    What do you guys think about using AP while waiting for an AOS interview? My case was approved mid January 2020, I got my c31 EAD but other than that nothing yet. My current AP expires in May. And my dad is dealing with cancer and going through chemotheraphy.  Idk if I should go see him before my AP expires. Even if I apply for a new AP I think it may be risky to leave the country after May. They may send me a notice or anything. And if everything goes well and I get my GC it won't be before the end of this year probably.

     

    I went to see my dad last December after he had his first surgery but I just feel bad not being able to support him during this time.

     

    What do you guys think? Is it safe to travel with an almost expired AP while waiting for an AOS interview? I'm thinking about a trip in early April since my current AP expires on 5/9/2010.

     

    @sandranj  @Stillwinning!!!😊 I'd really appreciate your thoughts about this...

    I just came back from my home country with my AP. Make sure that you come back before it expire in May. 

     

    Even if you apply for a new Advance Parole, you can only leave the country when you have the document in your hand.

    Praise be to God almighty !!!   I did my interview today and my card has been approved. Interview time was 12:pm. I  arrived at 11:40 but wasn't called until 12:33pm. I was out by 12:50pm.   The female officer apologized and led me in.

     

    Officer: How is your week going?

    Me: I guess its going well and yours?

    Officer: Can't complain. Did you do anything fun over the weekend?

    Me: Not at all. I was indoors for the most part. Same ol.

    Officer: Me too, I had laundry and cleaning to do. DO you have your medicals

    Me : Yes I do ( hands it over) . I also have a copy of my i864W

    Officer: Thank God. You are the first person with medicals today and I  have a copy of the i864w here(shes showed me in my file). Let me swear you in, pls stand...

    Officer: can I have your ID Pls.... 

    I gave her my ID.   after a while 

    Officer: Do you have your passport?

    Me: No , I don't.

    Officer: That's okay, I can pull up your details later. She returned my ID

     

    The officer then went on to ask for my full names,  my parent's names, my current address, my address in my home country and then the i485 "NO" questions.

     

    Officer: do you have anything to add?

    Me: I'd love to change my last name if thats okay

    Officer: Ofcourse,! Have you ever used the name before?

    Me: No

    Officer: Okay, Whats the name?

    I said my name and she did some writing.

    Officer: Any more question?

    Me None for now. 

    Officer: That"s it. I will review your file and you will get an update withing 24 hours.

    Me: sounds good.

     

    We stood up and walked out.

     

    On our way out...

     

    Officer: Do you still work at ....

    Me : Yes I do

    Officer: How do you like it

    Me: Not bad. I enjoy what I do.

    Officer: I can tell you like it there.  Have a good week.

    Me : You too

I haven't received any update on my I485 regarding transferring of my case to local office. I involved senator so lets see when I can receive a response. It shouldn't be any problem right if i travel abroad and come back as my I485 is still at vermont

    You should be fine. I am in Brazil right now with my AP document. I will post my experience when I come back later this month.

    Understood. They could still approve your green card based on the marriage interview that you had with her. But since you applied for VAWA now, make sure that USCIS don't deny you I485. Only travel if you're sure that it is still pending. If they deny you can always apply a new I485 with I765/I131 if your wife is a U.S citizen. Contact your congressman to make an inquiry and see what is the current status of your I485.

    I never thought that my wife was such a b***t and she will treat me like sh*t while we were married and now because of that I have to deal with psycologists because of the fear of the people, also deal with a process to try to convince immigration that in my marriage I was the good one and deal with a long waiting time which honestly is frustrating. I know there is no place for my complains and I know it was my choice to start this process but if I quit or if I leave all my ex-wife mistreatment will be in vain. I hope to have the strenght to move forward. At least it seems soon I can get the divorce and I can left that part of my life behind (Obviously my ex-wife is delaying the process because she wants to fu¨k me up in some way and she doesn´t want the divorce).

     

    I had already had the interview and it was horrible because the interviewers were rude and also because that day I went through an asthma attack (you can imagine why I had the attack ... wife threats). Anyway after 2 months of my interview I couldn't affort anymore the situation and my family, friends and everyone were concern so I left her and I applied for vawa on 11/13/2019, Uscis received my package on 11/15/2019 and they sent me a RFE on 12/24/2019 asking for the good moral character. They received my response on 12/31/2019 and I know this is just the begining of a long wait.

     

    I have some questions for the experts:

     

    - With my vawa I requested to move the I130 priority date and also my I485 to my I360.

     

    - Before my vawa I sent the EAD C09 renewal on 08/08/2019 and until now I haven't received any news or approval?. Its been almost 6 months and I'd like to know if it is normal this waiting time or maybe there could be a problem?.

     

    - Uscis receved my response on december 31st (one month ago), when should I expect the prima facia?.  

     

    - If I receive my EAD and advance parole renewal can I leave the country for a short time?.

    Did you go to your I485 interview with your ex wife? it's confusing because if you already did the marriage based interview, what was the result of that?

    No, the Head of Household status is designed for single persons with dependents, but in some cases, married persons can claim the Head of Household filing status. To qualify for the Head of Household filing status while married, you must:

    • File your taxes separately from your spouse
    • Pay more than half of the household expenses
    • Not have lived with your spouse for the last 6 months of the year
    • Provide the principle home of a qualifying dependent
    • Claim an exemption for your dependent

    If you meet all of these requirements, you may file as Head of Household while married.  But be careful because IRS can come back to you if you file head of household and don’t meet the requirements.

    If you are still legally married then you must file your taxes as "married filing separately"if you are divorced you must file as  "single."

     

    You started working 3 months ago, if you only have one W2 Form for 2019 it's a simple tax form so you can e-file using TurboTax for free.

    Contact your congrassman/woman and ask them to make an inquiry request for you. You can also make an inquiry writing directly to VSC. Once you have a VAWA case pending or approved, everythimg else goes to Vermont Service Center. You won't get any clear response from USCIS if you make the online inquiry.

    Send a copy of your Divorce decree to VSC with a cover letter and a copy of you I360 receipt requesting to attached it to your case. I did it, and they accepted. Send the police clearance too.

    Do not wait for RFE

    I Have renewed my EAD 4 times already... I used “No Lawful Status” in all of them. Never had any problems and received my card within 3-4 months. Non immigrant is also correct, but if you overstayed your visa and is currently  adjusting your status, technically there is no legal status...

    That is a long wait. I am also waiting for interview - (Queens Local Field Office).  Contact your congressman/woman to inquire about your case.

    When was your interview? usually they give you 30 days after place the I 485 on hold to show proof that you filed for VAWA.

    I know my case is strong but My concern is my wife was going to therapist office for her mental health. She told me that she has bipolar. She had a food stamp. Will this stattion affect my bona fide marriage?

    You have everything that you need to apply for VAWA. Organize all the documents and don't forget to get a police clearance from each place that you lived in the past 3 years. Your ex has nothing to do with your self petition, once you apply for it, don't matter what she says.

    Now, I'd like to use the same ap again before it expires in March but my attorney said that it's valid for one entry since it's stamped. 

    However, on the paper it says "Valid for multiple applications for parole into the United States" I doubt my attorney gave me the correct info.

    Then I forwarded my issue to my lawyer but haven't heard from him for a long time. I'm pretty sure I can travel with it again, but just wanna make sure.

    USCIS will stamp your copy. For subsequent times,  you can just show your copy and travel. As long as the document is valid.

    I understand. I am also travelling in February for 30 days with my Advance Parole Document.  My Field Office is Queens, so i don't expect an interview before that date. It's taking at least a year after VAWA Approved.
