  6. I don’t recommend doing this if both parties live in the US. Moroccan courts have no jurisdiction over residents of the US, and we’ve seen issues with the legality of such divorces here on VJ.

  9. It will take two years, and the IR visa is your only option.
  10. I don’t know of specific cases, but same-sex marriage is legal in all 50 states, so there would not be any issues there with local religious politics, as US consulates operate under US law. The name on the visa would need to match the name on the passport it is placed in. Maybe others with more knowledge of Morocco can speak to this, but it might be better to look at getting married outside of Morocco or via Utah online, and pursuing a spousal visa.
  11. I was just thinking about this, and the only plausible explanation I can find is exactly that- outlier record-fast approvals can positively skew the overall performance data while retaining the backlog that supports large fee increases.

  13. Normal procedure is that they specifically request it when they are ready to issue the visa, with instructions on how to courier it.

  16. Odd that she could simply abandon all of that to stay in the US for months and months.... all in order to avoid the queue for an immigrant visa. Yes, you can jump the queue, but there are drawbacks that you take on when you make that choice.
  17. You were advised to send it by whom? Did she have her interview, and now the consulate is asking for her passport? If so, they will advise you as to the procedure for sending it. Otherwise, you don't just send an unsolicited passport. Your message is not clear. Where are you in the visa process?
  18. You really think that will work? I don't. In light of this document, if all of that takes place before the 30 day deadline, it will see just as "clearly staged" as the photos. I don't think I've ever seen a consulate declare in such resolute language that they believe the case to be a fraud.

  21. Indian courts have no jurisdiction in California. You’d have to start from scratch. Again, this is not legal advice, and I recommend you seek legal advice.

  23. I may be wrong, but I believe you wouldn't be eligible if you move back before the visa processing/interview etc. The expectation is that you're still living abroad with your spouse.
