    Yes, assuming you have all the documents needed to file the petition and you have the payment, there’s no reason you can’t mail it to the lockbox tomorrow. He needs to return to the USA ASAP but where you mail the petition from is irrelevant. They don’t study the postal markings to see which city you were in when you sent it. They don’t care. 
     
    The affidavit of support is not needed until the NVC stage. Don’t even think about that now. Focus on the petition and getting your husband back to the US and him finding a job. Cross the NVC bridge when you get to it (about 6 or 8 months from now). His overstay will not affect the petition in the slightest. My husband (USC) has done far worse things and spent time in state prison in California and we were approved without any issues whatsoever. 
     
    It is very unlikely that your petition will be denied. The petition concerns only these things:
     
    - is the petitioner a USC (for this you will need a photocopy of his passport)
    - is the marriage legal (for this you will need a copy of the marriage certificate and copies of divorce decrees/death certificates if any prior spouses if either of you has been married before)
     
    The petition is not the visa. So an approved petition does not guarantee an approved visa. An approved petition just guarantees that you have a legitimate path to applying for an immigrant visa for an immediate relative.
     
    For the medical, hoe long ago was you mental health incident? Would you be able to get something from the doctor that confirms you are no longer a danger to yourself or others? Those are the magic words for the visa medical.

    It will take many months for the petition to be approved. The matter of income doesn't come into play until after the petition has been approved. Hopefully he will have a job by then that pays enough. If not, you will need to find a willing joint sponsor who does earn enough, or who has enough assets.
     
    Why are you 'wasting' money on a lawyer? You are in dire straits financially. Is there anything you have not mentioned here that would mean a lawyer would be needed? I understand you have an overstay but that's not that bad (relatively speaking - it is bad but it's hardly a conviction for murder). Many people have successfully filed following an overstay without using a lawyer. Since your husband will have, at least in the initial days back home, plenty of time on his hands he should read, read, read and read again about this process. And ask as many questions here that he has. Please save money where you can. Moving overseas is financially tough on anyone - no need to make it worse than it already is.

    It is not a breach of a tourist visa to get married in the US whilst a visitor. I see the myth that you have to have a K-1 to marry in the US is still circulating and being believed here. It’s simply not true. I married on the VWP. Many, many of us do. It only becomes illegal if you plan to stay (whether you marry or otherwise). The US embassy London’s website even answers this question - it’s perfectly acceptable to marry as a visitor:

    OP, unfortunately your days of the VWP are now over, forever. The good news is that this will not affect your CR-1 visa application. Your husband must return home. He is out of status in the UK and it would be a violation of this website’s TOS to suggest that he should do anything other than leave the country. The sooner the better. You would have to apply for a B-2 to visit him but I wouldn’t bother - your chances of success following a recent overstay are slim, at best. And save the money you would have spent on a B-2 and a flight ticket to visit for the I-130 filing fee.
     
    It costs $535 to file the I-130 and they take credit cards. The sooner you file, the sooner you can be back together again. It’s that simple. Borrow from a friend. Sell something. Drive for Uber. Deliver pizzas. If you want this badly enough, you will find a way. Send your husband back to get a job. This is going to be an expensive and long journey. 
     
    The time apart will be awful. We have all been through that or are going through that. It can’t be changed. Accept it and live with it. It won’t last forever. There are plenty of people here who can give tips on how they coped with the time apart.

    Interview dates can take a long time to get. It does not mean that there are issues with your case, just that the Embassy is busy!
    When did you receive your Documentarily Qualified e-mail?
    Also check out the “Case Complete to Interview August” part of the VJ forum. You will find other people that are in the same boat and also nervously waiting for an interview date.

    I was going to respond yesterday but it's hard to text when you're at the gym.
     
    Everyone has different experiences with USCIS. We got updated online, via text, email and mail. The NVC was swift with our paperwork. I had a great experience, and I am sorry that you didn't. 
     
    I am not going to bash USCIS. They don't work for YOU, they work for everyone. Just be grateful that you're not a June 2017 K1 filer that still doesn't have their NOA2.

Don't worry though, it is only an indication based on members feeding their timelines...  It would be logical to think that all centers have more or less the same processing time.     I would also recommend calling. It doesn't necessarily mean something is wrong with your submission, but I would check. Our first attempt took that long and when I called to check, they told me it had been rejected for an incorrect mailing address. They should be able to look up your packet based on identifying information (name, perhaps SSN...I don't recall). Good luck.

    Hello everyone,
    I'm Alix married to an animerican living in L.A. We sent the file on April 23rd, got a receipt saying they received it on April 24th,  the notice date is April 29th, 2019 (which I guess is the notice date starting of the process).

    Looking forward to seeing our updates in hopefully 6ish months and not longer!
