mushroomspore reacted to mindthegap in What to do after I-751 denied?
One day at a time. Stressing over something that in all probability will never happen, is completely counter productive.
File the best i-751 you can, with every single possible piece of evidence you can think of that may be helpful.

    If it was to get denied, your subsequent course of action would be entirely dependent on why it was denied. That aside, broadly speaking, your main immediate options would be one or a combination of the following;
     a)file another i-751,
    b) file an i-290b, if you meet the very narrow criteria for it,
    c) do nothing, wait for an NTA and go to court,
    d) file a new i-130 if you have since married an american citizen.

My ex spouse is an abusive sociopathic narcissist of amber heard proportions who straight up lied to USCIS in a malicious and deliberate attempt to ruin my life, and get me deported.
My experience, although not my any means unique, is far, far from the norm. If you worry to that extent, you will drive yourself mad.

I feel like we should have an FAQ/info section about questions like these. And maybe a big banner that says, "USCIS.GOV is the only official place to be getting information from."
As I said, do not file ROC. Your marriage was more than 2 yrs old at the time of approval so you are an UNconditional resident and do not need to file I-751. You will be wasting the filing fee and further complicating your case. Make an Infopass and get your passport stamped with I-551.

USCIS.GOV has the number to call for Infopass. Ask to talk to Tier 2 officer. Before Covid, we were able to make Infopass appts online. But sadly that's no longer available so you have to call. If they get difficult, just keep insisting you have to get the passport stamp because your physical card is incorrect and you need to retain proof of employment authorization and to return to the US should you decide to travel internationally.

Re: the bolded part - where did you read it's a "case by case" basis for 2 yr vs 10 yr GC? It is not. It's in the USCIS manual that if a perm resident is approved and their marriage is younger than 2 yrs old at that point, they get a 2 yr conditional card. If the marriage is older than 2 yrs at the time of approval, they get the 10 yr card. It is cut and dry, black and white. It makes no sense for it to be on a "case to case" basis. Why would any couple married for 2+ yrs not be allowed the unconditional 10 yr card??

Also, you need to file I-90 to get the card fixed. It is USCIS error so the I-90 is free foe you to file.

Oh it would have been good to mention in your first post that you already submitted I-90. Do not submit I-751. They made a similar error on my GC back in 2017. They said I had been a resident since Aug 2017 but that was when I FILED AOS. I was approved Oct 2018. I also got a wrong letter saying, "You're supposed to file I-751 close to Aug 2019." Obviously this was wrong. I filed I-90. I also replied to the I-751 reminder letter with a copy of my I-90 receipt notice stating that the dates on my card were wrong and I had filed I-90 so actually I did NOT need to file I-751 in Aug 2019. I'm not sure if that did anything but I got the new GC with all the correct info surprisingly quickly. I still had to do I-751 because my marriage was only 1 year and 4 months old when I had been approved. But there were no issues and I'm a citizen now.

File I-90 right away with copies of your marriage cert and the I-485 approval letter with post-it's or stickers pointing to the dates and a letter with very clear language saying: "I was married XXXX/2019. My I-485 was approved XXXX/2021. My marriage was older than 2 years old at the time of approval. Therefore, my green card's 'Resident Since' date is incorrect and the expiration date should reflect 10 years, not 2 years." Yes it sounds stupidly obvious but you have to spell it out for them. Burden is on us to call attn to these errors.

I don't think they need a lawyer. Their marriage was definitely more than 2 yrs old at the time of approval so they should have the 10 yr card. I think they just need to file I-90. I'm more confused about why OP thought the 10 yr card was given on a "case to case" basis. That makes zero sense.

If you were married for 2 years or longer as of the date the Adjustment of Status was approved, you should have received a 10 year card....period.  This should have been immediately reported via an I-90.

Step1: Determine the actual timeline of all events.
Step 2: Determine whether you received the proper Green Card
Step 3: Take IMMEDIATE action (I-90) to either correct the GC or plan for Removal of Conditions at the appropriate time.
You might have to hire an attorney to help you clear up this mess.

    Really?
    1.  No, it is not "case to case".  Either you had been married for 2 years on the date of approval or you weren't.  ANY error should have been noted and reported asap.
    2.  If you file ROC too early, it will be rejected.
    3.  If you file ROC too late, you could be placed into removal procedures.
ANY error should immediately be reported and corrected.

mushroomspore reacted to Loren Y in Can I request waiver on requirement to meet in person due to pandemic?
Out of the past 20 years, maybe 5 of these waivers have been granted, it is very hard to accomplish. Just go visit and refile, or since your going there marry and do the CR1. No way around a visit in your future I would think.

As a side note, covid variants are a big money maker, and are never going away. B.5, B.6 is next month, I heard B.7 should be here by September, and then the BIG winter and cold season begins in October/ November when everyone will be locked in their homes again because B.8 is here now, and it is the most contagious ever. But don't worry , by then they will have a new booster from Pfizer that will solve all your problems, and you won't be able to buy water and toilet paper again, but don't worry, Daddy Biden will be there getting you vaccinated while asking for your vote.

That is not a valid excuse to be granted a waiver. You can wait, travel later and apply after that. The only case we know here that was granted was when the US petitioner was severely disabled and bed bound and the beneficiary was not able to be granted a tourist visa to fulfill the meeting requirement.
