Alexa210 reacted to Crazy Cat in I-751 interview not waived after submitting strong evidence - need to worry?
Until a few weeks ago, USCIS could not waive an I-751 interview if the immigrant had not previously been interviewed by USCIS (CR-1 cases could not be waived)

Had my interview today and officer told me my case would be under review, upon checking case status tonight I found a different thing entirely.

#Can someone please tell me if this means I’m approved already my attorney is not telling me if I was approved already.😩

Had the I-751 interview today morning (yes, on a Saturday at 7:30 am). It was very simple. We were with the officer less than 10 minutes. Most of the time, he was just verifying our evidence of relationship. He had a big folder with all what we have submitted previously and asked if we had any new evidence. We submitted updated bank accounts, taxes, more photos, etc.

Then, he asked a couple of questions about where are we living now, where we lived before moving to our current address, asked for passport and asked if we’ve been out of the country recently, if we went together, and then asked if we have been arrested or had any problems with police. And, that was it !

He said that he didn’t have any further questions and to expect the new card within 30 days by mail.

So, our journey is over for the next couple of years as we will not be pursuing the N400 yet. Wish you good luck to everyone!

    Thanks!

    Just got back from it...............Approved!!!!!!

Apart from the wait......Appt. for 8:30. We arrived at 8:15. It took 30 mins to pass through security. Checked in and assigned an interviewer at 8:45. Called in for interview at 10:25. We did the interview together. At no point were we separated. No hardball questions. Asked where we met, and when. Who attended our wedding. Who proposed, and how/where. Wanted to see latest joint tax return (2020 had not been included with the petition). I also offered documentation on a Joint Trust that we have been putting together. His final question was to me...why didn't I file for a N-400 as well? I explained that I misunderstood the timelines. He pointed out that If I had of filed the N-400 when eligible (July 24/2021), we would of been doing both interviews at once! He excused us so if could fill out some paper work, and ten mins later came out and had me an approval letter, and explained that I would be receiving my new 10 year Green Card (I thought it would only be 7, because of the 3 years already here) in a couple of weeks!

It's easy to say now, but try not to sweat it

So after 276 days of pretty much radio silence for MSC, I received a letter in the mail today dated 06/05 to visit my local USCIS office in Philadelphia to get my biometrics done on 06/29.

It takes time but just be patient! My spouse wanted to file asking where our claim was, but I knew it is just a waiting game and I was right!

Finally feels like I'm on track now.

Want to wish my fellow filers the best of luck!

I thought that everybody in this thread would be very amused by my immigration attorney trying to convince me that getting an ROC interview is exceedingly rare and therefore I should pay him to come with us.

I responded to his email with a link to the Dec 2018 change in guidelines that make CR-1s ineligible for an interview waiver 😂

Posting here based on a recommendation in another thread. Is everyone who entered on a CR-1 visa now being re-routed to MSC regardless of the actual state of residence in the US?

Alexa210 reacted to millefleur in Choosing a K-1 Fiance or CR-1 Spouse Visa in 2021
CR-1 is obviously the better choice, but getting married in Russia requires trips to/from Moscow, acquiring paperwork and then a waiting period. This was complicated prior to Covid, and most likely it's even slower now. There wasn't any particular visa requirement prior to Covid to getting married in Russia, the hassle was always the trips to Moscow to collect documents (an appointment at the US Embassy for the American to get an affidavit and then a 1-2 week wait for some Russian bureaucratic agency in Moscow to authenticate/approve it - this had to be done in person, no mail in option) and the month long waiting period ZAGS requires.

I wish I had more answers about a good third country for Russians and Americans to marry in. The whole Covid travel restrictions have certainly made it much harder. Turkey seems like it could be an option - just makes sure that whatever the US Embassy requires is also feasible:

Just as a reminder as to why I think a CR-1 is superior for many couples.

Every couple has their own priorities, and each couple must decide which visa is better for their situation.
    K-1
        More expensive than CR-1
Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
Spouse can not leave the US until she/he receives approved Advance Parole (approx 5-6 months)
Spouse can not work until she/he receives EAD (approx 5-6 months)
Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period
Spouse will not receive Green Card for many months after Adjustment of Status is filed.
A denied K-1 is sent back to USCIS to expire

    CR-1
        Less expensive than K-1
        No Adjustment of Status(I-485, I-131, I-765, I-944) required.
Spouse can immediately travel outside the US
Spouse is authorized to work immediately upon arrival.
Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US
Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

No news... waiting. No biometrics, nothing. I read that MSC cases will almost certainly be scheduled for an interview, so it looks like it will take time 😕 .

That's not quite true, it's a section on the I-129f form.

However, my impression from past research is that it's more of an accountability thing. They do want to know roughly what you were doing in the past X years, especially I think if you are in a field for which they might want to do extra background checks (like handling dangerous chemicals or working on weapons contracts for the local military or something...I'm making up these examples). But they care less that you were paid $20 USD to mow the neighbor's lawn every now and then.

If you browse around more, you might be able to track down the specific USCIS law/guideline concerning that section (or someone who knows more can give better information). But that was my impression when filling this section out, do the best you can, and give the reader an idea of what you've been doing for the past X years. I imagine that, at 22 years, this would especially be true if you were a student...I think we even wrote that she was a student during certain time periods to explain periods without work.
