    Good Plan

Co-Sponsors have always been a case by case basis in Philippines, My mother was the co sponsor on her grandson about 20 years ago in Manila.  I did a K1 in 2008 in Manila and another one in 2014 in Manila.

Manila hasn't request I-134, tax records or pay stubs for over 3 years now on most K1.

Even some CO conducting interviews have told the interviewee that the I-134 was never ever really needed in the past.

i just searched your concern and i found that their acceptance is on a case by case basis.. meaning maybe they will. im sorry i gave you the information without being 100% sure, is the cr-1 route possible for you? i know that the cr-1 they 100% accept a joint sponsor.

i am doing the cr-1 but im pretty sure its the same for k-1 as long as the cosponser makes enough! i think so that you feel better you should search here on this site others doing/have done their k-1 with a co sponsor. this site is so useful. my husband isnt here yet but we are close to the end of the process and just waiting for the interview!

i cant really answer about what is going on with his taxes but, yes many people have been approved with a joint sponser. even if he didnt make enough, he and his mom will both do an affidavit of support and if mom is married the spouse will do an i-864a.

Immigration dependent and tax dependent are not defined the same way.  Be careful.

Rica Ross reacted to NigeriaorBust in How to know if they count as dependents?
If the child in the US is his and the child is under the age of legal independence or under and has not been legally emancipated he counts as fully dependent  a child that is over the age of adulthood and still living at home is partially dependent.

For the K1 interview at US Embassy in Manila.

Some people think it is a requirement for the interview, like a CENOMAR, etc.

The I-864 is needed once you do an Adjustment of status after entering the USA.

for any income requirement filling, yes that would count against him.  To qualify for the 100% or 125% of the poverty guideline it does matter

his daugther might count as dependent only if he is paying child support i believe.

Is this for the I-134 or I-864.

    I-134 isn't asked for in Manila for a K1

Last few months before year 2017 ends the k1 processing got slower . Before it only took 3-4 months to get your noa2. But, sadly right now you need to wait 5-6 months tho.

More than likely, unless he is from Africa, China or Hawaii, or Native American or some other area in the world.

Only you would know that answer.

    Hispanic is a generic term:

I would say people from Philippines are Hispanic and race Asian.

I would say people from USA who came form Mexico would be Hispanic and race would be White

OMG, that's insane! I think what the problem is, is the system is so bureaucratic and that doesn't work ( well, it might work to get those who are not willing to pay, but it affects other fathers like you who are paying ) when you are dealing with family matters.

The amount my husband is paying is about the same amount you pay for one kid. The place he was working at couple years ago laid off 25% of its workers and my husband was one of the 'lucky" ones. It was during the top of the financial crisis, hard to find a job and of top his father died. It ended up him not working for 6 months and bills don't stop. He got a different job and started paying his child support again but he still owed couple K, and all the other bills he had to pay. He had his three year evaluation and they were threatening him to take away his drivers license  ( by that time they already blocked him from renewing his passport). They were treating him like a piece of &%$#, like he was not willing to pay for his child. He explained that he didn't had a job for 6 months due to being laid off and loosing his father. The lady told him: not my problem, if you loose your job find another one. And if you don't start paying the child support you owe, we will take away your drivers license. He asked how he is gonna get to work then. And again she said it wasn't her problem.

That kind of lack of human factor and common sense pisses me off.  I know he would die for his child, he had to take his ex to court and spend thousands of dollars just to be able to see his child twice a month, which almost made him go bankrupt.

And here is this big bureaucratic money machine who wants to take away his drivers license to get him into more financial trouble.
In the end it all worked out fine, his ex and me are actually friends now, which is i personally believe is much better for children then all the bs about money.

OP, sorry i think i got swept away bit much. But to answer your question; from my own experience, it doesn't affect you if its AOS ( I haven't done K-1 so i don't know about that one). However it prevents him from traveling as long as he still owes back child support. And if you guys want to visit your country in the future so he can meet your family etc. you want that resolved ASAP.

    Good Luck!

Rica Ross reacted to Cyberfx1024 in Owing back child support could affect k1 petition?
This is the truth but unfortunately it does not happen. When my x signed up for food stamps even though I was sending her child support(she wasn't working at the time), they came after me for "official child support" because supposedly the checks I was sending her was not proof enough that I was sending her money according to social services. The Davidson County NC DSS came after me HARDCORE and even notified LA County CA(where I lived at the time) DSS about the child support issue to try to get it on their end. This was before even talking to me at all they went and did this. Ultimately I won because I got custody of our 2 children in 2013 and I still have them today. But NC was trying to make me pay $1100 a month for 2 kids all the while trying to survive in high COL Los Angeles on one salary. Once NC DSS ended their investigation with me bc I got custody, LA County was taking me court 3 times to pay child support FOR KIDS I HAD CUSTODY OF EVEN AFTER I SHOWED THEM THE CUSTODY AGREEMENT. I told them if I am called up here again for another meeting I will take the kids out of school to bring them up here and show you the kids that you are trying to make me pay child support for even though I have custody of them.

After everything was said and done I asked the NC DSS lady why sent after me so hard in the beginning without even talking to me yet. She flat out told me "I apologize for doing that but we deal with deadbeat parents so much that this is what we do before we speak to them. I see now that you are not one of them and I sincerely apologize".

point or not, this forum is to answer questions, not to judge someone who they don't know the history of. We all, or most of us, do not go into a relationship on a pre-judgment bias, if that were the case with everyone no one would be married.

thousands of couples get married after dating and their real part of the partner comes out, you then realize you made a mistake or you attempt to make it work and it just doesn't.  if something starts to go bad there are support groups places to turn for help.
