It was pretty straight forward on the yes/no questions but the officer drilled me so much to explain everything from the beginning with my abuser. That broke me down into tears then her attitude change once she saw the pain and trauma it caused me.

Timeline:
I360,485,765 - received 02/17/2017
Rfe 360 for bona fide marriage - 03/2017
Rfe received - 04/2017(resent mostly same stuff again)
[Moved to another state - 07/2017]
Vawa I-485 interview - 03/2020 (old state field office)
Notification interview complete and case must be reviewed
I-360 Approval - 06/2020
Rfe 485 for birth certificate - 07/2020
Rfe received - 08/2020
Vawa I-485 notice for interview again in my current state field office on - 10/2020
I-485 interview - 12/16/20
Rfe 485 paystubs and employment letter 17th the next day
Rfe received at local office 12/28/20
NOID due to.........address history not in line and advised to file form 601 waiver - 03/18/21
NOID responded with form 601 receipt notice and received - 04/27/21
Case status changed on 485 to card in production on - 06/30/21
I'm speechless, in tears and my heart is in shock. I just went on my knees to say a prayer for everyone in this journey. It's not over until it's over

It's likely you'll go for a new set of prints. In my case I went for a new set. They'll notify you to go to the nearest ASC to get them done.

You're very welcome my dear. Just in your free time read the form instructions with the form very well and it's self explanatory along with your statement, your VAWA approval notice and other evidence if applicable you'll attach to. Your lawyer will go over it if they're in agreement with the waiver.

That is very correct and just add to your submission.
Form I-601A : Certain immigrant visa applicants who are relatives of U.S. citizens or lawful permanent residents may use this application to request a provisional waiver of the unlawful presence grounds of inadmissibility under Immigration and Nationality Act section 212 (a)(9)(B), before departing the United States to appear at a U.S. Embassy or Consulate for an immigrant visa interview.
@Pinkrlion- I'm sure this was what you were referring to.
Form 601 : If you are inadmissible to the United States and are seeking an immigrant visa, adjustment of status, certain nonimmigrant statuses, or certain other immigration benefits, you must file this form to seek a waiver of certain grounds of inadmissibility. Please refer to the instructions to determine whether you should use this form.
(Approved VAWA applicants fall under this form for relief as mentioned in the form instructions)

@Cottoncandyskies from my little knowledge,I would highly recommend that you look over Form I- 601 Application for Waiver of Grounds of Inadmissibility waiver to resolve this issue. To me it's an easy fix as your statement and everything (evidence) will be submitted along with the above mentioned form to Vermont. Then with your response of receipt notice from Vermont, send a copy of the 797C along with this NOID to the office that sent you this NOID to let them know that the waiver is on going.
The usual time to respond to the NOID is about 33 days plus due to covid allowances by USCIS you have an extra 60 days to respond (total 83 days).
* current processing time for waivers under VAWA at Vermont is not known but takes around 2 - 6 months for approval which automatically kicks the approval of your 485 too.
Sorry if my explanation is a bit confusing but I hope it helps.

Yes that will be a straight out denial or Intent to deny. And if you do qualify for a waiver (Form I-601) you'll be advised to apply for it and once that gets approved your 485 will be approved subsequently and/ concurrently.

thank you so much 💚If you have all the documents with you outside there I'd suggest you do it anytime now. You could've done it 6 months before expiration but the earlier the better.

My VAWA was approved on Aug 6, 2019.
My I-485 (filed alongside my I-130) is still pending and was received in December 2016.
Shortly after submitting my VAWA application, I did send my local office (Baltimore) a letter asking that my I-485 be adjudicated based on my pending I-360 and not the I-130 my spouse had filed for me.
By God's grace, I have been able to renew my EAD twice so far.
I am hoping to hear from anyone with a similar timeline? Dealing with the Baltimore Field Office?
I have been waiting for an interview for about 18 months now from the Baltimore Field Office.
I have sent the Vermont Service Center letters to inquire. No response since August 2020.
I have reached out to the Ombudsman. No response since October 2020.
I have also reached out to my congressman a few days ago.
It seems I have exhausted all my options to get an update so I will continue to wait and see what gives.
Any insight would be much appreciated 🙂

My dear I know how it feels as I'm in the same soup with you, just a few months apart (Feb 2017) my I-360 has been approved, attended interview at Baltimore field office March last year and later transferred to my home state NC Charlotte field office which I attended the interview last December and got an rfe for employment letter with 2 pay stubs and copy of divorce decree. Still waiting and praying for everyone. Perseverance and patience will see us through this journey 🙏🙏🙏

I only had one on my 360 for bona fide marriage. I basically resent everything with additional affidavits and pictures. But on my 485, I've had 2 (one for birth cert before my interview was scheduled and other was divorce copy with employment letter+paystubs after my interview last December). Praying for a final outcome on that.🙏🙏🙏
Don't freak out. Just keep us posted on yours when you get it and will solved with the support on this page.

@Fishy89 I would highly not recommend you sue, the uscis.i was in your shoes from February 2017 until my approval for my 360 came in June 2020. Every enquiry from my senator and congresswoman was the generic awaiting background checks. February 17 coming up will be exact 4 years still waiting for a decision to be made on my 485.
Please 🙏 stay patient and keep the hope up.
