    My waiver package was about 3 inches thick...done By an attorney...it's way more than just filling out forms...and I had at least 3 serious issues...And many secondary issues.  
     
    My suggestion is to get a lawyer who's experienced in waivers...the last thing you want is a delay because your package isn't complete

    Get advice from a very experienced immigration attorney , don't give up . Ive seen time línes of people that were denied 2 even 3 times but at the end they needed up bringing their loved one and are together now .

    After 260 days of waiting we were finally APPROVED today (pending medical!)! 

    I am over the moon excited, all of our hard work is over and we are going to be comfortably living in the United States together my love and I! When you go through this process you always think, what happens if we get denied, what are we going to do? And it would just kill me to think that I would have to live in Chile or get married and be away from him for another year. Next month he will have his visa in hand and he'll be coming HOME!

    Normally a Fiance Visa sent back to USCIS will not get reviewed. It will be allowed to expire. Basically the Consular sent it back as not issued. Were there any red flags in your petition, huge age difference, etc.... How did the interview go? 
     
    Basically now, you need a new plan because this petition will die

    If its an onfoing case & a 2nd  I 601 waiver is filed, the waiver MUST be paid for again
    but not for the follow-up interview at the consular office

    Hello :
     
    My family applied for me for family sponsorship for unmarried sons or daughters over the age of 21 , we applied around 2009 and finally July 7 2017 i got asked for interview , now to make things clear , i was deported from the US for signing a check in the amount of $260 i got petty theft and forgery around 2003 ,its been around 15 years since this has happened and before and after i have a clean record , long story short after the advise of my lawyer ,he said they might give you the visa on the spot of you are lucky or most likely in cases like yours a waiver , i went to the interview and it went perfect ,of course i got asked for waiver I 212 , i left the US embassy in Jerusalem Israel and i was expecting that answer anyway , so contacted a lawyer for the waiver , then last Friday i get a call from the embassy asking me for a second interview and to bring my passport , im very confused now ,i know its in 2 days but has anyone had this happen to them ? and what could they possibly want since they already asked me for a waiver , she was very clear on the phone ,she said we are doing a second interview and please bring your passport with you ,waiver or any other document was not mentioned , any comments or past experiences would be greatly appreciated

    Did his CIMT carry a sentence for less than one year? Was this his only CIMT? And did he spend less than 6 months in jail? If so, you can ask for the petty exception.

    No. My fiance had his I-601 waiver approved for a CIMT. They didn't ask him one question at POE.
    After going through the grueling waiver process, it is very hard to stop worrying about what else can/could go wrong. Believe me, I know just how you feel. Don't worry. The border patrol doesn't know just by looking at your visa that you had a waiver filing or a CIMT. That takes further delving. You will be fine.

    If you guys are looking at getting a K-1, you will have to meet within the last 2 years preceding the petition submission. This is a requirement that needs to be fulfilled regardless of your supporting documentation.
     
    So your first step is to meet and gather evidence from the meeting.
     
    Given that your home country Nigeria is considered a high fraud country (despite your current residence in Dubai), it might be a good idea to have more than one in-person meeting. You guys can meet anywhere in the world.

    The updated dates mean the officers at the embassy are looking and actively working on his file. It's impossible to tell if he'll get the visa without more details. How was his interview? Was he told he was approved?

    for those who are here right now to find answers about their immigration situations, or are you just hanging around on this site while waiting for your love ones while their visa are on process, i just want to let you all know that just keep holding on, keep praying and relax. dont stress too much. they will get here in eventually. its probably stressing you out now with all the expense, the time that keep taking so long and that feeling like its been forever. i was also there. 2 years ago, i used to be on this site to find answers to my question about my husband and daughter's immigration status. i waited a year and half to bring them here with me. but before all that, i went through a lot of pain, stress, deppression, and sadness. i was getting impatient because their papers were taking a long time. i cried almost everyday because i was missing my 6 years old daughter so much. so that day i got their interview date, i knew i only had a few more days left to get see my husband and daughter and hug them forever. it will be a long wait for a while, but once the consulate from your country recieves your case, the process will be really fast and before you knew it, you can finally bring you family and loved ones here in the US. i just wanted to share my experiences for a year and a half of waiting for my husband's IR-1 visa and my daughter's IR-2 visa. we had been living here in the US with my other daughter (we have 2 girls, one is US citizen already bcoz she was born here in the US.. my younger daughter was born in the philippines) for almost 2 years now. we very happy that we dont have to be talking everyday on skype anymore or facebook chats and videocalls just to see each other everyday. that was the saddest moment of my life. but look at me now, i am the happiest mom and wife knowing that i have them with me at last. and will never be apart again. for those who are still waiting, be positive and think of what tommorow may brings.. this day may be dark for you once you have your case complete and interview date, it will be the start of you happily ever after!! goodluck everyone!

    Have the petitioner contact he embassy or nvc and she has to ask them why exactly did they send the application back . You guys might have to seek the help of a lawyer to advice you on what to do next but maybe what will work better for you is to get married and have her sponsor you as a husband . Certain countries seem to be more strict than other to provide k1 visa specially when the male is the benificery .

They said that my divorce certificate is fake but last time when I apply for K1 I provided the same documents and got the v   
    Have the petitioner contact the embassy through email or phone and ask in detail why was the visa refused , also since they kept your passport they might try to debate something about your case and then they will give you back your passport with the actual refusal letter .

    Yes of course. 
     Yes he will still be refused and you'll have to start you'll be starting all over again   
    No. Processing times are approximately 10-12 months. I believe I have posted links to the USCIS processing times. 
    No. You only pay the visa fee once.

    Yes, sometimes consultations are free. But dont give up hope. I have been through a denial, for different reasons, but I know it hurts and makes you feel defeated. But you got to dust yourself and move forward. Make moves and as you complete the steps you will begin to see the light at the end of the tunnel.

    It will be a refusal regardless of it is a fiance or spousal. You will need the waiver either way. It would be a great idea to consult with the lawyer recommended by LionessDeon, she has proven results. 
     
    Stay strong, I know its hard but remain hopeful.

    Yeah, if they're waiting on papers, then he should submit them to the embassy. They won't approve a visa then request the paperwork...that's just not how it's done.

    We had our second interview today! We are finally approved! I will finish updating my signatures and such tomorrow but I wanted to let those of you who aren't in the facebook group, know. They said we should have his visa within ten days! I'm on cloud nine! It's been a long and stressful journey but we've made it!

    Depends on several factors - is it culturally okay in your background? How long have you known each other?  How often did you meet?  
     
    How strict is your embassy?  This would usually be reflective of the fraud rate.
