I originally used my greencard extension (I think it was the stamp) when I started my current job. They never questioned my status, but it took them a bit to figure out how to put it in their system correctly. The biggest downside was that I needed to reverify my status when my extension expired. Luckily I had an unrestricted social security card by then.

First, yes, you can adjust but you will not be able to work (even a remote position) until you have an EAD or the greencard. You will also not be able to leave the country until you have an AP or a greencard. Second, I don't think K1 makes much sense if both of you are living in Ireland. If you decide against doing adjustment of status I would suggest getting married and filing CR1.

Since she is currently here, you can get married and adjust as long as that was not the initial plan when she came here. However, as you probably know whe will not be able to work for a while

From what you've stated you can file adjustment of status. Read the guides on here for the process. You are correct, overstay is forgiven for spouses of US citizens

You can look at my timeline. First roc filed November 2020, denied sometime between October 2021 and January 2022 (uscic doesn't seem to agree with itself there). Second roc filed January 2022, approved July 2024

You definitely should not call them your spouse. That implies that you are already married.

We had a "courthouse" wedding. (Our state doesn't do weddings at courthouses). It was small wedding with me and my husband, 2 witnesses, an officiant, and a friend taking photos. No one else. We had no problem getting AOS approved (not a K1 case though). We had a big wedding on our one year anniversary, but my greencard was already approved by then.

Thank you everyone for the answers. I think we're going to go ahead and apply. If we get approved before our trip that's great. If not, we'll at least have it for our next trip.

Keep in mind if you are still using your maiden name for your passport and tickets, but your GC is in your married name, then they will use your married name. They can't enter 2 names into the system for you. Thererore, your ticket/passport name won't match and you won't get TSA pre-check on your boarding pass. But you can use your GC for the global entry.
Thanks. I changed my passport to my married name 5 years ago. Interestingly I've had that issue with my middle name missing from my ticket before

Hello,
We (me: LPR, husband: US citizen) are planning on visiting my family over Christmas, and I was reading up on global entry. The official website states that they only recommend it for people who fly abroad 3 to 4 times a year. We're only planning on going abroad once this year, but I'm still thinking about getting it. I know it would be $200 but it would alleviate a lot of stress during travel. Would it be worth it?

No one here is going to advice you to do that because it would be fraud. You clearly have intentions to get married and adjust status. Coming back into the country on a non immigrant visa knowing you are about to apply for adjustment is a big no-no. Unfortunately it looks like your best option is to apply now, include I-131, and hope that at least that part will be approved by the time your trip comes around. And if not, you'll have to cancel or reschedule.

And as mentioned above, she needs to be upfront about everything. Answer yes to overstaying, and yes to working illegally. Both will be forgiven.

Just checked my mail while at work and saw an envelope from uscis waiting for me. So I immediately checked myuscis, kinda scared since the last time I got a random letter from uscis it was the denial of my first I751. I thought it might be an interview or biometrics notice. Lo and behold, instead I see this.
So after almost 4 years, 1 denial, multiple nervous breakdowns and call to uscis that led to nowhere, 2 ADIT stamps, and not a single interview or biometrics appointment (I was sure they would need to redo them since my biometrics are from 2018!), I am finally DONE! Maybe one day Austria will change the law about dual citizenship and I'll apply for citizenship, but for now, I will gladly leave uscis in my rear view mirror.

A visa is for entering the US. You no longer need a visa because you are already here and are a permanent resident. Therefore, the correct choice is number 1. You no longer need a visa, because you adjusted status.
