I am sorry you're now experiencing the heartache of being denied. I've been there and know the pain you must be feeling. Unfortunately you're experienced the same thing my husband and I did in 2015...the CO most likely feels you're married. The engagement party, the pastor and the engagement rings all give the the impression you did a traditional marriage...even if you don't feel your married.

Next steps: you will need to return to Ghana, legally get married and start again with a CR1. The good news is you have good evidence to move forward with a spouse visa. Also, you won't have the challenge of overcoming a "fraud" finding on the K1. It should be much easier for you to get through the next visa.

Again, I am sorry you have to go through this. It's not easy and sadly the time apart will be hard. But don't give up. We got through it and my husband arrived in March of this year. If you have any questions, feel free to message me.

    You did too much :
    1. we got engaged and had a enagement party. We even had a pastor to blessed our enagement.
    2. " I also got him an engagment ring"

^^ those were your problems based on what you wrote. The Ghanaian "engagement" is an actual marriage under customary law of Ghana.
Adding a "party" solidifies this point. And a pastor on top seals..You are married.
    2.  I don't know of which culture that has men wear engagement rings... certainly not Ghanaian.

You had good intentions but you did "too much" in trying to show that you are indeed engaged to him.
A word of advice to American women dating Ghanaian men, please stay away from these traditional "engagements". it is a complicated concept and would easily get you denied especially for K-1 process. You can do it later after your fiance has arrived in the US.

Approved from Ghana! We thank God ! All last night I was very nervous leading up until my fiancé interview because so many people would say Ghana is a high fraud embassy so many K1's don't get approved and that you have to front load your petition this and that which may be true , but we made it. I can honestly say I sent about 15 pictures maybe 10 chats a plane ticket stamp and that was it. My fiance was in this with me 150% he did his part so well. I never felt like i was doing all of this by myself even though we are 9000k miles apart. My fiance was only asked 3 questions and he was interviewed my a young African american man. Guys it doesn't feel real yet. It doesn't. We have had so much support during this whole process from both of our families our church, friends and this group has been beyond helpful. My fiance was so confident and went into this with such a positive attitude which helped a lot. I feel so emotional writing this because I would always pray and say God if you are for this please allow this to happen all the way from the beginning and the signs just kept coming. I'm so excited and so happy. For those who are still waiting may your blessing happen soon. Never stop praying. This is only the beginning of something amazing ❤

    Hi,

We understand your frustration, but none of us work for the embassy and can't answer you questions. The best answers you will get are speculation. You are venting your frustration out to people who are trying to help.

Maybe the divorce decree you sent got lost. Who knows. Just send the documents and proof they are asking for. this will be the simplest solution because if you tell them you sent them already and tell them to look for it, guess what? You case may just get put on in a large pile to collect dust. Be proactive and send them what the ask. If they ask for after that, then send more. Because every day you delay is another day your case will not be worked on. even if it is not your fault.

    Good luck.

Yes you provided the divorce decree in the original petition, but it is standard in many embassies to provide another copy at the interview.
What proof did you submit for meeting twice within 10 months? Pregnancy/having a child together is not the only proof of relationship that you need.  Photos are good evidence, but often considered secondary after things like passport stamps and travel receipts.

I am so sorry your case turned out this way. My husband and I also had our K1 denied two years ago, so I understand the heartache that comes with it.

As others have stated, your best thing to do is to go to Ghana and get married. That said simply getting married isn't enough to overcome the concerns the CO has with your case. It's good that you contacted your Congresswoman, but sounds like you got the same generic answers everyone does. You need to carefully look at your case, see what red flags you have and find ways to overcome them.

    Examples:
Do you have an age gap? An older women/younger man isn't a cultural norm for Ghana and adds extra scrutiny to the case. This can be overcome by providing good evidence of a solid relationship. Best evidence you can submit it time spent together in person.  How many times have you been to Ghana? As I already mentioned, face time is like gold to this embassy. If you've only had one trip and then filed your petition, it isn't enough for Ghana. I highly recommend planning to go back several times as you continue your next petition. I went 5 times in 2 years. Expensive...yes...but worth it because my husband is now here. How long have you known each other? A short relationship followed by a petition can cause problems in Ghana.  Did you do an engagement party? If so, they already think you're married and its basically an automatic denial. It happened to us. We didn't consider ourselves married, but my sweet husband took pictures from the party and they were interpreted as a wedding. We had to start all over and it cost us more time apart.   I know many of these might not seem like big problems, but in a high fraud country like Ghana they are...and have led to many people being denied.

Hey---like you said---when you know, you know
Your close in age, which means you have a lot in common most likely...you know one of his relatives "in person"...both on your first marriage....you both work...you waited before filing instead of running and doing it immediately...so you've been engaged for, what---9 months before filing?  These are good things in your favor so please try to think positive!!  I know it's easy for me to say and you'll worry anyhow---I'm a worry wart too.  And trust me, every single person here in these forums knows what it's like to think of the worst when dealing with immigration in any form.

I wish you and him the best of luck!

I've been  reading everyone's  posts on their  status, and that the  case status is not updating . Today I got up at 4:15 am to  go to the gym, which I did  . As I returned home I walked past my mailbox, a little voice told me to "check your mailbox" (something I rarely do) . I opened and didn't see anything but  continued pushed the envelopes  through my fingers. At the very bottom was  a letter with my name, before I  dismissed it I looked at the sender  "Homeland Security" . I ran inside shaking all I see was my fiancé'  name through the window. I tore it open and handed it to my roommate , who read it to me, "approved"!! Oh thank you Jesus!! I was  literally jumping up and down. I wanted to share the news with my love, but he was  still at work and an hour past , still waiting for him to get home. Once he arrived the darn Wi-Fi  was  on the brink. After multiple try's we finally connected , by this time he was  tired, hot and sure he is hungry being that it's  Ramadan.  He can't hear me well, but I was able to  give him the news, now I'm late to my 9 am appointment at work and it's 8:55am.   I can't wait until tonight to finally see his face and talk. This has been a long time coming , I'm  excited and  a few more steps and I'll be with my love.

August 26GH reacted to O&GForever in Going to Interview with Fiance
I'll be honest. The interview is all about your partner knowing you and every piece of evidence you submitted. My husband was mostly asked questions from chats and pictures I submitted throughout the process. (You can find my review in the Consulate Review section.)

I would highly recommend you read through the reviews and start quizzing your fiancé. My husband and I spent hours going over things...not so he would have memorized answers, but so he would no how to answer questions so the CO will understand. I also uploaded all of our evidence to Google Docs and sent him a link. This allowed my husband to look over things in his free time and he was aware of what the CO had in front of her. The only information the CO has to go off of is what you provide, so make sure your man knows the evidence inside and out.
