    Dual citizens are not banned, even if your birth place is currently on the banned list.  If your family member has a Canadian passport, they will use that to apply. 

     

    The dual citizen should probably expect a long time in administrative processing, though. 

  2. I'm not certain, but I believe only certain "officials" and their families from Venezuela are currently banned, and not regular citizens. 

     

    You can search on here and find the message board for Venezuela and gather more information there.

     

    You may also want to consider getting married and filing a spousal visa vs. the fiance visa as there are a few more benefits to that, especially if you are worried about encountering any issues due to where your fiance is from.

      On a different note- is anyone coming to the Congressional meeting next Tuesday about the ban. My sister and I are going. This is our chance to speak up and show that this ban is hurting real people. If you live near DC I hope you will join me.

    Since you're parent's case has been stuck in AP for 2+ years, I would definitely be contacting your state rep. - they may not be able to speed anything up, but they can sometimes get a slightly more detailed response than the average citizen would get.

    I would start with searching for a phone number or email contact for that specific embassy and attempting to get ahold of someone there who can give you more direction as to how they want to receive the medical/photos.

    I'll pipe in here too and add that my fiancé received the DS5535 as well.  He is a Christian, Norwegian citizen (although he lived as a child in a banned country for a time.)

    We've been stuck in AP because of this since September 2018 with virtually no updates unless we inquire on our own.

    I am glad to see people are successful in finally receiving their visa after being subjected to the DS5535 though :)

    If you still know the number of the expired passport, go ahead and fill it in - otherwise, you are not required to show them any old passports. Most people destroy old ones anyways.  What's important is your current passport.

    I would advise putting N/A in every blank that does not apply to you - leaving it empty may look like you mistakenly forgot to enter information.

    This is really frustrating to say the least. Lucky me I guess, huh? Now I need to wait for god knows how long and I probably have to look elsewhere for an internship, I can't wait for 6 months or even longer. I have been waiting for 2 months already with zero updates, this will throw me behind my schedule for getting my degree for sure.

    Yes, I have heard that even if you have never been to any currently banned country, but you have immediate relatives who come from there, even if they do not currently live there, it will trigger a ds5535 for you. Basically, if you have any connection at all to a banned country, weather or not you've ever been there, you are in line for extreme vetting. If you ask me, it's complete overkill, and causes a lot of undue hardship to those of us waiting to be reunited with loved ones. There seems to be more of a push lately in getting government to be more transparent with the process and finding ways to speed it up.  Good luck, and I hope you won't be waiting for too much longer!

    fkin BS. Why not take a single look at my case since you understand my frustration?

     

    Should I inquire daily and bug them or it's a bad idea? B1/B2 Visa

    My understanding is that the Department of Homeland Security and many other agencies, etc. are the ones performing the extra vetting/background checks. The embassy needs to wait until those other agencies have completed their investigations in order to pick back up with processing our visas.

     

    My fiancé and I have been sending an email once every 30 days or so to our embassy asking for a status update,  even though the only thing they can ever answer back with is to tell you it's still in AP - we've been in AP for 9 months now, and many more on here for have been for upwards of 1 to even 2+ years.

     

    It stinks, but the only thing anyone can really do is just have patience.

    Also yeah, I was looking and almost everyone got their APs done with within a few weeks..

    My fiancé (Norwegian citizen his entire adult life, but born in Iran, not muslim) waited 2.5 years for a visitor's visa and was also given the ds5535 for our fiancé visa.  It has been 9 months with no word from the embassy.

     

    Not to be discouraging, but it seems to be taking quite a while for the extra vetting to complete.  You'll just need to have patience and hope it ends sooner rather than later.

    So grateful for these opportunities for those affected to get their stories out there, and yes, if you haven’t already done so, please make a quick video of your own story for the in-it campaign. The only way to make change is to keep talking.

    For Iran they say this:

    Available but unreliable. Police certificates are issued by the General Department of Penal Records and Pardon Amnesty (Idar-e Kul Sajl-e Kifari va Afva Bakhshudagi ). However, police records are not required for immigrant visa applicants because posts cannot verify them. Clean record certificates can be obtained in Iran or from Iranian Embassies and Consulates and the physical appearance of the certificate changes significantly depending on which authority issued it.

     
    So does that mean she only needs it from Iraq? Also, if we have questions about the procedure to get these from either country, do we call the embassy? 
     
    The people I spoke who live in Iraq have had to travel to baghdad to get this certificate. But they were iraqi nationals. I believe the same process might be needed for my wife even though she is an Iranian national. Please if anyone knows, advise.
     
     

    My fiancé is a Norwegian citizen formerly from Iran.  He only needed to provide his Norwegian police certificate.  I double checked with our embassy and they told us that Iranian police certificates are not required. From the link you posted, it looks like your wife should be able to obtain certificate from Iraq, though.

    Same situation as @MO&RA - my fiancé is a Norwegian citizen, but born in Iran - AP for 8 months now. Here's to hoping we all get through this soon.

    No effect on the case at all - you can email the embassy and request they send it back to you.

    When they are ready to issue the visa, they will contact you and have you re-send it to them.

    Agreed. The DS-5535 is a very good way to keep additional people out who supposedly do not technically fall under the ban, without making the ban look like it's over-kill. 

     

    My fiancé received the DS-5535, we suspect because his birth place is Iran even though he’s a European citizen. He’s also Christian. 

     

    I feel our our best hope for anyone stuck in AP because of the DS-5535 or because they are waiting for a waiver, is a change of administration and a more sensible, fair approach to this issue.
