santiagosilva got a reaction from Giovanna024 in filing N 400 online 1 day early in 2020
    Just a minor update

Went for bio, and spoke to the lady working there. she was as chocked as I was about the timezone being Hawaii.  There's only one officer at that field office, and she said he was booked all day + it would be at least 2-3 hours before I'd even MAYBE have a chance to talk to him.
So I figured I'd wait for my interview. (as they're processing much faster now than in 2018 /19)

Bottom line, she was as surprised as me to hear that the system uses Hawaii, of all time-zones, and NOT something more common.

you're probably right!  And because there's probably only ~ 50 / year that this happens too, and it's easy to just sweep that amount under the rug, and blame the user.

As I work nights, to match other countries time zones................I do a lot of my paperwork and finances / bill pay at night.  That's partially why I figured it was perfect to apply when I did, and have done LITERALLY everytime there's an online option in life.
If you would've told me that USCIS in 2020 had a flawed system like this, I wouldn't have believed you.  Especially since business hours are over in puerto rico, when Guam hasn't even started serving egg mcmuffin yet     This is why it would be good to be extra clear , as to what time zone we're going by.

    Enough ramble ....

I guess I'll just keep waiting to see.

Do you know if @Giovanna024 heard back quickly on the filing early, or had to wait the full 10-12 months to then get denied to reapply?

@geowrian That's the thread I just read before posting. But it's over a year old, so I wanted to see if there was newer info on that. Like if they had decided to give leeway for people who live in different timezones.

Yes, sorry for the delay. We got a separate letter stating that it would be a combo so I had to buy a ticket to come back 2 weeks earlier than planned to be there in person but it was very good I did that. As soon as the officer saw me and my son with my husband I think he already was on our side. We went in for our combo interview on Monday and got there early (arrived and was in waiting room by 7:20 for a 8:05 interview time). The officer came in just a few minutes later (almost 30 minutes early!). My husband was using the bathroom so he said no problem and came back out a few minutes later. We went in probably around 7:45 AM (so I recommend going earlier than your time!!). The officer was very friendly and quickly put us at ease. We started with questions for the I751, where did you get married, etc. etc. Largely just focused on when we got married and dates of moving, travel, etc. Then he went quickly to the N400. Asked civic questions and my husband got the first 6 correct (what is the capital of CA, ... can't remember the others). Then he read and wrote on the iPad and told us we were approved. I think it total it took about 1 hour but a lot of that was just waiting for him to type things into his computer. Not that many questions for us. He didn't ask us explicitly for any original docs but when he asked us questions, I would take out the original docs that we had that supported the fact. E.g. showed him pictures from our family trip to Japan or showed him the original house deed when we talked about purchase of a house, etc. He told us we would probably get oath date in August and wrote 8/14/2019 on the letter he handed my husband. Hard to believe this process is finally almost over!! Good luck everyone who is still going through the process!

santiagosilva reacted to longuscisprocess in PLEASE HELP!!! I-751 pending and divorce
Hello everyone, I know this group is silent from a while. But I really need help here. I filed joint petition and we got separated. I filed for divorce and I dont have divorce decree in my hand yet. Today I got a notification that my soon to be ex husband withdrew my petition. I called uscis and tier 2 officer spoke with me. He says someone wrote a letter to uscis(husband) telling to withdraw the form. Now my online account tells my case has been withdrawn and to wait until i receive my withdrawn acknowledgement notice. Is there someone like me? what will happen to my case now. I will receive my final decree in two weeks. I was thinking to sent the decree and to change into waiver once i receive the final decree. What can I do now. Please help.

Only because it seems other threads have dried up, or ppl have stopped updating their status / visiting VJ,  I'm curious; - Are the ppl who haven't been accepted yet on this list, really still waiting? (just for my own peace of mind.)

Your divorce cannot be final if applying under the three year rule. If it becomes final before your N-400 is adjudicated then it will be denied, since remaining married is a requirement of filing under the three year rule. Note that you must only be in a bona fide marriage up to the point where the N-400 is filed, but if you separate and/or file for divorce after that, it cannot be finalised.

I don’t know of one, but the 3-year rule does specifically require that you must still be MARRIED TO and LIVING WITH the same US citizen at the time of FILING.

And as i said , i would ask USCIS or an immigration lawyer. But if i've understood the "philosophy" of immigration via marriage ; the marriage with which you obtained your visa(s) is the one that counts, and that you have to prove was real. I.e. in theory, even if you've gotten married 1000x after that marriage, doesn't matter. As long as you can prove that the one that gave you the visa(s), was genuine.
Then of course the question becomes "what is proof?", and if you don't have it, "why don't you have proof of having been in a real relationship, if it in fact was real?". but that's the next step, and could involve you going to several interviews, and sending several pieces of evidence, and still not being believed by the person making the decision.

thank u @Damara  and @santiagosilvafor the advice,  i think its best for me to file for a waiver and see what happens, its not in my hands anymore,  I put in Gods hands whatever the outcome will be, but i really got married in good faith, i will try to call uscis and also ask immigration atty what can they advice me in my situation. thank u.

I guess we're done doing those charts nowadays

(maybe it's just me, but it's easier to look at the charts once every few days, than read all the different individual posts. )
