  1. I will need a lot of advise. I'm a green card holder. Been living in New York since April 2021, married to a US citizen and currently pregnant (due in October 2024).

My mother always wanting to visit me here and I think it's the right moment now. So not only she will be seeing the neighborhood I live in, but she will also see her very first grandAchild.

The thing is she can't speak english and will travel alone here. She is now 63 years old. She has a full-time job and a business since 1993, and she also own a property under her name.

    Now, the questions:

    1. I know the visa decision will be 100% will be in the interviewer's hand, but do you think her chance will be pretty high ?

    2. On the DS-160 form, who should pay her trip ? Because me and my husband for all her trip expenses. But yes, she also has her own money with her now.

    3. Also on the form and at the interview, should she mention that she'll be visiting me and her grandchild or just say vacation ?

Those are all the questions I could think about at this moment. I'm sure I will have a lot more along the way.

Depending on the state and employer, you may not even need to show Green Card. I changed job in California and all I had to submit was local driver's license and Social Security card with removed restrictions (e.g. no wording such as VALID FOR WORK ONLY WITH DHS AUTHORIZATION). No questions were asked about card, extenstions etc because this was good enough proof (SS card + ID).

That makes sense. It's gonna be depends on each company's policy. Thank you!

What @Crazy Cat is stating is that you are a GC holder.  You are a permanent resident.  You are not a temporary resident.  The expiry date on your GC does not cancel your permanent resident status - that can only happen if you voluntarily relinquish your residency or if an immigration court cancels it.  The extension letter you get from filing the I-751 is proof to show others, like your employer, if they ask.

December and January are 31 day months.   Therefore, the 90 day window begins on 11/05/23 for you.

Awesome! U even counted it for me. Thank you!!

Your status does not expire when the 2 year card does.  Your authority to work does not expire. Your extension letter will extend the expiration date of the card for 2 years.  The extension letter explains that.  Even if the extension letter expires, your status does not expire.  At that point, you can make an appointment at USCIS for an ADIT stamp.  But that is a long time from now.

You are a legal resident.  You do not need an EAD...

Thank you so much for your eye opening answers. Have a great weekend!

It is a legal document issued by USCIS.  If they refuse it, they need to be educated by you or your attorney.

    Gotcha

    1.  I would mail it when the window opens (not even one day before)... 90 days prior to the conditional card expiration.

    2.  Your Green Card is full authorization to work.  It superseded the EAD.

    3.  No.  See #2 above.

    4.  See #2 above.  You are fully authorized to work in the US as a Green Card holder.

Hi!! Thank you for answering. I know that GC could act as a full authorization to work. I was talking about when it's nearly expired and I won't get the renewal on time, what should I do to keep my job with an expired GC ?

  6. Hi everyone!

I know, I know.. I just got my GC this February 2022 and started to work on April 2022. But this is just who I am. Preparing everything loooong time before things happened.

I have couple of questions regarding ROC (I-751) :

    1. As I stated above, my GC was issued on Feb 2022 (02/03/2022), what date should I deliver my (I-751) package so USCIS will receive it on time, won't be too early nor too late ?

    2. I never get a combo card. Only GC (Even though I filed it together with my AOS). Do I have to quit my job at some point ?? :( because I think I won't be able to have my 10 years GC on hand on time. Before my 2 years expired (based on people's ROC timelines)

    3. Do I have to apply for I-765 ? Again because I never get that. Straight to GC only.

    4. Or is there such a thing like extension letter issued by USCIS so I will be able to show it to my employer to keep by job ? if so, will my employer accept it since it not the actual GC.

So far, that's all of the questions I could think about. I will bother you guys again if I have more questions.

Thank you soooo much in advance. I appreciate it. ❤️ ❤️ ❤️

  7. Hi everyone. Happy valentine!! Little update here. I received my GC last friday (02/11), my interview was on 02/03.

Interview was very relax. Questions were :

    1. When did u meet ?

    2. When and where ur wedding was ?

That was it. She asked for additional document. I gave her joint bank account, my health insurance, copy of flight tickets, copy of cards from the family, photos. But she didn't even look at it. She just clip it all together with the rest of my documents she already has.

Since the officer lives like 10 minutes away from us so we talked about restaurants around us. At the end of the interview she said "you're green card will be delivered within 1 or 2 weeks". But I got in in less than 2 weeks.

    Good.

The stamp is used when someone is already an LPR but does not have the physical card. That's why you need to inquire at the end of the interview -if approved-.

To add on that, the process implies being interviewed by an officer who will forward the case for review by a supervisor afterwards. Sometimes supervisors are the ones interviewing, so that can expedite the process. You can also request talking to a supervisor after the interview.

What I suggested is not a common practice but if you are in such a rush, you lose nothing requesting the stamp.

Thank you so much. You have a lot knowledge. That's so cool!

The immigration officer after my GC Interview said - I’ll have the GC in mail by one week.
my F.O was San Bernardino, CA

I’d just wait one week to get GC in Hand than do any further paperwork and complications

your employer is not willing to wait ?

What is any further paperwork that u meant ? Well.. they've been waiting for me for MY EAD card. But I didn't get anything till the employer called me again today. Then we agreed to wait for my interview result. She said "if you got approved on the spot, I see no problem for you to start working the very next day then". On that point, I kinda doubting if I could and if it's legal ? That's why I asked here and there. Some people said I can, but mostly said that I have to wait for the actual physical card. I'm confused, and of course I worried that I will lose the opportunity to work with them :(

Honestly, I don’t think we’ll be getting interviews until next summer… I think the status will change to interview ready to be scheduled at some point and it’ll stay like that for a while until it’ll say “interview has been scheduled” and we’ll get a date.

Yeah, I truly don't mind about the interview as long as I will get my EAD asap. Can't wait to work

  11. Hi Guys..

I just got my biometric done on 08/03. Around 10 minutes after it done, I tried to check my status and it's mentioning "Case is Actively Being Reviewed by USCIS" instead of "Fingerprint Was Taken" .

I read most of people got their case changed into "Fingerprint was taken".

Do you guys know why mine is different ? And what does it mean ?

    Thanks in advance
