He already has a passport application out. He is just waiting for it
We will make sure we stay put until we have that
As I think even moving around with hid valid Nigerian passport (which he has dual citizenship) will re-permit him entry.
They did not let me into the building
So I have NO idea what went down there. Hubby himself was confused a bit but it's all sorted out now. Thank you!

My parting message to this thread.
Op, I go with the mantra K.I.S.S. There's already a well established process to secure a US passport for people in your hubby's situation. Make an emergency appointment at a Passport Application Center to secure a passport. All the hail mary attempts people are proposing, just save that for extreme situations if you find yourself in one. Yes, as a USC you should not be restricted from coming home but why go a complicated route to get home when simple solutions are there. Good luck.

Short of past fraud , friend is set, but should fight in divorce court for dissolution and not agree to annulment.

You're asking too many questions that only "patience" can answer. Sadly
Moving your case tends to usually result in a positive news.
Perhaps your current center is backed up and now that your RFE is replied to, they perhaps have all the info they need to adjudicate the case so you got moved
You're already applying for N-400 so all of this is irrelevant.
If it happens that you have no 10 year card by the time the N-400 rolls around, they just combine it into a dual interview. Happens all the time
Immigration is not a fast or easy process. And let's not forget that COVID might still be making some centers worse than others. so try not to let it impact you too much.

It is definitely bad when something like this happens, and I understand the frustration. Let’s not forget that even if it shouldn’t happen ever, I don’t know the numbers exactly but this agency is processing millions of different kinds of applications at year, each application requires them to send a number of correspondences to each applicant. They are working with less than normal amount of employees and having to deal with the pandemic.
There is this surge of migrants, sometimes during the summer it reaches 100k at month, each applying for assylum, work permits, etc.
Errors as terrible as they can be in certain circumstances, will happen, it is not a perfect system. In a perfect system 0 errors occur.
When errors happen we have to document everything and contact them as much as possible and even involve our congressman or congresswoman if necessary, until the issue is corrected. Don’t apply and go dormant, keep checking online status, on both systems. Sign up for informed delivery with USPS. Check your email and spam email.

I don't think the issue is the length of marriage or the QUALITY of the evidence.
What you have is great and quality evidence. Their issue is timing.
When did spouse get approved for AOS? They want documents from then (since in theory, upon approval, they have everything they need to commingle finances)
I read on VJ before we submitted our documents that too many people were getting hit with RFEs that only show recent bank statements. I think the same issue is what's happening.
You got married in 2018? They expect documents from 2018 (or latest adjustment date to present), particularly on the financial side. You had the Credit union statement from Dec 2018 (which is fine) but they said it is not "actively used" so are there not too many transactions on them? That might be the issue with that.
The IO is basically worried that you made all your 2020 evidence in anticipation for this filing- which sucks to hear, but remember, that's how they see things. It's not really a reflection of reality.
From what you are saying- what you have is what you have. That's when spouse joined those accounts
A possible remedy is the following-
Did you add spouse to lease prior to April 2020? Bring that document. Same with all housing documents prior to 2020 that had spouse's name on it.
Basically- dig as FARRRR back as you can to things where your spouse was added- anything before April 2019 will help.
I know this sucks. An RFE is just a delay. Someone is looking at your case. Don't panic
Send whatever you can back, and an approval will surely come. Good Luck!

I wouldn't think that
I mean there's a bunch of SRC folks in like September where nothing is happening either.
I think if you are one of those that recently had a JOINT interview in the states (K1, CR6, F1, etc), then an interview might never happen- and the delay is just that the person holding your files are processing other applications.
They're moving cases around to navigate work load.
Basically what am saying is no one knows what's happening.
I wouldn't be discouraged and automatically think they "forgot" you or U will have an interview.

A little behind? I think they all quit that service center. There has been no movement and it's incredibly frustrating. I'm so happy for people getting their approvals already, but we aren't even getting biometrics waivers/appts
