    You don't report it, you just fill those parts out by hand. Almost everyone has this 'problem', no one gets denied because they filled parts out by hand that they simply couldn't fill out on the computer.

    Paying for an extra petition is not a big problem, so is it better to file I-130/130a for both kids or  just for one that is coming to live in US upon approval?   

    My thought is if we file for all the kids this looks more natural, and if we file just for one it is more unusual situation and we are living proof that the consular officers don't like anything unusual. From other prospective, if one kid is staying with his father without a US visa, it should look as a small proof of the true relationship. 

    I don't know about the child question part, but why were they suspecting the relationship wasn't real? 

     

    If I were you, I would tackle the suspicion first before applying for the CR1. Getting married isn't automatically a sign that the relationship is real. Unfortunately there's tons of people out there that marry just to obtain a green card.

    No one can tell you. Once you go into AP it could take days, weeks, months or years. All depends on how busy the consulate/embassy is, how fast all the checks go trough, the outcome of the checks etc. The fact that they did ask her passport back is a good sign. So yeah, sit back and just wait.

    It sucks, but I do agree with others that the timeline could raise red flags to the IO. She couldn't come to the US through her sister (or it would've taken 15+ years), and right after she gets married. Not saying your marriage is fake in any way, just looking through the eyes of the IO.

     

    Is there any way for you to move to India for now? You could live there for a few years and then petition for an IR1 visa. When they see you've been married an living together for a good amount of time, the red flags will probably go done by a lot.

    Your fiancé will need a police report from every country (s)he lived in more than 6 months since turning 16 (just to show that there's no criminal record OR if you have one you should bring all court documents etc), but usually the embassy requires it not to be older than x amount of time, so don't rush into that.

     

    Since you're still waiting for NOA2, I wouldn't spend too much time on this yet. Once you get your NOA2 you have at least another 2-3+ months before the interview (NVC usually takes a few weeks, and than it usually takes a few weeks to plan the interview), so you'll have more than enough time to gather everything you need.

     

    I know the American consulate in the Netherlands sends a checklist with everything you need to bring to the interview, I would assume London would do something similar. So for now, just slowly gather some extra proof of relationship and get the rest done once you're actually closer to the interview.

    I know people who got the 'you don't need to do new biometrics' letter 6 months after filing the I-751. They're so immensely backlogged that even this takes way longer than it should -_-

     

    About the smudged middle name, I don't think it'll be a problem. If you're that worried, just call USCIS on Monday to ask your question. That might give you more peace of mind

    At this point it's more common to go through manual verification than not to go through it. I went through it twice (when I requested replacement SSN card an when I changed my name), both times I got 'approved' about 3 weeks after they started the manual verification.

    Medical itself is valid for 1 year. As long as you file AOS within 1 year after medical and the medical is marked 'complete' you don't have to do another medical.

     

    The K1 visa is valid for 6 months after medical date

Upon getting back I immediately filed the I-129F along with a packet of about 50 pictures, printed text messages from talking every day since 2016.     The interviewing officer denied her Visa on grounds of misrepresentation and that it seems they only want to gain entry into the U.S. I honestly thought we were over prepared for this. I have been married in the past, but sent my divorce decree along with my I-129f. I sent all the necessary papers. Affidavit of support, I make well over what was required. The G-325A, along with my fiance having copies of every form needed. My friend also just went through this same process, so he looked over my paperwork and made sure I had everything needed.

     

    Come the interview day, as they get denied, they asked questions of where my parents live, work, and names. They did ask why I wasn't there, I couldn't get the time off work. And didn't know it was neccessary, my fiance answered all questions, when asked how we met, she stated truthfully, through a family member. She had a hard time hearing the officer and asked multiple times for them to repeat questions upon which they brought in a translator, she was not offered an interview in her native language, although she does speak great English.

     

    So after asking how we met, she couldn't hear because she said it was noisy and must of thought he asked who I came to Cambodia with, it was her sister. The officer states, first you say your Aunt, now you state your sister. After that the interview was over and she was given a paper with denial 221G that the petition states false information and it is not a real relationship, only one solely to gain entry to the U.S. Nothing else besides the paper was given to her, no actual reason on what they thought made our relationship false.

     

    So I have gone to my state senator office and signed a release form for them to contact other agencies on my behalf. I also have an Immigration attorney meeting this coming week.

    Looking for anything I can really do now that it's at a denial. If anyone had had this happen and has had success getting their fiance to the U.S. Thanks and on mobile, so sorry for the wall of text.

     

    I'll add as an edit- I've only gone there one time, for the engagement and spent a week and a half there. I send her money fairly regularly, as she has a decent job and says she doesn't need much. I still send her money though. Also, neither of us has any criminal background. And we have pictures of us together with her relatives there going all over Cambodia and our engagement ceremony pictures and we also have a video of it.

    I'm sorry you guys go through this. You met her once, and that was about 1 year ago for an engagement ceremony? I don't know if Cambodia is a hard embassy, but it seems like you guys might not have spend enough face to face time. Also, tons of people were denied on engagement ceremonies (too married for K1, not married enough for CR1), so re-filing I-129F is prob a no no.

     

    Probably your best move is to get married and file for I-130, but since she's denied based on misrepresentation and not enough proof of a genuine relationship, I'm not sure if she would be able to get the I-130 by DYI. Maybe someone else that has more knowledge/experience can chip in on this.

     

    If you are able to marry and file I-130, make sure you have way more face to face time before you file.

    Guess so. Hey, I didn't make the rules lol. The website clearly states that people with foreign DL's can drive up to 1 year with a foreign DL, so I don't really understand why this has to become a discussion. Fact is, PA allows people that come here from another country to drive up to 1 year with their foreign DL (if it doesn't expire before than). 

     

    If you have a DL from another state already than the 60 day rule gets in place. But I'm specifically talking about someone with ONLY a foreign license, not an out of state license (they should be even able to see if you have a DL from another state I'm pretty sure)

     

    And I'm also pretty sure that 5 DMV employees that I separately asked this question wouldn't all give the exact same answer if it was actually not true. Again, I explained that I live in PA (not a visitor) and they all said it doesn't matter, you still have a foreign DL so you're good to go.

    Nope, doesn't matter. As said, I even asked the DMV if I was allowed to drive (explained the whole AOS situation) and they confirmed multiple times it's perfectly fine. Also, in the text I posted it doesn't say you have to be a student or anything.

     

    Is it a good idea to get your PA DL asap? Yeah, absolutely! I mean, who doesn't want their PA DL once they move here? Is it required? Not for 1 year (or if your foreign DL expires before that)

    Yes, that's OUT OF STATE. I am talking about a FOREIGN license

    A K1 I 94 is 90 days.

    I live in PA, entered on a K1 visa and am allowed to drive up to 1 year with a foreign license combined with an international license.

     

    Lived in PA 5 years ago as an au pair, got pulled over multiple times cause my host dad made me drive a car with expired inspection, and every officer confirmed that I was perfectly legal to drive up to 1 year with my foreign license combined with an international license.

     

    Got my USA DL a few weeks ago (PA allows people waiting for AOS to get a USA DL for 1 year) and the DMV confirmed that I was perfectly legal to drive with my foreign license  combined with an international license up to 1 year. I even drove myself to my driving test, it's perfectly legal in PA.

     

    Most states don't allow it, PA is very relaxed when it comes to driving. And yes, the I-94 is valid for 90 days, but the moment the I-94 starts is the moment the 12 month clock starts ticking for your foreign license.

    As the title suggests, I'm experiencing some pretty heavy anxiety about the fact that I have participated in a green card lottery before filing for my k1. As a matter of fact I think I participated in the lottery approximately a month before applying for my then k1. The reason for this was that I had just proposed to my then girlfriend and now wife and I really wanted to come up with a way that I wouldn't have to say bye to her at the time. It was an irrational decision that I made in an emotional state (much like right now lol)

     

    We are currently waiting for our AOS interview, already gone through biometrics and just in a waiting period right now. Does anyone have any similar experiences, whether or not this can be an issue down the road? I hadn't put much thought into this until now. This has never been brought up in our process so far.

    Can you explain to us why you are so worried about this? This is not an issue at all, it will have 0 impact on this process or the processes to come.

    I thought you said not to be aware of driving for 1 year with foreign license, but then I saw you said out of state license, so I deleted my comment since you're right.

     

    As for a foreign license, in PA you can drive up to 1 year with a foreign license combined with an international license, but that was not the topic here lol.

    How long do you want to lice in Ukraine? Usually you can delay your NOA2 expiration date for a total of 12 months, but expect questions at the interview why this happened. Also, like others said, you have the income- and domicile requirement.

     

    If you plan on living in Ukraine for more than 12 months, best to withdraw the K1 and file K1 or CR1 whenever you're actually ready for it.

    Oh man, we did K1, and our process went slightly different than the normal K1.

    We actually got an email from NVC that they received our approved I-129F before we received our NOA2! (little mistake on USCIS side I guess lol)

    I knew others that had the same time line as me, and once I knew their time line I was basically staring at my phone / refreshing CEAC multiple times every day 😂😂😂

    Once I had my interview and got approved, I emailed the consulate after 1 week asking why my status still was on 'Ready' (yes, I was VERY impatient, don't be me lol). 

    So no, you're definitely not alone!

     

    Right now we are in the AOS phase. Got my EAD/AP one month ago and still waiting for my GC interview (what could take at least another year or so)

     

    Although you're doing CR1/IR1, I thought sharing my craziness would give you a peace of mind lol. Hang in there, before you know you'll land your butt on that plane seat off to the USA!

    That's good evidence! If I were you I would just include the plane tickets/hotel bookings from both of you, passport stamps and some pics (and don't forget the letter of intent from you both, but that's a whole other piece of evidence)

    We didn't provide any chat logs, since it's in no way proof of meeting in the last 2 years.

     

    We filed in 2017, included 7 pics of us together/with friends/with family, the plane tickets/hotel bookings of when we visited each other and the passport stamps of visiting each other/our travels together through Europe. No RFE and visa got approved in 2018. The only 'extra' evidence the IO wanted to see at the interview were pics from after filing, and that was mostly cause I was basically waving them in the IO's face lol.

     

    If you include way to much evidence, the chances are that they'll throw out important documents (cause I read that they will throw out stuff they don't need like 10k pages of chat logs lol) what can lead to RF(I)E's, so better not to overload, especially since you're from a not high fraud country. Including chat logs is fine (although again, no evidence of meeting), but just include 1 or 2 pages with a few sentences of your chats on different days/years.

    That must've been so creepy! I know a few years ago in NYC there were a lot of fake 'police officers' with badges etc. One NYC resident told me you're ALWAYS allowed to call the police station and verify that it's an actual cop by giving them the badge number. As long as you politely mention to the cop you're with you want to double check for your own safety, you're not doing anything wrong. 

     

    And yes, a few of those calls exposed that the badge numbers were not official police badge numbers and it were not actual cops. But I fully understand that when you're actually in that situation, this is not the first thing to pop in your head.

    It fully depends on the state you live in. I live in PA and I got my 1 year DL without EAD, since PA allows people who can proof they have a pending AOS to get their DL.

    I don't know about your state, but it should be pretty easy to google. Just check out the local DMV site, it will hold the answer to your question.

    Basically to check the marriage is real and the petitioner (you) has the right to receive the Green Card.

     

    It will also be good for you to check the AOS guide, since it seems you're not very familiar with the process. Knowledge is key in immigration (K1 all the way up to citizenship), since some mistakes could have severe consequences or could delay your journey.
