  2. I know I messed up not checking my passport earlier but my German passport expired in June and I was wanting to travel to Germany to visit my family for Christmas.
I can get a new passport until then easily through the normal application but I was wondering if it would be possible to apply for it with my maiden name since you have to apply for a name change through marriage to get my new name on the passport.

All my American documents (ID, greencard etc) are with my new last name, will this be a problem during the application? I am ok with receiving a new passport with my maiden name.

Did anyone else go through this and can give me some advice?

    thank you

@Toastbear taxes is a big factor when deciding to naturalize in the US for sure.

    Few things to consider:

    - As LPR you're liable for taxes just like a US citizen.

    - You cannot simply move outside of the US and expect to stop being a taxpayer. Losing LPR status requires following a procedure

    - US has foreign earned income exclusion. If you were to make less than $120000 in 2023 living in Germany, you wouldn't have to pay taxes on that income.

    More here https://www.irs.gov/individuals/international-taxpayers/foreign-earned-income-exclusion

Wow I really thought I've read a lot in the past, but I did not know this either. I guess at this point it does not matter anymore once Germany allows dual citizenships.

Thank you so much for that insight.

As stated by another commenter, no worries, just take that extension letter and your green card with you whenever you travel overseas. When airlines ask for your green card expiration date, it’s simply your previous expiration date +2 years. I made my husband keep his extension letter in a plastic baggy to protect it while we were traveling in Europe this summer 🤣

And yeah citizenship is a personal thing, of course if your home country allows dual citizenships or you simply don’t care too much about your passport of birth, you should certainly go for it! My husband’s country is still trying to add dual citizenship to the constitution, but I’m hopeful they’ll allow it before the next green card renewal comes around 😅 Cheers, safe travels!

Yeah I am so glad I asked here because I was under the impression I had to get a stamp. Also thank you for the tip with the expiration date, because I feel like if you put an expired greencard, they gonna be like what? They almost didnt let me on the plane back when I flew in with my k1 visa, because I didnt have a return ticket.

And yeah I am still debating if I want to do it, the dual citizenship is one point, the other one is what happens if we move back to germany some time down the road. Because the US wants you to pay taxes even if you live overseas. Its such a weird concept to me, since Germany does not make me do that.

What password? Passport? You don't need it unless you're travelling when your extension letter expires. If you do needed, then you need to call USCIS 30 days before extension letter expires to schedule an Infopass appointment. You will get the I-551 stamp valid for a year then if you don't have 10 year green card.

    Reasons:

    1. Do not have to deal with USCIS again

    2. Do not have to pay increased fees for renewing Green Card

    3. Do not have to wait for few years to get card renewed. This may be improved in the future, but nowadays I-90 takes years

    4. Do not l have to worry about leaving US for 6+ months if needed, without abandoning LPR status

    5. Do not need to worry about some silly thing happening by mistake (arrest etc) that will make a permanent resident deportable.

    6. Germany is now liberalizing dual citizenship, see if you can keep it when becoming US citizen

im so sorry yes i meant passport! And oh wow I didnt know i could travel with the extension letter.

Thank you so much for your insights, I will have to look into that!

  6. Hey guys, just a question i am also a december 2021 filer, but I am planning on traveling to germany for christmas this year or maybe even before that. What are the steps for me? Like I know you can get a visa stamp in your password? But how do I do that, because I haven't seen anything where I could make an appointment in Norfolk with our Local office.

I only have the extension letter, my greencard is expired.

And since I am already typing, is there a reason a lot of you guys decided to do the N400? Because I was kinda hoping I can just refile my greencard stuff every 10 years, because I dont want to become a US Citizen. I know that might sound weird for some of you, but its not super easy to have dual citizenship and I would never want to give up my german citizenship.

Yeah, but part of that is on you, as the immigrant, to know what your status is.  The immigrant is in violation and in the US illegally if no steps have been taken to adjust status.  How many times do people post on the forums that they've come to the US and married the petitioner, they've filed for adjustment, they have their interview scheduled but their spouse isn't the person they thought they were and whether or not they can file with a divorce waiver? It's often.  But, those individuals are aware of their status and don't pretend that ignoring it will make it go away.

I realize it's TV, but I do get the impression that Natalie just wants everything done for her.  Honestly, what did she think was going to happen when she bailed to FL?  She's so preoccupied with marriage and children, as demonstrated by her comments when she told one of the other couples to get married and have kids.  Her expectation, despite having been married and divorced and now separated again, is still confusingly Disney.  Not sure how many failed relationships it takes to realize Disney is Disney - no relationship is as easy as TV and the movies make it out to be.

Oh yeah i 100% agree with you. My husband is the US Citizen and I basically did all the paperwork by myself and just told him what I needed from him, because he hates doing paperwork, and I am just better with documents and stuff. Even when we filed the K1, I basically put everything together while I was visiting in the US.  So I totally agree she should make sure her status is fine.

The only thing that raised my eyebrows was that she was under the impression it was filed. Its like he lied to her about it?

The real reason why I came back to this thread.

How is Natalie filming this show if she doesn't have work authorization?

Do we really believe Mike hasn't filed AOS or do you think he pulled the paperwork?

I just watched this and I am speechless. I personally get so much anxiety when I think about my status and making sure everything is fine.

Even if they have problems, but him not caring about her paperwork and she thinking it was filed.. I don't care about what's going on in-between them, but that is just straight up evil to me. You brought her here and you let her float now?

Informed Delivery says I'm getting a letter from USCIS (Potomac SC) today to tell me my previous biometrics are being reused and that I don't have to go in for an appointment. I already know this because the message is clearly visible under the address on the front of the letter. I would be more annoyed about their incompetence if I wasn't so grateful that I don't have to make future travel plans around a possible appointment!

Same here. Was being able to read it from informed delivery. Glad they reused my finger prints too haha

Sent my packet via USPS on December 20th.
USPS tracking shows as delivered on December 22nd.

USCIS Case Tracker says that it was received on December 22nd.

Checked my bank account this morning and it showed that the check has been cashed.

Funny enough I just got the text message with our casenumber. So that was me being worried for no reason as always haha.

Looks like its Potomac Service center, so I'm guessing no interview? :o

Makes sense, maybe I should have filed from the Norfolk VA office! When did you originally file? Looks like we have 4 update possibilities left based on what you have.

You dont get to decide where to file. Like I live in Virginia so they put me into the Norfolk office.

my NOA1 was May 20th. It would be good if you fill out your timeline, so people can help you easier!

Both websites have the same status at the moment for us. I don't know all of the appropriate status updates, but I assume it doesn't go from "Received Case" to "Interview Scheduled" as that would make it a fairly low value update mechanism lol.

Oh its because you didnt have both of the biometrics done. Once you did them, they will update your case too!

Mine went from: Received to something about my biometrics appointments, then Interview ready to be scheduled, Interview scheduled and now its "New card being produced".

  13. Hey just a heads up since I am from germany too. I did not include any proof in our AOS package except the marriage certificate. We didnt get an RFE and we have our interview tomorrow. So keep the evidence you have until you have the interview. Because they will ask "do you have any other proof than what you sent with the AOS" and that makes that proof kinda useless imo. So keep it :)

  14. Yeah as NikLR said, you really have to take the NOA1 with you in case there are any questions. Its the only proof you have after the I94 becomes invalid. Only thing I would suggest tho. If your NOA1 is in the new name and she doesnt have her passport or ID with the new name, I would take a copy of the marriage certificate or name change document with you (depending on your name change laws of your state).

    They are applications not petitions

You do not share common evidence.  That does not mean you replicate the entire i485 package for the other applications.

proof of marriage is not a requirement for either i765 or i131, otherwise what do single people do?

    Copy of 221g?

Did you know the ds3025 is not required?  The ds3025 is only acceptable IF it was marked complete AND was included in the "Do not open " envelope

I read somewhere that the 221g must be included if there’s one.

also my ds3025 is complete and I saw it as required from a lot of people.
