When is the background check process started? When the application first gets touched by the adjudicator, or before? For instance, I am a June filer, is there a possibility that a background check has already been issued, meaning are they usually initiated months before the NOA2, or no?

Backround checks are first process at CSC. they have to be completed before anything else, normally completed within the first 45 -60 days...usually, but whats that these days?

    Hi April Filers,

What is the difference between an I-134 Affidavit for Support and an I-864 Affidavit for Support.  I know I'm supposed to use the I-134 for this K-1 process, but I'm curious about the other form and when it's used. Thanks in advance!

864 is for spousal and at the AOS stage and perhaps later on at Removing Conditions. not sure on the last part, I haven't read that far ahead

Just think how much easier their job would be if the automated system they use either worked...or they actually updated it.

I mean some of them do work hard no doubt, but some don't just like anywhere else in life...But not all petitions are done wrong. Stuff happens, things get lost and have to be sent back in.

What's frustrating is our petitions go thru Background checks, then pre-screen, and finally on to the Adjudicator who apparently likes to issue an RFE 4-1/2 months after submission. People tend to get a bit sideways when that happens.

I don't pity them one bit, it's their job. At the end of the day they get to go home and kiss their SO and children and live their life. They don't have to keep reassuring a freaking out Fiancee, that everything will be fine, we just have to be patient.

    NO SYMPATHY FROM ME

Maybe they're being smart...promise a little, but deliver a lot. Then people get surprised and happy that it didn't take 60 days it took only 15 days.

And honestly, it seems like the job of answering phone calls from people wondering why their visa isn't done probably is one of the most painful jobs around. Can you imagine every day getting angry people with complaints? I mean, how  many people call to thank them for doing it quickly? :D

I sure don't envy them. Tough job.

Man ... I'd take it and run with it 😂 ... two weeks .. I'll be looking to my notification next Monday 😂 fingers crossed anyways ... Glad to hear its out the door and on the way to you! Here's hoping for a quick turn around for you!!

Same for you my friend. That service only cost me $600 for that RFE. I should have trusted my own ability and just made the time to complete it myself.

Okay, I will go ahead and do that once I get a second confirmation on here. Thank you so much. Also, my case is in the Philippines as well. Again, thank you and I wish you all the best of luck with your processing times. Don't give up on the White Christmas thing just yet, thats something to look forward too, and such just a feel good thought.

Once you have the # you're good. Hard copy doesn't always arrive

Well I hope so, maybe by next Friday I will have mine! The officer requested it the Tuesday after yours  ... I feel like calling someone and exercising my freedom of speech, but we all know that doesn't do any good

I'm just trying to do everything I can to make sure we're set up for a sprint at the end of this marathon. I can't speed them up but I can have our ducks in a row.

Just got an email about an RFE this morning. NOA1 was April 6th. Annoying, but better than the processing answer i have gotten for 3 weeks. Does anyone know if I call if I can get the specifics for the RFE? Basically can i find out what I need before the letter shows up, so that I can reply as soon as it does?

They won't tell you specifics, they say there's no way for them to know at the CSR level

Faye, she doesn't get on FB much, she pretty much goes to work and home.  I will let her know you want to connect.  She will have to connect with you, her FB account is private.  Send me a message with your FB name here or you can send me a friend request on FB, my name is Keith Armstead.

FB friend request sent since my account is private too..Thanks..

Like you @spike198, I found out about the RFE because I called.  It registered on the website 15 days or so after it was requested by the case officer. I received it 4 days later in the mail. Until you get notified that it was sent thru the website it isn't actually sent.  Hopefully it will be sent soon.

Keith I don't know how helpful your Tier 2 was when you called and found out about your RFE, but mine was very helpful. She even told me how to fix it before they issue it with email and direct fax#, but it only works if you know what you left out.

i felt that information was too dangerous to share because too many people might try and jump the shark guessing, causing them longer delays.

i decided to wait for mine to be sure of what they wanted.

The need to cancel comes from the fact that, if the airline makes a mistake and notify the authorities you are in that flight through the flight manifest, then immigration might think you were actually leaving the country before getting AP and, therefore, abandoning AOS.

I94 tracks all movements by foreign nationals to and from the US though. So point still stands. Flight manifests are generated by check ins not reservations, and are the last thing to enter the aircraft prior to departure. I think we are over thinking this :) corporations often purchase numerous flights to and from the US for their execs and then they take the earliest one they can make and cancel the others. There are also " throw away " legs in tickets.

I received status change notification that an RFE was sent on August 18. It travelled across the US and arrived here a week later (yesterday).

Prior to August 18 I heard nothing since I submitted the application in March.

I guess Faye and I are tag teaming this morning on VJ :)

man that is awesome! I hope it was an easy fix.

The thirty day thing seems to be yet another canned response.

In thin case it is not just a curtosey to the airline. Not cancelling can cause some serious headaches when you try to go through adjustment of status and they think that you actually took that return flight and left the country. It shouldn't happen, but it has on several occasions.

Ok... So you left the country on the return ticket before AP or issued a waiver, and somehow got back in without them knowing it? Not saying it couldn't be an issue for a complete moron processing the AOS, but seriously?
