Haha the funny thing is that telling USCIS that you are getting divorced with a pending I-751 is TOTALLY NORMAL and the easy way to go about it. Sooo many couples do it. You can't predict life so lots of people do undergo divorce after filing a joint I-751. Your ex lying and thinking that's gonna help him somehow with USCIS??? Well that speaks to....very low levels of intelligence. But it's ultimately not your circus and not your monkey. Wishing you all the best as you move on.

Thank you. Yea he can ask his sister in law and twin bother they only have 3 years here in the USA and he thinks that they know more than me, I came when I was 3 years own and going on 44. He basically did it to himself.

Then there will be an I-751 interview. You won’t be there. Unless he knows he can change the petition to an individual petition with a divorce waiver while at the interview then his case will be denied. If he remains clueless then he will eventually have to leave America.
No at least three of us are telling you to not send your divorce paperwork to USCIS.

Sorry about your situation.
Just to be clear, he is not getting a visa. He's way past that. He will get a 10 year green card.
Unfortunately, the petition is his, so he is the one that has to inform USCIS.
As Timona has said, until he naturalizes, works 40 quarters and/or dies, you are on the hook for the i-864.

Exactly. If he doesn;'t inform USCIS of the divorce, and you have an interview and don't show up, he'll have to explain why.
If he gets approved without an interview and fails to inform USCIS of his divorce, he's going to be in hot waters when he naturalizes, because he needs to inform of the divorce.

Exactly. If he used you, I would let him freak out and figure out the situation himself. Focus on you and your own life now.

1. Protect yourself and your children physically and financially through a good divorce attorney.
2. Divorce, move on, and seek happiness for yourself.
3. Let him worry about his own immigration journey. He will have to convince USCIS that he entered the marriage in good faith. You are not required to participate.

Hi just called thank you @ MsKayC, followed your instructions and was able to get a very nice agent. They were able to give me his receipt number. She stated I will be getting the notice in 2-3 weeks.
