    That is the reason why they did not accept it then. You must attacht a copy of the receipts. 

     

    I never had any problems. Always renew my EAD without pay the fees. Also i sent my AP Separate and did not have to pay any fees.

    We were called for interview 2 weeks ago based on my I-130/I-485. I must say that some IO are just totally clueless.

     

    She kept on asking me for my green card and I kept on telling her I'm yet to receive. She then went on to say my case is done already and she doesn't need to interview me, rather my daughter whom she said she still cant interview for now 🤨. She never even bothered to ask of my estranged husband.

     

    I asked for my I485 to be put on hold whilst awaiting adjudication of vawa. She literally said no she cant do that. I have a lawyer for my I130 but not I360 so he kept arguing with her that she can hold it. She didnt even want to take the receipt notice for my vawa and prima facie, saying that she does not have evidence of me filing for it in her file. The lawyer argued with her that she won't see it cos it's at vermont and they (vermont) will be requesting for my file from then instead.

     

    At some point she took the documents to photocopy, only for her to come back still saying she cant hold the I485. I started explaining to her what I thought the confusion might be in terms of needing not to interview me but my daughter and the green card she assumed that I'm already in posession of (remember they gave me 6 years on my driver's license some months back with no limited written on it which got me confused as well)...I thought she wasnt listening to me cos she didnt raise up her head she was busy flipping back and forth through the file so I asked if she was still with me

     

    Holly molly! That statement got her angry and she flipped at me saying I need to respect the office how dare I ask her that question 😏 my lawyer and I apologised and she said again she ain't holding the I485. I bursted out crying profusely 😥

     

    She later asked us to go wait outside as she need to consult with her supervisor.

     

    After a long wait she came back and said she will hold it and will interview my daughter when the vawa is adjudicated. 🤗

     

    ...good news it is but they've got our case all messed up

     

    I had a similar situation back in 2018 when i went to my marriage based interview. The Officer wanted to denie my I485 and after 30 minutes waiting for his supervisor, they came and apologize to me. He transfed my case to Vermont and the same day approved my pending renewal for EAD C09. Since that i am renewal my EAD C09 +AP and had my VAWA Approved on August 2019 and case is waiting for the interview with Queens Local Office, NY.

    They don't cancel the C09. I received my EAD C31 and the Approval letter first and I still received my C09 renewal after. Both cards are valid when i checked online E-Verify.

    The officer didnt ask any questions about the marriage.  

    The interview was about 10 min. My lawyer was next to me. 

    Officer said the she would review my case and i would hear from them.

    The officer gave me a letter stating that they wouldnt need anything else from me and for my suprise, soon i walked out of the Plaza building in Manhattan my status was updated to :

    New Card Is Being Produced

    On November 19, 2019, we ordered your new card for Receipt Number , and will mail it to the address you gave us. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

    Either one is correct.

     

    When i send my renewal for EAD i always write Attn: I-765 , for AP Attn: I-131 , for my I-360 i wrote VAWA Unit. 

     

    Best to send with USPS Priority mail envelope and select signature required.

     

    i always get signature from "Laura Zuchowski"

    So you have I-360 not I130.

     

    now you need to submit I485, I765 and I131. I believe that your spouse /Ex is a USC.

     

    The Prima facie is means you established the minimum requirements for VAWA and you can use that for public benefits. 

     

    But there is no EAD based on that.

    That's the standard response when your case is at the local office..I remember I got the same response when my file was transferred in June. But now they have given my senator a definite time frame. When where you approved again and when was your file transferred to the local office? You're in NYC right?

    VAWA approved Aug 13 2019

    Queens Field Office

    Not sure when they transfered it, they only comfirmed that the case is at the field office.

    No you can NOT use that. 

     

    File Form I-765 for renewal your current EAD. USCIS will send you a new receipt with a new case number and that can be used as the extension.

    As long as you come back before the expiration date,  CBP Officer should admit you in the US.
