Hello all, I did a voluntary departure 10 years ago. My daughter is in the USA married to her husband. Can I apply for a visitors visa? I have proof of strong ties to my country Brazil. My daughter can apply for a  immigration visa for me but I do not want to live there. I would like to know if I should I apply or I am wasting my time or I need a waiver. Here is some more info about my case. 
 
March 2004, entered without inspection, never appeared in scheduled hearing, consequently July 2004 ordered removed.
-        October 2012 received Order of Supervision.
-        August 2013 Voluntary Departure.
-        Attempted tourist visa before 10 years, found ineligible under Section 212(a)(9)(B)(ii).
It has now been 10 years since she has been out of United States, my questions are:
1.     Does she need an I-212 waiver? Or can we submit a PD request to bypass the need for waiver, if that is the case?
2.     Will she then be able to apply and possibly be approved for a tourist visa? Or will she only be eligible for an immigrant visa?

Thank you and we got Jan 2nd notice online and it took until the 19th to get the mail so over two weeks. I was getting nervous but people told me thats not uncommon so just be patient it should be there soon.

Hey guys april 14th filer. Just got our interview scheduled for feb 2nd. 
so took about 10 months from filing to interview for a NJ Filer. for any NJ filers my field office is Mt Laurel not Newark so that may be why the quick processing time.

I just hopped in the March Filers chat and seems like this past week there has been an overwhelming amount of Cards being produced, all without an expedite.. Seems like Aprils will be coming very soon, God Willing !!

WOW thats awesome I was going to mention, I wonder if the I-485s would be a lot quicker since usually right now we would be receiving them already. USCIS was still working on cases just not biometrics because it was in person. Could be they have worked on cases already and just waiting for the BioMetrics too release cards. Wishful thinking but you never know.

Just got my biometrics appt in the mail Aug 13th. No update on the site though.

Wow congrats, without a biometrics appt they are sending a EAD/AP card? First ive heard so far.

Hey guys, so my fiance went for her K1 interview this morning. I came to this website about 16 months ago trying to get some info on my immigration situation. My fiance lived in the US illegally by coming across the border with her mother when she was 11 years old. She came thru Texas and was caught had a deportation hearing court date set that she never went to as they continued there way to New Jersey. She lived in the US for 11 years, went to school in the states all the way thru college. When the DACA program became available she applied and was excepted. By the time she got it she was 19-20 years old. She also had gotten one DUI in the US that was later expunged. That is a brief back drop of her history. All that being said we were under the assumption we would get to the K1 Interview and then need the 601 waiver. We talk to many lawyers who had said the same and our community on this site also thought the same. We were completely truthful about everything from the DS160 and at the interview today. The Interviewer knew her entire history and she was not hiding anything. It was a long interview and the he said he was granting her the visa after we fix one hiccup with her Medical exam. She even asked about the 601 waiver and if she needs it because we dont want to get to customs and be denied. The interviewer said that because she had gotten DACA and even though it was approved at 20 years old so she would have accumulated two years of illegal presence which would lead to a 10 year ban. That the DACA basically waives her 10 year ban and she is eligible for the visa without a waiver... I dont know if anyone has heard of this before, we are in shock with excitement but also still nervous because we were sure she needed the waiver. Does anyone have any knowledge about this?

wow just called today and they have my Case # and informed me that my case has already left as of yesterday and is at the embassy!!!! WOW yesterday they couldnt event give me a case # so for everyone waiting be patient.
