patientguyinlove reacted to geowrian in Applying for Unemployment on a Green Card
Unemployment compensation is not a public charge issue. You pay into it (directly or via your employer) and it pays out, like an insurance program. No issue using employment.
Conditional permanent resident is the exact same as an unconditional permanent resident, except they have to remove conditions to renew their card.

No issue. Unemployment is an insurance program that you pay into. It has no public charge implication whatsoever.

Wvail - Hello and welcome.
First, let me say that almost every thread I've seen on this topic has gotten somewhat nasty, so I'll try to refrain and keep it objective.
Next, this issue has come up a lot on VJ. I would encourage you to search through the site. I'm not being rude, but you'll get a better perspective as people have dealt with this issue through many different embassies throughout the world. This will give you a cross-section of how this has been handled from the various embassies.
Heres one thread:
My understanding is this...while some embassies may handle this issue differently, the general theme is for them to ask you about drug usage during the medical exam. THEN, if you say yes, they will ask when and issue a drug exam. The existence of drugs or admittance to use in the past year will prevent your approval...many refer to it as a one year ban...meaning you can reapply after one year.
If anyone has any EXPERIENCE to the contrary, please let Wvail and all of us know. Thanks!

My wife is having the same issue.
It seems companies are regularly violating federal employment discrimination laws.
We started a thread on this topic, if you're interested:

patientguyinlove reacted to TenderHearted in Been here for 5 years and I don't know if I made the right choice.
You need to have a heart to heart with him on this. Don't let anything undermine your marriage, and resentment can be the start of really bad things if you don't get it in check. Tell him how you feel, in a kind respectful manner. That will go a very long way.
I can only imagine you are a little homesick, so keeping your mind occupied with things to do will help, and so I could see your reasoning about moving to a bigger town, where there are things to do. Be willing to bend a little, not that you haven't, I'm sure you have, since you immigrated here to be with him. Surely he will consider seriously what you have to say, especially since you have to drive such a long distance to your job. I would kindly make mention of that as well. This is a hard process to go through, and I can't imagine that he doesn't highly value you, enough to do things to help you be a little safer, like doing something to help cut down on that drive!

Thanks @C90. This employer has 275,000 employees and offices throughout the world. They conducted a review with a legal team of specialists in immigration. I'm shocked this was the conclusion. Thanks again for your advice.

patientguyinlove reacted to C90 in EAD Question - Employment pending Green Card
I got this question multiple times (are you allowed to work in the US and does your EAD expire)
What I tell them is yes, it does expire BUT 6 months (or so) before expiration I can send a renewal request and USCIS will renew EAD for 180 days if the new card doesn't come in in time and that his process keeps repeating itself till I get a green card OR get a renewed EAD for 1 year. This way I ensure employers there will be no gap in my ability to be legally allowed to work here.
Side note: I usually have to explain this to smaller companies that don't deal often with immigration. I'm educating them and up till now got very positive feedback and they're grateful that I take the time to explain it to them.
Anyways, as long as the job description doesn't say that the applicant has to be an LPR or USC, they're absolutely not allowed to deny her for the fact that she doesn't have any of those documents, since she does have her EAD. I would advise you to read through the topic I mentioned down here, since it has really good info what to do in case you are 'a victim' of EAD discrimination.
Good luck, hope the company gets educated and she gets the job she wants!

I work as a recruiter and I can tell you that is serious discrimination. I agree with @geowrian They probably didn't understand the rules; however, that doesn't give them the right to do what they did. If that's the way they're going to treat her during an interview process I say good riddance!! She doesn't need to work with a company who will be disrespectful or take advantage of her

patientguyinlove reacted to geowrian in EAD Question - Employment pending Green Card
Unless the position is with or requires certain government or military organizations that are exempt, an employer is not permitted to discriminate between individuals permitted to work or immigraiton status.
https://www.uscis.gov/i-9-central/employee-rights-resources/preventing-discrimination
"Preventing Discrimination in the Form I-9 Process
Employers must accept any document an employee presents from the Lists of Acceptable Documents, as long as the document reasonably appears to be genuine and to relate to the employee. Employers must not:
Demand that an employee show specific documents Ask to see employment authorization documents before an individual accepts a job offer Refuse to accept a document, or refuse to hire an individual, because a document will expire in the future Refuse to accept a receipt that is acceptable for Form I-9 purposes Demand a specific document when reverifying that an employee is authorized to work " That said, this usually comes up when the employer doesn't understand the rules. It's much better to work with them to explain the situation than to try to take any action against them.

Hi All,
8/3 "received date" petitioner here.
Hard copy NOA2 in the mail today! No RFE. Approved!!!
2/20 Notice data (my timeline has been updated for everyone).
Special thanks to @Naes and the other data analysts that have provided their volunteer time to keep all of us informed.
A reminder that @Naes and the other volunteers are using cases (data) to estimate timelines. None of these folks represent the US Govt.
In other words, please dont send them nasty messages about the timelines they are providing.
To those waiting, stay strong and happy. Your relationship will benefit tremendously. Spend the time saving, budgeting and thinking about your future relationship. Also a thanks to those that have kept this thread positive. As the second poster in August, I had to step away due to the panic and anxiety that was created. Let's keep it on the positive and support each other. This isn't a fun experience for anyone. Share the love. Let's help eachother. That's what VJ means to me.
