  8. If DCF is not accepted you would follow the IR1 process, he won't need a work visa with the IR1. He will be allowed to work as soon as he enters the US with either process. DCF is just faster and only allowed in special circumstances like yours.

  10. If you have a job offer that is starting soon. You can request DCF before you move back to NYC. It will be much faster as the IR1 spousal visa will take about 2 yrs give or take. So your best bet if you're moving soon for that job offer is to email Montreal and request DCF.

  12. The UK is one of the few countries where I have seen the Immigrant be able to self sponsor. How's the wife's savings? Any chance she can keep her job when she moves? If she can this would be a good way to go.

  15. Run from that lawyer, we have seen more than enough news reports of lawyers and scams they are pulling. Having you pay for someone to sign the I-864 is just not going to end well. I know you are trying to figure out SSDI? By the time the visa interview comes around you may have it already, but the issue is will it be enough to sponsor on your own? Do you have any close friends who you can ask?

  21. That is only for active duty. They will not be able to expedite the 12 months drug testing as that will only come up again at the medical and interview. It would still be faster to finish the K1.

  23. Sorry for the late reply, no resubmitting the I-129f it is not denied but on hold to give her a chance to pass the medical. She needs to complete the drug testing as requested and then do another medical. Then they will redo the interview with the new medical and clear of drugs. She cannot be using drugs. If she fails than no visa of any sort.
