Hopefully more of you recent filers will fall under the same!!

NOA was 8/16(ish), PR Card in hand today🥂

Congrats again. We sent our package in February of this year. We sent a lot of evidence, including 24 bank statements for all the years we've been married, same as the IRS tax returns, joint leases (previous), joint deeds, joint utility bills, etc. Seems like we almost sent too much evidence and now they are taking super long versus most recent cases.

I found this article from April of 2022

Looks like we fell into that and I'm assuming, unfortunately, for you that since you sent in 02/2022 that you fell outside this process.

Permanent Residence card was received in the mail today.

  11. I don't expect an email back before Friday because they are at end if business today, closed tmw and supposed closed Friday too. The thing that I don't like is nothing is showing a rescheduled appointment and even calling the embassy they don't know news they are canceling Friday interviews. And also the fact the day they say new interview is is full on traveldocs (I'm sure they can force schedule and interview) but without confirmation I just think is interview really next Friday now?

It makes sense for a long weekend, but the short notice is garbage. Lucky I wasn't in your shoes Tasty and travelled all the way out there for the interview only to have this stunt pulled.

  12. My fiancee just received a call from embassy saying that the consul will not be there on Friday, so her July 5 interview will be next Friday. She was in middle of Maidan so had terrible time trying to hear, and didn't think to ask follow up about appointment confirmation because of the shock. I call the embassy scheduling and they say all I show in my system is interview is still scheduled for July 5, for more information you need to email kyiviv@state.gov. She called back to the number that called her and got the same information. Ustraveldocs still shows a July 5 interview, and next Friday when they say her new interview is doesn't have any open spots. I send an email to Kyiviv, but they take 3 business days to respond so with the holiday that's next Tues of Wed.

All I can say is what the heck is this #######!!??!!

  13. I thought of you Tasty when I received this info but figured you would be having the original since you were going to be at the interview, but yes absolutely positive wet not required. The "checklist" does say original is required however, but I'm guessing this is old and not updated.

On the other hand, should we be worried we haven't received an email from the embassy yet? Our case left on 6/11 and arrived 6/14 and 6/17 updated to ready. We scheduled interview for July 5, this is three weeks after case arrived. Everybody else I am seeing got an email within a few days of case arriving. Should I call embassy to confirm interview?

    @Shiran

  14. Just went ahead and called the embassy for clarification on this. While their directions make it sound there are 2 confirmations to print, 1 for interview and 1 for delivery, they are both on the same confirmation to print. He said for other visa options it can be different.

Also, perhaps an answer to an even more ambiguous question...I did get confirmation that a wet signature is not required for the I134, at least at Kyiv. A copy is sufficient. I have seen this asked many times on here with no sure answer, and was wondering the same myself as I didn't want to DHL 8 sheets of paper for $120 if not needed.. I called the embassy on this and who I spoke with literally said "I don't know" and to email the IV section and ask.

  15. Thanks for the responses, and honestly every one make sense!! That's what makes it difficult choosing the correct option.

I guess strictly "legally" saying, if I fill out the form accurate as of 7/1 and date it as such, and something happens after that the form is accurate. If I fill out the form on 7/1 with how "I think" it will be on 7/5, I am actually filling it out inaccurate although I am trying to be honest and have full disclosure. I think I will make it as accurate as possible  as close to her interview as I can. If I close 2 days before her interview, there isn't going to be a way for the embassy to see or question this anyways as loan and titles take a few days to settle and be recorded anyways.

  16. As the title says, couldn't have timed this any better and my land purchase/construction loan will be closing on the same day or within 2 days of my fiancee having her interview. This makes some questions on the I-134, difficult to answer correctly in regards to cash on hand and property ownership. Do I just answer the question how they will be on the interview on 7/5, or do I answer accurate as of dating the I-134, say if I send to her on 7/1.

Ok, I did it.  I just pulled the trigger.  I found a halfway decent fare for a round trip to Kiev for the embassy interview.  I was thinking I had a better chance of looking hot in a bikini than I did scoring an earlier embassy interview so I have my flight locked in.  This means I ain't changin' even if something were to open up at the embassy.

This may bode well for the rest of you.  Now that I have locked myself into an airplane reservation, I think there's a pretty decent chance June and July appointments will start opening up like a Catholic in a confessional.  It's the story of my life.  So keep your eyes open but don't tell me about it if you're successful.  🙉🙉🙉

Please spare us the bikini pictures, we believe you🤣🤣

On the other hand, thank you for taking the dive for the rest of us and ensuring some openings in July now!!! In all seriousness, I'm not even really looking for an earlier interview. What we have booked with still work with the timeline we were hoping for marriage, and to stress out 3 times a day checking for an opening that probably never will come ain't worth it. If something falls in my lap we would of course take it, but I ain't really looking nor expecting.

Looks like we will both be getting our good news a day apart!!
