He is doing multiple cases. For the Syrians, 7 out of 9 have visas now.  It was $5000 each. You can follow updates on the case here: https://curtismorrisonlaw.com/jamal-v-pompeo

Not true. What has been denied is the expedite discovery of documents related to the cases.

And Iran had 8 K1 fiance visas issued in July...which is not a whole lot but a big jump up from 0 or 1 a month which has been the case since the beginning of the travel ban

    Hello all,

Our lawyer filed a Writ of Mandamus lawsuit yesterday for a group of us that are trying to bring Syrian family to the US. If you want to follow what is happening, the lawyers website is updated promptly after a new filing or court decision is made.  Here's the link:  https://curtismorrisonlaw.com/jamal-v-pompeo

I know that it might seem like things are changing regarding getting waivers, but we decided to move forward anyways.

I think this means for those exceptions such as dual nationals, those with valid visas before the proclamation went into effect that were already in the US and such. There is a list of exceptions on state dept website under faqs about the presidential proclamation and all the exceptions are listed there

I got one update after senator Kamala did an inquiry late last month, and then 2 more random updates in early June. That's 3 in less than a month. Hope that's a good sign. 10.5 months in AP so far.

I agree that it is insane that the mere fact that all immigrant and non-immigrant visas in iran have been halted on grounds of national security and extreme vetting of terrorists,  with exception for student and exchange visitor F, M and J visas totally refutes their entire argument that they are banning people from these countries due to their lack of information sharing. How is it they can get sufficient info on students but not others? How is it students, some with no other ties to the US other than wanting to come here to obtain a degree, are less of a national security risk than a family member of a united states citizen with significant ties trying to be reunited with their family?
If they can sufficiently screen them and allow them entry within a few months, then those seeking waivers of the ban should not be stuck in AP for years.
I wonder why they havent made mention of this either in the case

Per an immigration lawyer's  advice, keep in contact about every 6 weeks and keep track of your interactions so if they later need to be used to defend your case, you can show you were in frequent contact with them about your case status and were in admin processing for a long time. Helpful if you want to file a writ of mandamus case after a year of AP or more

I actually think Salhasl has been the most logicaland accurate person when it comes spreading news about the travel ban. It is good to be optimistic, but it is very bad to give people false hopes. We all want to have our visas or spouse's visas be issued. My wife has been in AP for more than 7 months and there is still no indication when she will get it. So, I try to keep hopeful and optimistic that she will get it soon; but at the same time reality hurts! Numbers are posted monthly and they are not telling a lot of great news!

Anyways, I am still hopeful that things change in the near future!

I know there is a waiver template, but OP is already in AP, which means she already qualified for waiver consideration. Now they just have to do the full AP - which is what they are doing for everyone. If she hadnt qualified for waiver, they would have refused her and told her she did not qualify for waiver. But they cannot do that, because the proclamation makes an exception for Immediate relative, and I have read a cable from the embassy that says K1's are to be considered as IR's in the context of the PP.

Now, if she has a legitimate medical/exceptional condition that was not included in the original documents, then certainly she can submit this information, although I dont know of a mechanism that will get that to the geniuses at DOS in washington DC.  Moreover, in many cases the consular folks have simply refused to take waiver letters. When you think about it,  When the consular is saying I dont need your waiver letter, he is saying - I've already determined you meet the undue hardship/national interest criterion, so your letter is of no use. Now the DOS needs to determine you meet the Nat Sec criterion - and no waiver letter can do that. You could have the Pope sign the letter but they wont care. Which is why I am reasoning the DOS is vehemently saying we dont need you or your lawyers to write waiver letters. All of this is conjecture, based on my reading. No inside source.

The ONLY situation where a waiver letter is of any use, is if there is truly a pressing medical/exceptional situation, at least from what I have read so far. If not, just wait 1 year and file a writ. It will cost just about the same and atleast from what I have read, writs actually have a history of getting a result and you have the support of the US judiciary to get things moving. The govt picks and chooses its battles on writs, so only do it if you are certain both you and your spouse are clean as a whistle, and would not be in AP if it weren't for the proclamation. Like if your guy is a nuclear scientist with a name like Victor Frankenstein, dont file a writ. But if your girl is a elementary school teacher with a pink dress and a tiara, writ might work.

It's a common misunderstanding, but the K3 visa has been virtually obsolete and unavailable since February 1, 2010.  Now, if you file both petitions, USCIS simple administratively closes the file on the I-129F for spouse in favor of the I-130.  The visa "exists" technically, but is not a viable option.

So the travel ban case was heard before the Supreme Court on April 25, 2018. The final verdict comes out June 30, 2018.
The ban is for all immigrants and non-immigrant visas coming from those countries under the travel ban with a few exceptions for some countries. For example, Iran still can have a visa is issued for non-immigrant classes F, M, And J Which are for students and exchange visitors.
The best thing to do right now would be to write a letter to Supreme Court Justice Kennedy and Roberts  explaining exactly how the travel ban is affecting you and your family.  If either of these two justices decided To vote against this ban it will be overturned.  These two justices carry the swing vote.
According to the department of state I did not see any fiancée visa is being issued for the last 3 to 4 months since the last travel ban was upheld by the Supreme Court on December 8, 2017.
Please write a letter immediately to Justice Kennedy and Justice Roberts encouraging them to counter act the travel ban.. According to the State Department website people are already being interviewed for waivers and 400+ have been issued.  Many people are being denied waivers, including some terminally ill  children and grandparents. This travel ban is not about terrorism! 400+ waivers is not that many when you consider the thousands and thousands who have applied and spent time and money and energy on this already very long process
