  1. So long story short, she went in for the interview this morning In London. The woman said she passed the interview, but they didn’t have her medical yet. She took my fiancé’s passport and handed her a blue form saying has been refused under section 221(g) addition administrative prossessing. Is it only because her medica isn’t there yet? We are concerned :(

    Ah yes! Well it’s all good. Never stepped into a courtroom or police office for anything so I’m good :)

    About RFE's

     

    When you receive an RFE (Request For Evidence) the best way to handle the RFE is to read it carefully. Do ONLY what it says. DON"T add tons and tons of unnecessary documents. It's not needed and will NOT help your case. The adjudicator has already made up their mind about your case and if you do what they ask then they are going to approve your case. Of course if something in your past is hanging up the approval, hence the RFE then what you return will answer the question(s) that the Adjudicator has.

     

    I'll give you an example. Recently a couple had filed a I-129f and they received an RFE because a question was not answered. The question was "have you ever been arrested" or something near that. Forgetting about a expunge case in his youth he thought he was being honest and said "no". Well the RFE was returned and the adjudicator denied the case because it answered the question "no" when he should have answered it "yes" because of the expunge case that he forgot about. So, he had to return back to his fiancé's country, marry her, and then return to process a visa for her under the I-130 which is a CR-1 visa (spousal visa).

     

    Also, sign your RFE where it ask and if it doesn't ask then sign the copy of the RFE that you will be returning. Sometimes they ask and sometimes they don't. We had a case here not too long ago where someone forgot to sign the RFE when requested and BINGO.... Denied! So sign even if it doesn't ask for it.

    Did you register your email with NVC?

    Once you receive your NOA2 approval then contact NVC via https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/ask-nvc.html to update your email address as well as your beneficiary's email address. This will give you an email alert when your file arrives at NVC, your case is assigned and when the file leaves for your Embassy.

    Thank you for the advice! I signed on the bottom, it did ask me to sign, print my name, and the date, which I did. I also attached a cover letter which someone suggested stating that I signed it and answer the question, I signed that letter and dated it as well to double make sure that everything was going to be OK. I think it all goes smooth from this point on :)! Thank you for all the help you provide on this forum.

    That's great! That's actually all I had missed as well when I received my RFE. My lawyer told me that he thinks a lot of times it unchecks itself and doesn't print out correctly. For some reason that specific box has done that on many people's application. Which is super frustrating. However, I am glad like you, to have that be literally the only issue they had with everything. Meaning we are in the clear for everything else for now. And hopefully soon I hear back from the USCIS that it is approved, get the NOA2 and can move on. Hope things go quickly for you too!

     

    Yeah I was going to say, I don’t think I missed that, then I went and checked the PDF and I did check it but it didn’t print out. It would probably be good to pin that to the top of the form to let people know that it might not print that out so that way it doesn’t happen to them. So excited though! Glad that you’re on the same track as me! Good luck to you too!

    Wow.  That’s crazy. How long do these request for evidence take? When I originally filed we were holding my fiancé would be able to come home for Christmas to meet my family. It looks like at this point I won’t even be done before Christmas because they’re saying it could take upwards of 90 days. I really don’t know what to do here, there’s really no approach that works I guess. Even if they approve it at this point, at best and 15 days if I’m lucky, it looks like it’ll take upwards of 4 to 8 weeks to ship to the national Visa Center, and then another four weeks to get to London, plus the two weeks for the interview time and a medical.

  6.  Well I guess news but not good news. 

     

     I called in today to get an update and apparently they sent a request for evidence on the 27th Of September. I don’t know why, I sent over 40 photos of us together and letters, etc. so I guess I’ll have to find out. Really really bummed out and feeling hopeless right now. Not even a clue except that I put “Okcupid.com” and the guy was like “MARRIAGE BROKERAGE SITE!!!” Even though a 30 second google search proves this wrong. MAN! Sigh.

I did mention it was a mobile dating app but I've read mixed RFE results of people who met through dating apps. 

    #######. I just realized I put Okcupid.com as my meeting place. I did describe we met in person at in n out but now i'm freaked they are going to just flag my case and say "IMB" sigh, this whole thing has been terrible from the start.

    Yeah true. A part of me hopes that she didn't purposely flag me or anything to make my case take more time :( It was really hard to be polite through that whole exchange. Oh well! glad at least march peeps are getting approved :) March 9th is not too far away.

     Just an update.  The second woman I got on tier 2 was really hostile and mean. She was basically yelling at me telling me my case was in normal processing time.  I was being very polite and cordial and thanked her for her time anyway so that way I don’t get in trouble or anything. But a very terrible experience altogether. She refused to tell me anything, and when I asked if somebody had looked at the case she told me  “We’ve received it and that’s it. Anything else ?” Yikes. Felt like being at the principles office when your 13 years old.

    Tier 2 will likely tell you there there has been no action taken on your case, as it is still too early.  I called before our approval and the Tier 2 was very kind and simply said "everything looks good, there are no problems that I can see."

     Oh OK! I was worried for a second that they would get mad or something that I was calling since it wasn’t out of the timeframe yet . But hey! Gotta try something haha. Thanks for the reply :)

  11. Hey guys,

     

    So this morning I called since the site was down to ask about my case status. The woman said it was still pending but she was super friendly. I asked if there was anything I could do and she said "Well, I can transfer you to tier 2 if you want to" to which I replied "Heck yea!" so now im on a 191 minute wait time, but they said they would call me when my time was ready. I am sorta nervous though.. is tier 2 a bad thing? is there anything I should know?
